According to the State Council's Decision on Deepening Reform and Strict Land Management (Guo Fa [2004] No.28), the State Council's Notice on Strengthening Land Regulation (Guo Fa [2006] No.31), Chongqing Municipal People's Government's Notice on Adjusting Land Requisition Compensation and Resettlement Policy (Yu Fu Fa [2008] No.45) and land management laws and regulations,

The first is to adjust the methods and standards of land acquisition compensation and resettlement.

(1) Land compensation fee and resettlement subsidy

Land compensation fees and resettlement subsidies are calculated separately. The land compensation fee is calculated according to the area of the expropriated land regardless of the land type. The land compensation standard within the administrative area of our county is per mu 15000 yuan; The resettlement subsidy is calculated according to the number of non-resettlement agricultural population, and the resettlement subsidy standard for each non-resettlement agricultural population is 25,000 yuan.

Land compensation fee is the compensation obtained by rural collective economic organizations whose land has been expropriated. 80% of the total land compensation fee is first used as a whole for landless farmers to participate in the basic old-age insurance for urban enterprise employees, and the land administrative department will allocate it to the labor and social security department on their behalf; The remaining 20% is paid to the rural collective economic organizations whose land has been expropriated, which is used to develop the collective economy and arrange the production and life of the members of the collective economic organizations.

The payment of resettlement subsidies is determined according to the different age groups of landless farmers, and the resettlement subsidies are paid in full to individuals under the age of 16. For 16-year-old and above landless farmers, their individuals should pay 50% of the total cost of participating in the basic old-age insurance for employees of urban enterprises according to relevant regulations, and the land administrative departments will allocate it to the labor and social security departments from their resettlement subsidies to be used exclusively for the basic old-age insurance for landless farmers, and the rest of the resettlement subsidies will be paid to individuals to arrange their production and life.

If 80% of the land compensation fee and the monks who pay the basic old-age insurance fee can't meet the capital demand of the landless peasants to participate in the basic old-age insurance, the difference will be made up by the land-expropriated units until the capital demand of the landless peasants to participate in the basic old-age insurance is met.

(two) compensation for rural houses, young crops and ground structures (attachments).

The compensation standard for rural houses and young crops shall be implemented according to the attached table 1 2; Compensation for attachments on the ground, such as bamboo and wood, is 5,000 yuan per mu according to the comprehensive quota of land area (excluding construction land), which is paid by the land acquisition implementation unit to the expropriated collective economic organizations, and distributed to the owners of attachments on the ground by the collective economic organizations; The above-ground structures shall be cleared and registered by the land acquisition implementation unit, and the compensation fee shall be calculated according to Schedule 4 and paid directly to the owner of the above-ground structures. After the announcement of land requisition, the robbed structures will not be compensated.

Relocation subsidy standards for large-scale breeding households (more than 3 cows, more than 20 pigs (including sheep and dogs) and more than 200 chickens, ducks, geese and rabbits): 500 yuan for each cow, 30 yuan for each pig, 10 yuan for each sheep and dog, and 3 yuan for each chicken, duck, goose and rabbit that are not large-scale breeding households. After the announcement of land acquisition,

Land-expropriated units with independent accounting of water, electricity and gas shall be compensated according to the installation cost at the time of land acquisition.

Cable radio and television lines and data communication lines with separate accounts shall be compensated according to the installation cost when land is expropriated.

The decoration of the demolished house shall be demolished by the owner without compensation. If it cannot be dismantled by itself, appropriate comprehensive compensation shall be given in accordance with Schedule 3.

If the villagers' houses are used for other purposes, compensation shall be made on the basis of the houses. The relocation loss, shutdown loss and relocation subsidy of the equipment that the villagers have used and obtained legal business procedures for production and business activities shall be calculated according to 15%-20% of the depreciated net value of the relocated equipment.

If the relocated households whose land is expropriated are relocated within the prescribed time limit, the relocation subsidy shall be paid in one lump sum by 400 yuan per person; Relocation subsidy is one-time per person 1000 yuan.

(3) Housing placement

The per capita construction area of rural residents' housing resettlement for land acquisition and demolition is 30 square meters.

Actively promote housing monetary resettlement, and the specific standards for monetary resettlement are determined according to the sales price of affordable housing and the scope of land acquisition in the adjacent areas of the county.

According to the social and economic development and the changes in the real estate market, the sales price of affordable housing in the adjacent areas within the scope of land acquisition is clearly defined in the resettlement plan for land-expropriated rural houses, which shall be determined and promulgated by the county government before implementation. Housing resettlement object to implement monetary resettlement, requiring directional purchase of affordable housing, monetary resettlement standards in accordance with the county government to determine the monetary compensation standards for affordable housing.

Where monetary resettlement is implemented for the land-expropriated and relocated personnel, and it is required to purchase directional affordable housing, the government can provide the owners with the right to use state-owned construction land in the way of "government guidance, market operation and owner's responsibility", and the owners will build houses through bidding, and the owners will sell them to the land-expropriated farmers who have already made monetary resettlement to meet their housing needs. Directional construction and sales of housing for rural residents whose land has been requisitioned and demolished enjoy relevant preferential policies for the construction of affordable housing.

For those who move from rural areas to cities and towns, if the relocation is completed within the time of the announcement of the relocation of land-expropriated rural houses, 200 yuan will be rewarded for each person who moves one day in advance.

After June 65438+1 October1in 2008, self-built housing resettlement will no longer be implemented in the urban planning area in principle.

Before the promulgation of this notice, the housing resettlement measures approved by the county government shall be implemented in accordance with the approved housing resettlement measures.

Second, adjust the method of determining the transfer population in land-expropriated rural areas

If all the land of a collective economic organization is expropriated, all members of the collective economic organization will move from rural areas to cities and towns; Part of the collective economic organization land expropriation, according to the expropriation of cultivated land area (orchard, pasture area is calculated according to the cultivated land area, the same below) and multiplied by the non-cultivated land area divided by 0.5 times the per capita cultivated land area of the collective economic organization expropriation calculation to determine the number of people from rural to non-rural. The per capita cultivated land area is the cultivated land area recorded in the collective land ownership certificate (excluding the requisitioned cultivated land area) divided by the total population of rural collective economic organizations (the number of people from rural areas to non-rural areas should be deducted).

Three, the collection of social security fees for landless farmers.

The land acquisition fee is included in the land cost and is uniformly collected by the financial department. As a special income of cities and counties, it will be included in the special account management, which will be used to adjust the social security fees of landless farmers as a whole.

Four, the establishment of the basic living security system for landless farmers.

County labor and social security departments should establish and improve the unemployment registration system and employment service system for working-age farmers whose land has been expropriated, actively provide services such as policy consultation, employment guidance, employment training and employment introduction, develop employment posts through multiple channels, enhance employment absorption capacity, improve and optimize the employment environment, and promote the employment of working-age farmers whose land has employment aspirations. Land-expropriated farmers of working age can enjoy relevant preferential policies for the employment of urban registered unemployed people. Land-expropriated farmers or children of land-expropriated farmers studying in various secondary vocational schools within the administrative area of Chongqing enjoy the subsidy policy for studying with reference to the relevant provisions of Chongqing Municipal Committee's Decision on Accelerating the Industrial Development of the Reservoir Area, Focusing on Solving the Employment of Immigrants and Promoting the Prosperity and Stability of the Reservoir Area (YFA [2006]18).

(B) the establishment of a basic old-age insurance system

(C) the establishment of life difficulties relief system

Civil affairs departments at the county level and township people's governments (offices) shall establish a multi-channel and multi-form relief system for landless farmers. Families of landless peasants who have difficulties in living and meet the minimum living guarantee conditions for urban residents shall be handled by the civil affairs department in accordance with the relevant provisions of the minimum living guarantee for urban residents.

Five, strengthen leadership, clear responsibility

(1) Township People's governments (offices) should take the Theory of Three Represents theory as a guide, firmly establish the ruling philosophy of Scientific Outlook on Development and "people-oriented", strengthen organizational leadership, take effective measures to actively promote the employment of land-expropriated farmers, conscientiously implement the basic old-age insurance system for land-expropriated farmers, strive to solve the living difficulties of land-expropriated farmers and effectively protect their legitimate rights and interests.

(two) the relevant departments of the Township People's Government (office) and the county government shall, in accordance with their respective responsibilities, do a good job in land acquisition compensation and resettlement and social security for landless farmers, and realize a smooth transition between the old and new policies.

Land administrative departments shall do a good job in the implementation of land acquisition compensation and resettlement and the transfer payment of the basic old-age insurance fund for rural residents, and cooperate with relevant departments to do a good job in the identification and registration of rural residents and insured persons.

Labor and social security departments should do a good job in employment training for landless farmers, establish and improve employment services and social security systems, and formulate corresponding measures.

The civil affairs department shall do a good job in the minimum living guarantee for eligible families of landless farmers.

The public security department shall provide the household registration information of rural residents whose land has been expropriated, do a good job in household registration examination, approval and statistics, and handle the household registration of rural households in accordance with the regulations.

The agricultural sector should do a good job in the guidance and supervision of the distribution, use and management of the property of the collective economic organizations whose land has been expropriated and the adjustment of the contractual management right of land.

The financial department should do a good job in the supervision and management of the collection and use of land acquisition fees and the transfer and disbursement of basic old-age insurance subsidies.

Audit and supervision departments should do a good job in the supervision and inspection of the implementation of land acquisition compensation and resettlement policies and the collection and use of land acquisition fees.

Planning and construction departments should do a good job in site selection, construction and quality management of resettlement houses for landless farmers.

Six, large and medium-sized water conservancy and hydropower projects compensation and resettlement in accordance with the relevant provisions of the state, city and our county.

Seven, this notice since June 2008 1 day. Where the relevant provisions of the original land acquisition compensation and resettlement are inconsistent with the provisions of this notice, the provisions of this notice shall prevail.

Compensation and resettlement for land requisition implemented before June 65438+1 October12008 shall be handled according to the original regulations.
