Chapter I General Provisions Article 1 These Measures are formulated in accordance with the Water Law of People's Republic of China (PRC) (hereinafter referred to as the Water Law) and combined with the actual situation of this province. Article 2 The term "water resources" as mentioned in these Measures refers to surface water and groundwater.

Development, utilization, protection and management of water resources, prevention and control of water disasters and water-related activities within the administrative region of this province must abide by the Water Law and these Measures. Article 3 People's governments at all levels (including administrative offices, the same below) shall encourage and support various undertakings that develop and utilize water resources according to law and prevent water disasters, and protect the legitimate rights and interests of units and individuals that develop and utilize water resources according to law. Article 4 The development and utilization of water resources and the prevention and control of water disasters shall be comprehensively planned, with overall consideration, ensuring key points, comprehensive utilization, stressing efficiency and giving full play to various functions of water resources. Article 5 People's governments at all levels shall strengthen the protection of water resources, take effective measures to conserve water sources, prevent soil erosion and water pollution, and improve the ecological environment.

All units and individuals have the obligation to protect water resources and water projects, and have the right to supervise and report acts of destroying water projects and polluting water bodies. Article 6 The water conservancy department of the people's government at or above the county level is the water administrative department of the people's government at the same level, responsible for the unified management of water resources within their respective administrative areas, and other relevant departments are responsible for the relevant water resources management in collaboration with the water administrative department. Chapter II Development and Utilization Article 7 The water administrative department of the people's government at or above the county level shall, jointly with the relevant competent departments, conduct comprehensive scientific investigation, investigation and evaluation of water resources as the basis for formulating agricultural, industrial and urban development plans. Article 8 The development and utilization of water resources and the prevention and control of water disasters must follow the unified planning of river basins or regions. Planning is divided into comprehensive planning and professional planning.

Comprehensive river basin planning of important rivers and lakes determined by this province shall be compiled by the provincial water administrative department in conjunction with the relevant competent departments and local people's governments, submitted to the provincial people's government for approval, and reported to the the State Council water administrative department for the record; Comprehensive planning of other river basins or regions shall, in accordance with the management authority, be compiled by the water administrative department in conjunction with the relevant competent departments, reported to the people's government at the same level for approval, and reported to the water administrative department at the next higher level for the record.

Approved planning is the basic basis for the development and utilization of water resources and the prevention and control of water disasters. Article 10 If the construction of engineering facilities, waterway regulation and other activities cause the deterioration of river regime and the collapse of river banks and dikes, which affects flood control safety, water supply sources, waterway water volume and irrigation and drainage efficiency, the construction unit must take remedial measures or make compensation. Chapter III Protection of Water, Waters and Water Projects Article 12 People's governments at or above the county level shall delimit protected areas according to the uses of water bodies and take measures to ensure that the water quality meets the prescribed standards.

The water administrative department of the people's government at or above the county level shall cooperate with the environmental protection department to supervise and manage the prevention and control of water pollution, strengthen water quality monitoring, and control the discharge of sewage and sewage into rivers, lakes and other waters. Sewage disposal units that cause pollution to water bodies shall deal with them in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Water Pollution. If it is necessary to wash, dilute or pump the polluted water body, the required expenses shall be borne by the pollutant discharge unit. Fourteenth water administrative departments and relevant departments should strengthen the supervision and management of groundwater development and utilization, and maintain the balance between mining and compensation. In areas that have been overexploited, mining should be strictly controlled.

Units that exploit groundwater shall regularly monitor groundwater, grasp the changing trend of water level, quantity and quality, establish technical files, and provide information to the water administrative department and relevant departments in a timely manner.

If the exploitation of groundwater leads to the decline, depletion or land subsidence of the groundwater table and causes losses to other units or individuals, remedial measures must be taken to compensate for the losses. Article 15 The scope of management and protection of river courses and state-owned water projects shall be proposed by the water administrative department of the people's government at or above the county level in accordance with the following standards and reported to the people's government at the same level for demarcation:

(a) the scope of river management with dikes is the waters between the main dikes on both sides of the strait, sandbanks, beaches (including cultivated land), flood discharge areas, dikes and their berms, filling areas for strengthening dikes, and borrow sites, while the scope of river management without dikes is below the historical maximum flood level or the design flood level line;

(2) The management scope of the reservoir area refers to the reservoir area below the resettlement line, land requisition line or land adjustment line around the reservoir, in which the hilly reservoir is a vegetation protection area from the check water level line to 200 meters to 500 meters;

(three) the scope of management of reservoir dams, spillways, hydropower stations, sluices, shiplocks, electromechanical irrigation and drainage stations and other water projects. , refers to the distance of 30 meters to 500 meters from the engineering sideline, and the protection range of 50 meters to 300 meters can be delineated outside the management scope;

(four) the scope of ditch management is 2 meters to 30 meters from the toe of the embankment or the edge line of the dumping area on both sides.

The scope of management and protection of collectively owned water projects shall be delineated by the local people's government with reference to the provisions of the preceding paragraph and actual needs.
