Beijing, Jan. 4 (Xinhua) According to the website of the Ministry of Health of China, in order to implement the Fourth Supplementary Agreement on Closer Economic Partnership Arrangement between the Mainland and Hong Kong and Macao, according to the provisions of China's Law on Medical Practitioners, Regulations on the Administration of Medical Institutions and other relevant laws and regulations, The relevant matters concerning the establishment of individual clinics in the Mainland by qualified permanent residents of Hong Kong and Macao (hereinafter referred to as Hong Kong and Macao service providers) are hereby notified as follows:

1. Hong Kong and Macao service providers who have obtained the Mainland's "Medical Qualification Certificate" (medical practitioners in clinical, traditional Chinese medicine and stomatology categories) may apply for the establishment of individual clinics in the Mainland when they meet one of the following conditions:

(1) They have legal medical practice in Hong Kong and Macao.

(2) Having been engaged in clinical work in the same major in the Mainland for more than 5 consecutive years.

2. A Hong Kong or Macao service provider can only set up one individual clinic in the Mainland, which is wholly owned by himself and is the person in charge of the individual clinic.

3. Service providers from Hong Kong and Macao who set up individual clinics in the Mainland should register and practice in the individual clinic. If they cannot continue to practice for some reason, they should go through the formalities of canceling the individual clinic according to law.

5. In principle, individual clinics may not employ other medical practitioners. Due to the necessity of medical services, 1-2 medical practitioners (mainland residents) with the same scope of practice as service providers in Hong Kong and Macao who set up individual clinics can be employed to participate in the work. According to the needs of medical services, individual clinics can employ an appropriate number of registered nurses in the Mainland.

VI. The names of individual clinics opened by service providers in Hong Kong and Macao shall, in principle, be approved as "the place name of the place+the name of the service provider in Hong Kong and Macao+the subject+the clinic".

VII. Service providers from Hong Kong and Macao who apply for opening individual clinics shall apply to the municipal health administrative department of the district where the clinic is located with relevant certificates and materials, and report to the provincial health administrative department for examination and approval after preliminary examination. The provincial health administrative department will issue the Approval Letter for Setting up Medical Institutions and report it to the Ministry of Health for the record; To apply for the establishment of individual clinics of traditional Chinese medicine, the municipal administrative department of health with districts shall, after preliminary examination, report to the provincial administrative department of traditional Chinese medicine for examination and approval, issue the "Letter of Approval for the Establishment of Medical Institutions", and report it to state administration of traditional chinese medicine and the Ministry of Health for the record. The practice registration, daily supervision and management of individual clinics shall be handled in accordance with the provisions of the administrative department of health and the administrative department of traditional Chinese medicine at or above the provincial level.

VIII. Service providers in Hong Kong and Macao shall submit the following certificates and materials in addition to the relevant application materials in accordance with the Regulations on the Administration of Medical Institutions and its detailed rules for implementation:

(1) Qualification Certificate for Doctors in the Mainland (original and photocopy);

(2) practising certificate or license/registration certificate of Hong Kong and Macao recognized by the Medical Council of Hong Kong, the Dental Council of Hong Kong, the Chinese Medicine Council of Hong Kong or the Macao Health Bureau (original and photocopy);

(3) The insurance coverage issued by insurance institutions in the Mainland or Hong Kong and Macao includes the medical liability insurance certificate in the Mainland (original);

(4) professional ethics/good reputation certificates of Hong Kong and Macao issued by the Medical Council of Hong Kong, the Dental Council of Hong Kong, the Chinese Medicine Council of Hong Kong or the Macao Health Bureau (original); Or the certificate of practice experience (original) and the "Doctor's Practice Certificate" (copy) issued by the health administrative department at or above the municipal level in the mainland.

IX. Individual clinics set up by service providers in Hong Kong and Macao shall abide by the relevant laws, regulations and provisions of mainland medical institutions, medical technology management, medical practitioners and practical nurse, and standardize their practice according to the principle of ensuring medical quality and medical safety. Medical accidents and disputes arising in the course of medical activities shall be handled in accordance with the relevant regulations of the Mainland.

X. this notice will be implemented as of January 1, 28.

There is a provision in p>CEPA that medical graduates from the University of Hong Kong and the Chinese University can apply for the mainland medical qualification examination. During a recent visit to Hong Kong, Vice Minister of Health Huang Jiefu announced that the qualifications will be relaxed, so that doctors who have graduated from the mainland or abroad can take the examination and practice in the mainland as long as they have a medical license in Hong Kong.
