Chapter 1 General Provisions Article 1 In order to strengthen the management of the Yellow River Project, improve flood resistance, maximize the comprehensive benefits of the project, and ensure economic construction, social development and the safety of people's lives and property, according to the "People's Congress of the People's Republic of China" These regulations are formulated in accordance with the provisions of the "Heguo Water Law", the "Regulations of the People's Republic of China on the Management of Heguo Rivers" and other relevant laws and regulations, and in combination with the actual situation of the Yellow River (including Qin River, the same below) project within the administrative region of this province. Article 2 These regulations apply to the management and protection of the Yellow River Project within the administrative region of this province.

The term "Yellow River Project" as mentioned in these Regulations refers to the large embankments of the Yellow River (including Qinhe Embankment, Taihang Embankment, Beijin Embankment, Guanmeng Embankment, Wenmengtan Resettlement Protection Embankment, old embankments, old dams, etc. ), hazardous works, culverts, flood diversion, flood detention, river control and guidance, beach protection and other projects, as well as various engineering signs and signs, transportation, power, communications, management and protection, observation, protective forest and other facilities. Article 3 The management of the Yellow River Project shall adhere to the principles of unified planning, hierarchical management, streamlining and efficiency, and implement equal emphasis on construction and management, separation of management and maintenance, rational development, and paid use. Article 4 The legally delineated embankment areas, dam protection areas, gate protection areas, siltation adjacent areas, siltation back areas, old embankments and old dams along the Yellow River are owned by the state and are managed and used by the Yellow River River Affairs Department. No unit or individual may occupy the property without authorization. Article 5 People's governments at all levels along the Yellow River should strengthen leadership over the construction of the Yellow River Project, organize relevant departments, units and local people to support the construction of the Yellow River Project, coordinate land use for project construction, resettlement and compensation, etc., to ensure the smooth progress of project construction. Article 6 The Yellow River River Affairs Department of the province, provincial city, county (city, district) is the competent authority of the Yellow River Project within its own administrative region. It exercises the duties of the Yellow River water administrative department and, in accordance with the principle of hierarchical management, uniformly manages the Yellow River channel in accordance with the law. and the Yellow River Project.

The local public security organs are responsible for the security and protection of the Yellow River Project. Article 7 Yellow River administration departments at all levels should establish and improve management responsibility systems and gradually establish a market-oriented, professional and socialized Yellow River engineering maintenance system.

Repair and maintenance units shall complete maintenance and repair operations in strict accordance with the contract. Article 8: Any unit or individual has the obligation to protect the facilities of the Yellow River Project, and has the right to stop, report and accuse any behavior that damages the Yellow River Project. Chapter 2 Embankment Management Article 9 The management scope of the Yellow River embankment project includes: the embankment (dam) body, the embankment area and the embankment project safety protection zone.

Delimitation standards for the scope of embankment areas:

(1) Yellow River embankment, above the head of the east dam in Lankao County, with no less than three sides on the left and right banks facing and behind the embankment feet. Ten meters; below the head of the east dam and across the Meng Dike, Taihang Dike, Beijin Dike, and the Yellow River embankments in Mengjin County, Mengzhou City, and Wen County, the outside of the river is no less than 30 meters, and the back of the river is no less than 10 meters;

(2) Qinhe River Embankment, the outside of the embankment foot facing the river shall not be less than ten meters, and the back of the embankment shall not be less than five meters.

If the original embankment land fails to meet the above requirements, it shall be set aside by the provincial municipal and county (city, district) people's governments in accordance with the prescribed standards. The Yellow River River Affairs Department shall handle the land use procedures in accordance with national and provincial regulations. .

The scope of the safety protection zone of the Yellow River embankment project:

(1) Fifty meters outside the foot of the Yellow River embankment facing the river and one hundred meters away from the river;

(2) ) Qinhe embankment is 30 meters away from the river and 50 meters away from the river. Article 10 It is prohibited to retrieve soil, dig wells, blast, dig ditches, dig cellars, dig fishing ponds, build kilns, bury graves, build houses, discharge waste, waste residue, grazing, and shovel turf within the dike (dam) body and the embankment area. , illegal cultivation, land clearing, drying grain, stacking materials, conducting market trade and other activities that are harmful to the integrity and safety of the embankment body.

It is prohibited to collect soil, dig wells, dig cellars, build kilns, dig ditches, blast, bury graves, discharge waste (slag) and other activities within the safety protection zone of the embankment project. Article 11 It is prohibited to carry out blasting operations without authorization within 200 meters outside the safety protection zone of the Yellow River embankment project; if blasting operations are really necessary or large-volume blasting outside the 200-meter range endangers the safety of the embankment project, the construction unit shall Applications must be submitted to the local Yellow River Affairs Department, which will be reviewed and approved by the Yellow River Affairs Department in conjunction with the public security department before implementation.

Article 12 Strictly control the construction of projects on the Yellow River embankments. If construction is really necessary, the opinions of the local Yellow River River Affairs Department should be obtained in advance. On the premise of ensuring flood control safety, design documents should be prepared and submitted step by step. Construction can only be carried out after approval from the Ministry of Water Resources or the Yellow River Water Conservancy Commission.

It is prohibited to break dikes (dams) without authorization to divert water, drain water, bury pipelines or build other projects. Article 13 If non-flood control project construction activities are carried out within the scope of embankment project management and the project is damaged, the construction unit shall reinforce, repair, and reconstruct it in accordance with the original design standards; if the construction unit cannot or cannot reinforce, repair, and reconstruct it on time, the construction unit shall The Yellow River River Affairs Department organizes reinforcement, repair, and reconstruction, and the costs required are borne by the construction unit.

If the operation and use of non-flood control engineering facilities increases the workload of embankment project management and related engineering protection responsibilities, the construction unit or management and user unit shall bear the corresponding expenses. Article 14: Approved construction projects within the scope of embankment project management must comply with flood control safety regulations, and the Yellow River River Affairs Department has the right to supervise and inspect the construction. When the project is completed and accepted, the Yellow River Affairs Department must participate and sign for approval before it is valid. During the operation period of the project, it shall be subject to supervision by the Yellow River River Affairs Department.

For existing projects within the management scope of embankment projects that do not comply with flood control safety regulations, the management and use unit must reinforce, rebuild or dismantle them, and the costs shall be borne by the management and use unit.
