Notice of the Ministry of Finance on Issuing the Interim Measures for the Administration of the Use of Construction Funds for the Three Gorges Project

Chapter I General Provisions Article 1 These Measures are formulated to ensure the safety, integrity, preservation and appreciation of the construction funds of the Three Gorges Project, promote the rational and effective use of the construction funds of the Three Gorges Project, and prevent the construction funds of the Three Gorges Project from being diverted, misappropriated, wasted and lost. Article 2 The funds for the construction of the Three Gorges Project include the Three Gorges Project Construction Fund allocated by the state, loans from the China Development Bank and various funds raised by China Three Gorges Project Development Corporation (hereinafter referred to as the Three Gorges Corporation) for the Three Gorges Project. Article 3 The principle of "differentiated treatment, classified management and earmarking" shall be adhered to in the management of funds for the construction of the Three Gorges Project, that is, different management methods shall be adopted for the construction funds of the Three Gorges Project according to different users and nature of funds. Where the direct use of units, the Three Gorges Project construction funds can only be used for the Three Gorges Project expenditure, and shall not be used for other purposes; Where the indirect use of units, the Three Gorges Project construction funds should first meet the relevant expenses stipulated in the contract. Article 4 These Measures are applicable: (1) Units that directly use the construction funds of the Three Gorges Project include the Three Gorges Corporation, the Immigration Development Bureau of the the State Council Three Gorges Project Construction Committee (hereinafter referred to as the Immigration Development Bureau) and local immigration agencies, the the State Council Three Gorges Project Construction Committee Office, and the State Grid Construction Corporation; (2) The contractors who indirectly use the construction funds of the Three Gorges Project include the Yangtze River Water Conservancy Commission (hereinafter referred to as the Standing Committee), other design units of the Three Gorges Project, the shipping headquarters of the Three Gorges Project of the Ministry of Communications, and various construction units (including other domestic contractors), scientific research units, supervision units and relevant domestic manufacturers during the performance period. Chapter II Management of the Use of Construction Funds for the Three Gorges Project by the Three Gorges Corporation Article 5 The Three Gorges Corporation is the project legal person of the Three Gorges Project, and is fully responsible for fund raising, operation management and asset preservation and appreciation after the Three Gorges Project is put into operation. The Three Gorges Corporation shall conduct investment control and management in accordance with the budgetary estimate approved by the state and the requirements of "static control and dynamic management", and strictly regulate the use of internal funds. Article 6 The Three Gorges Corporation shall submit the investment plan of the Three Gorges Project for the next year to the state on time every year, and prepare the annual capital plan according to the annual investment plan approved by the state. In addition to the Three Gorges Project Construction Fund allocated by the state and the loan application from the China Development Bank, we will actively raise and rationally allocate funds in accordance with relevant state policies and regulations. Article 7 The Three Gorges Corporation shall, according to the project plan, contract and schedule, timely allocate the construction funds for the Three Gorges Project used by other units without undue delay. According to the annual immigration investment plan approved by the state and the availability of funds, timely allocate funds for immigrants in the reservoir area; Survey and design fees and "three navigation fees" are allocated according to the actual work progress according to the annual investment plan approved by the state and the contract signed by both parties; Used for project progress payment, scientific research fee, supervision fee, material and equipment purchase fee, etc. Strictly fulfill the economic contract and allocate funds according to the work progress. Article 8 The Three Gorges Corporation shall strengthen the management of internal fund use and establish necessary incentive and competition mechanisms. According to these measures, formulate specific management measures such as project price settlement, expenses, equipment and materials, price difference and investment saving, and report them to the Ministry of Finance for the record. Article 9 The internal organs of the Three Gorges Group shall be self-supporting in principle. It is really not feasible to distinguish between self-supporting and self-supporting or full budget units. Without the approval of the Ministry of Finance, the construction funds of the Three Gorges Project shall not be used. The operating companies set up by the Three Gorges Corporation shall carry out independent accounting and be responsible for their own profits and losses, in strict accordance with the document No.22 of the Ministry of Finance (1995), that is, the Interim Provisions on Several Financial Issues Concerning the Establishment of Enterprises by State-owned Enterprises. They should draw a clear line with the head office in assets, institutions and personnel and implement financial decoupling. Article 10 Policy loans and special loans arranged by the state are part of the construction funds of the Three Gorges Project. The Three Gorges Corporation shall sign a loan contract with the China Development Bank or other handling banks, strictly implement the loan agreement, and implement the relevant systems and management measures of the relevant banks. Chapter III Management of Reservoir Flooding Compensation Article 11 Reservoir Flooding Compensation of the Three Gorges Project (referred to as resettlement funds) is an important part of the total investment of the Three Gorges Project. The Immigration Development Bureau shall, in accordance with the management system of "unified leadership by the central government, responsibility by province and county-oriented" formulated by the State Council, arrange and use the immigrant funds reasonably. Article 12 The Immigration Development Bureau shall submit the resettlement fund plan for the next year to the the State Council Third Construction Committee and the Three Gorges Corporation on time every year, and apply for funds in time. Immigration agencies at all levels should strengthen the progress of the allocation of resettlement funds, reduce the allocation links, shorten the detention time of funds, and ensure that the resettlement funds in various places are in place in time. Thirteenth immigration agencies at all levels should strengthen the management of immigration funds, and use immigration funds in accordance with the principle of earmarking. It shall not be used for unplanned projects, and if it is really necessary to adjust the plan, it shall be reported to the relevant state departments for approval; It is not allowed to expand the scope of use of immigrant funds without authorization, and it is strictly forbidden to intercept, occupy or misappropriate immigrant funds. The immigrant funds saved in that year shall not be used for other purposes, and can only be carried forward to the next year. The interest income generated during the temporary storage of resettlement funds by immigration institutions at all levels will increase accordingly and be included in the resettlement project construction plan; All the interest income generated during the use of the immigrant construction unit shall be returned to the construction unit to offset the construction cost.
