Measures for the administration of state-owned forest farms
Article 1 In order to standardize and strengthen the management of state-owned forest farms and promote the high-quality development of state-owned forest farms, these Measures are formulated in accordance with the Forest Law of People's Republic of China (PRC) and relevant laws, regulations and rules.
Article 2 These Measures shall apply to the construction and management of state-owned forest farms.
The term "state-owned forest farm" as mentioned in these Measures refers to the public welfare undertakings and enterprises established in accordance with the law to protect, cultivate and utilize forest resources.
Article 3 State-owned forest farms should adhere to ecological priority and green development, strictly protect forest resources, vigorously cultivate forest resources, make scientific use of forest resources, earnestly safeguard national ecological security and timber security, and constantly meet the people's growing demand for good ecological environment and high-quality ecological products.
Article 4 State-owned forest farms should scientifically determine development goals and tasks according to ecological location, resource endowment, ecological construction demand and other factors, adjust measures to local conditions, make classified policies, actively innovate management systems, and enhance development momentum.
Fifth forestry authorities at or above the county level shall be responsible for the management of state-owned forest farms within their respective administrative areas in accordance with the management authority.
Cross-regional (city) and county (city, district) state-owned forest farms are managed by cross-regional forestry authorities at the same level.
Article 6 No organization or individual may infringe upon the right to use state-owned forest land and the right to use forests and trees on the forest land legally obtained by state-owned forest farms.
Article 7 State-owned forest farms shall, in accordance with the law, conduct unified management of natural resource assets such as forests within the scope of operation and management, and their main responsibilities include:
(a) in accordance with the requirements of scientific greening and the concept of grass and sand system management in landscape forest, field and lake, organize afforestation and ecological restoration;
(two) in accordance with the requirements of strict protection and scientific protection, organize the management and protection of forest resources, forest fire prevention and forest pest control;
(3) Organizing the construction of national reserve forests and the management and utilization of forest resources in accordance with the principles of scientific utilization and sustainable utilization;
(4) Organizing scientific research, technology popularization, pilot demonstration, ecological culture and popularization of science;
(five) other duties as prescribed by laws and regulations.
Article 8 State-owned forest farms shall set up boundary markers or other boundary markers at the boundary of their business management scope, and no unit or individual may destroy or move them without authorization.
Chapter II Establishment and Management
Ninth the establishment of state-owned forest farms, in addition to the basic conditions for the establishment of legal persons as stipulated by laws and regulations, should also have a certain scale, clear ownership, clear "four areas" of woodland.
The newly established state-owned forest farm shall, within 30 days from the date of its establishment, report the approval documents to the State Forestry and Grassland Bureau step by step.
Tenth to encourage the establishment of state-owned forest farms in key ecological function areas, ecologically fragile areas, and ecological migration areas.
Eleventh state-owned forest farms should maintain long-term stability, and shall not be revoked, divided or changed without authorization.
Twelfth state-owned forest farms should establish and improve the management system of forest resources protection, cultivation, utilization and human, financial and material resources, and improve the management level.
Thirteenth the implementation of post management system. State-owned forest farms should scientifically and reasonably set up management, professional technology, forestry skills, work-study skills and other positions in accordance with the requirements of the Guiding Opinions on Post Setting Management of State-owned Forest Farms, and formulate post responsibilities and management measures.
Article 14 A financial management system shall be implemented. State-owned forest farms shall, in accordance with the provisions of the financial system of state-owned forest farms (nurseries), formulate financial management measures and improve financial management measures.
Fifteenth the implementation of employee performance appraisal system. State-owned forest farms shall, in accordance with the provisions of the Measures for the Performance Appraisal of Workers in State-owned Forest Farms, formulate specific measures for the performance appraisal of workers according to local conditions.
Encourage state-owned forest farms to establish a system linking employee performance appraisal results with salary distribution, and explore measures to reward employees after deducting costs from operating income and social service income and withdrawing funds according to regulations.
Sixteenth the implementation of the file management system. State-owned forest farms shall, in accordance with the provisions of the Measures for the Administration of Archives of State-owned Forest Farms, improve archival materials such as comprehensive management, forest resources and forest management, and ensure that the archives of state-owned forest farms are true, complete, standardized and safe.
Chapter III Protection and Supervision of Forest Resources
Seventeenth state-owned forest farm forest resources to implement the national, provincial and municipal forestry authorities grading supervision system, focusing on the supervision of forest land nature, forest area, forest volume and so on.
Eighteenth to maintain the long-term stability of the scope and use of state-owned forest farms, and strictly control the conversion of forest land into non-forest land.
Approved occupation of forest land in state-owned forest farms, forest compensation fees, resettlement subsidies, vegetation restoration fees and social security fees for employees shall be paid in full according to regulations.
Nineteenth state-owned forest farms should set up management and protection stations reasonably, equipped with necessary management and protection personnel and facilities, and strengthen the capacity building of forest resources management and protection.
Article 20 State-owned forest farms should conscientiously perform their duties of forest fire prevention, establish and improve the responsibility system for forest fire prevention, formulate fire prevention plans, organize fire fighting teams, equip them with necessary fire prevention facilities and equipment, and improve their fire prevention and early fire handling capabilities.
Twenty-first state-owned forest farms should be equipped with necessary technical personnel and facilities and equipment according to the relevant requirements of the national forest pest control, so as to improve the monitoring and control capabilities of forest pests and diseases.
Twenty-second state-owned forest farms should strictly protect wild animals and wild plants within the scope of management. Take necessary measures to protect the habitat and growth environment of wild animals and plants protected by national and local legislation.
Twenty-third state-owned forest farms that meet the statutory conditions may be entrusted by the competent forestry authorities at or above the county level to implement administrative law enforcement activities within the scope of operation and management.
The competent forestry authorities at or above the county level may coordinate the local public security organs to set up law enforcement sites in state-owned forest farms as needed.
Chapter IV Cultivation and Management of Forest Resources
Twenty-fourth the implementation of the forest management system of state-owned forest farms with forest management plan as the core, and establish and improve the internal decision-making management and external support guarantee mechanism based on forest management plan. State-owned forest farms shall prepare forest management plans, which shall be implemented after being approved by the provincial forestry authorities in principle.
Twenty-fifth state-owned forest farms shall carry out forest harvesting and reforestation in accordance with the provisions of the cutting license and relevant technical regulations.
Twenty-sixth state-owned forest farms should adopt excellent varieties, carry out afforestation and greening, and take measures such as tending young and middle-aged forests, restoring degraded forests, and transforming low-quality and inefficient forests to improve the quality of forest resources.
Twenty-seventh encourage state-owned forest farms to take various forms to carry out afforestation in different places, and give play to the leading role of state-owned forest farms in land greening.
Twenty-eighth to encourage state-owned forest farms to build fast-growing, high-yield, precious tree species and large-diameter timber forests, increase timber reserves, and give play to the backbone role of state-owned forest farms in maintaining national timber safety.
Twenty-ninth encourage the integrated development of state-owned forest farms and forest seedlings, and give play to the main role of state-owned forest farms in producing and providing public welfare seedlings.
Thirtieth state-owned forest farms can make rational use of forest land resources and forest landscape resources, carry out activities such as under-forest economy, forest tourism and nature education, and guide and support social capital to cooperate with state-owned forest farms in the utilization of forest resources.
Thirty-first forest resources assets of state-owned forest farms shall not be transferred without approval, and shall not provide any form of guarantee for other units and individuals.
Chapter V Safeguard Measures
Article 32 The competent forestry authorities at all levels shall incorporate the policies of forest resources protection and cultivation, infrastructure, talent team construction and financial support of state-owned forest farms into the scope of implementation of the forest length system, and give play to the role of the forest length system in consolidating and expanding the reform achievements of state-owned forest farms and promoting the green development of state-owned forest farms.
Thirty-third provincial forestry authorities shall, according to the actual needs, formulate long-term development plans for state-owned forest farms, promote the formulation of local laws and regulations for state-owned forest farms, and strive to introduce various support policies.
Article 34 Infrastructure and supporting service facilities such as roads, power supply, water supply, communication, management and protection houses within the management scope of state-owned forest farms shall be incorporated into the national economic and social development plan of the people's government at the same level.
Thirty-fifth encourage financial and insurance institutions to develop financial and insurance products suitable for the characteristics of state-owned forest farms, raise funds needed for the reform and development of state-owned forest farms, and improve the ability of state-owned forest farms to resist natural disasters. Encourage social capital to participate in the construction of state-owned forest farms.
Thirty-sixth forestry authorities at all levels should actively send business backbones to state-owned forest farms. Encourage targeted enrollment, targeted training, targeted employment and other ways to supplement the professional and technical personnel of state-owned forest farms.
Thirty-seventh forestry authorities at all levels should strengthen the education and training of cadres and workers in state-owned forest farms, and improve the quality and ability of cadres and workers.
Thirty-eighth forestry authorities at or above the county level shall commend and reward the state-owned forest farms or employees who have made remarkable achievements in the construction and management of state-owned forest farms, and draw the people's governments at or above the county level to commend and reward them in accordance with relevant regulations.
Chapter VI Supplementary Provisions
Article 39 These Measures shall be interpreted by the State Forestry and Grassland Bureau.
Article 40 These Measures shall come into force as of the date of promulgation, and the Measures for the Administration of State-owned Forest Farms promulgated by the former State Forestry Administration on 2011shall be abolished at the same time.

Article 1 This Law is formulated for the purpose of practicing the concept that green mountains and green waters are priceless, protecting, cultivating and rationally utilizing forest resources, speeding up land greening, ensuring forest ecological security, building ecological civilization, and realizing harmonious coexistence between man and nature.
Article 2 This Law is applicable to the protection, cultivation and utilization of forests and trees and the management of forests, trees and woodlands in People's Republic of China (PRC).
Article 3 The protection, cultivation and utilization of forest resources should respect and conform to nature, and adhere to the principle of giving priority to ecology, protection, conservation and sustainable development.
Article 4 The State implements a target responsibility system and an assessment and evaluation system for the protection and development of forest resources. The people's government at a higher level shall assess the situation that the people's government at a lower level has completed the development goals of forest resources protection, forest fire prevention and control of major forest pests and diseases, and announce the assessment results to the public. Local people's governments may, according to the needs of the protection and development of forest resources in their respective administrative areas, establish a forest director system. Article 5 The state adopts fiscal, taxation and financial measures to support the protection and development of forest resources. People's governments at all levels shall ensure the investment in forest ecological protection and restoration, and promote the development of forestry.
