Measures for the Interview Management of People from the Mainland Area Applying to Enter the Taiwan Area

Article 1: These Measures are based on the regulations between the Taiwan Area and the This is stipulated in Article 10-1 of the Regulations on Relations between People of the Mainland Area (hereinafter referred to as the Regulations).

Article 2 The competent authority for these regulations is the Ministry of the Interior.

Article 3 When the Immigration and Immigration Bureau of the Ministry of the Interior (hereinafter referred to as the Immigration and Immigration Bureau) accepts cases of people from the Mainland Area applying to enter the Taiwan Area for reunification, residence or settlement, the applicant shall be treated in accordance with these Measures Interview.

If the applicant has a Taiwanese spouse or relative, his Taiwanese spouse or relative should also be interviewed if necessary.

Article 4 When the Immigration and Immigration Service accepts applications from people from the Mainland Area to enter the Taiwan Area for reunification, residence or settlement, it shall visit the applicant’s Taiwan Area spouse or relative within one month after accepting the application. The family, physical and mental, financial and other conditions shall be used as the basis for reviewing the application.

If the applicant’s Taiwanese spouse or relative is in Taiwan, and if it is deemed necessary to conduct an interview, the Immigration and Immigration Service shall notify the Taiwanese spouse or relative in writing to accept the interview.

Article 5 The Immigration and Immigration Bureau may interview the applicant when accepting the application, or notify the applicant in writing to handle the matter in accordance with the following provisions:

1. The applicant is in an overseas area If required, go to our embassy, ??consulate, representative office, office or other agency authorized by the Ministry of Foreign Affairs for an interview.

2. Applicants who are in Hong Kong or Macau shall go to the institutions or private organizations established or designated

by the Executive Yuan in Hong Kong or Macau for interviews.

3. If the applicant is in the Mainland Area, he or she should go to the institution specified in Paragraph 1 of Article 4 of this Regulation or the branch of a civil society entrusted in accordance with Paragraph 2 of this Regulation in the Mainland Area Institutional interviews.

4. Applicants who are in Taiwan must go to the designated location of the Immigration and Immigration Service for an interview.

If the applicant is unable to receive an interview abroad in accordance with the provisions of paragraphs 1 to 3 of the preceding paragraph, an entry permit may be issued first; upon entry, the applicant shall go to the Immigration and Immigration Bureau at the airport or port designated place for interviews. Their spouses or relatives in Taiwan should be present to cooperate in the interview.

Article 6 When the applicant and his/her spouse or relative in Taiwan accept an interview (interview), they should prepare the following documents:

1. Notice of interview (interview). However, applicants who are interviewed at the time of application acceptance or interviewed at the national border are exempted.

2. Identity documents.

3. Other supporting materials.

Article 7 If the person being interviewed is deaf, mute or has a language barrier, the Immigration and Immigration Bureau may use an interpreter or ask questions in written form and order in written form during the interview. statement.

Article 8 Before accepting the interview, the applicant may apply in writing for an interview assistant, and with the consent of the Immigration and Immigration Service, the applicant may be present to assist in the interview.

The qualifications of the interview assistant are limited to the applicant’s spouse, direct blood relatives, or third-degree blood relatives. However, those whose spouses should be interviewed shall not be allowed to do so.

If the applicant does not immediately raise objections to the statement made by the interview assistant, it will be deemed to be his own statement.

If the interview facilitator is found to be obstructing the interview during the interview, the Immigration and Immigration Service may prohibit him from making a statement and order him to leave the interview.

Article 9: After the applicant and his/her spouse or relative in Taiwan receive an interview in accordance with the provisions of Paragraph 2 of Article 5, the Immigration and Immigration Service determines that the case is complex and cannot be determined immediately. The applicant may be allowed to enter the country first after inspection, and the applicant may be notified in writing to go to a designated place for a second interview (interview) with his or her spouse or relatives in Taiwan within one month.

Article 10 When there are several persons to be interviewed, the interview shall be conducted in isolation; persons other than those being interviewed shall not be present.

When conducting an interview, the interviewer should make a record of the interview on the spot and record the entire process; if necessary, the entire process may be videotaped.

The interview record should record the following matters:

1. Name, age, residence or address of the person being interviewed.

2. Questions and statements of the interviewees.

3. Date, month, day and location of the interview.

The interview record shall be read aloud by the interviewer or interpreter on the spot, or shall be read by the interviewer and then signed by the interviewee himself.

Interview records, audio and video recordings are compiled by the Immigration and Immigration Department, and are produced together with application materials, document verification documents, the interview results in Paragraph 1 of Article 4 and other related documents Documentation, storage and management of special volumes. For interviews conducted outside the country (outside of the country), two copies should be made. One copy should be kept by the interview agency (institution), and the other copy, together with the audio and video recordings, should be attached to the application form for transfer to the Immigration and Immigration Service.

Article 11 Personnel conducting interviews shall be neatly dressed and have a sincere attitude, and shall not use violence, coercion, inducement, fraud, fatigue questioning or other improper methods.

When conducting interviews, the interview may be conducted at night with the consent of the interviewee. And the deadline for acceptance is 22:00. However, if the transport operator arrives within the scheduled time and before 22:00, the Immigration and Immigration Department shall still conduct an interview.

For those who are required to be interviewed at the airport or port and cannot be interviewed at night for some reason, the Immigration and Immigration Department will arrange accommodation and wait for the interview the next day.

If the transport operator picks up a person who needs to be interviewed at the airport or port, and it has been more than 22 hours after arriving at the airport or port, the Immigration and Immigration Service will notify the transport operator to arrange accommodation and the transport operator will be responsible for taking care of it. , waiting for an interview the next day.

The expenses for food, accommodation and care required in the first two items while waiting for the interview in the accommodation shall be borne by the interviewee.

Article 12 The person conducting the interview shall be a person designated by the Immigration and Immigration Service. The principle is that the interview shall be conducted in teams of two, one of whom shall be an appointed person with a fourth grade or above. However, only one person may be responsible for the designated recommendation of personnel with grades six or above.

When the interviewer discovers that there is suspicion of a crime, he or she shall handle the matter in accordance with the provisions of the Criminal Procedure Law.

Article 13 Articles 10 to 10 above regarding the preparation, preservation and implementation of interview records shall apply mutatis mutandis when spouses or relatives in Taiwan are interviewed.

Article 14 If a person in the mainland area has any of the following circumstances, his or her application shall not be approved; if the application has been approved, the approval shall be revoked or annulled:

1. Unjustifiable Reasons for refusal or failure to pass interview.

2. There is no fact that the applicant or dependent partner is living together, or there are major flaws in the statement.

3. During the interview, it is discovered that there is a suspicion of collusion, but refuses to be stopped.

4. There is no positive evidence to confirm that the marriage is genuine.

5. It has been found to have an impact on national security and social stability.

Article 15 When people from the mainland area arrive at the airport, port or have entered the country, and are notified for an interview, if they fall into any of the circumstances specified in the preceding article, their permission shall be revoked or annulled, and their entry and exit permits shall be cancelled. .

Article 16 The provisions of these Measures shall apply mutatis mutandis to the interview procedures for people from the Mainland Area who have the status of spouses of people from the Taiwan Area and enter the Taiwan Area for other reasons to apply for reunification, residence or settlement.

Article 17 These Measures shall come into effect on the date of promulgation.
