Can overseas Chinese regain China citizenship when they return to China?

Hello, most China friends in the United States know that China does not recognize dual citizenship, that is to say, if you become an American citizen, you are not a China citizen. If you return to China with a China passport ... let's talk about what happened to a China who joined a foreign country after returning home. ...

Recently, the Chinese Embassy in the UK found that some applicants who joined foreign countries and held Chinese visas were suspected of defrauding China passports. The Embassy handled the case in accordance with the relevant laws and policies of China.

Article 3 of the Nationality Law of the People's Republic of China stipulates that "People's Republic of China (PRC) does not recognize dual nationality", and Article 9 stipulates that "China citizens who have settled in foreign countries will automatically lose their China nationality if they voluntarily join or acquire foreign nationality."

For applicants who illegally obtain China passports in violation of the above provisions, the China Embassy and Consulate in the UK will cancel or declare the relevant documents invalid, and the relevant personnel will be refused visas or entry.

As we all know, China does not recognize dual nationality. Anyone who voluntarily joins or acquires foreign nationality will automatically lose China nationality and his household registration shall be cancelled.

Although there is an express provision, the reality is that many China people who emigrate overseas will try their best to keep their registered permanent residence in China after becoming foreign nationals, so that it is more convenient to start a business, buy a house, provide for the aged, manage money, provide medical insurance, send their children to school and enjoy more benefits.

There are two ways to retain China nationality after joining the United States:

1. Keep the green card law.

Apply for a new green card 6 months before naturalization on the grounds that the green card is lost, and the validity period is 10 year.

When you need to turn in your green card for naturalization, you can claim that your green card has been lost again, so that you can hold a green card valid for 10 years after naturalization.

After that, every time I entered China, I used a China passport and a green card when I left. Enter the United States with an American passport.

2. Transit law of third countries.

If there is no green card, or the green card has expired, then:

1. Enter China from the United States with a China passport.

2. If you want to return to the United States from China, you should first sign a third-country visa on your China passport (Korea, Japan and Southeast Asia will do), and then use the visa to travel to a third country.

3. Go to America from a third country. Come back from America and enter a third country.

4. Return to China with a China passport from a third country.

In this way, you can keep your China nationality account ID card and save you all kinds of troubles when you enter a foreign country.
