The Content of German Skilled Talents Immigration Law
The first part: The content of German technical personnel immigration law.
1. First of all, the new law has a unified definition of technicians. According to the new law, there are two types of technicians, namely, those with university degrees and those who have received formal vocational training. 2. At the same time, the new law also stipulates that when an applicant applies to work and live in Germany, the German Federal Labor Office will give up giving priority to the applicant's academic qualifications and training certificates when local residents are in Germany and sign a work contract. (Note: Priority audit for local residents means that the German Federal Labor Bureau will examine whether local German residents are qualified for the post. If local residents are qualified for this job, then employers need to give priority to local residents in Germany. In this case, the labor bureau will reject the foreigner's application for work and residence.
3. The new law cancels the previous restrictions on the introduction of technical talents for non-university education majors, and is limited to the shortage of majors. After the new law is passed, the introduction of professional trainers will not be subject to professional restrictions.
4. Applicants who have received formal vocational training or university diploma in a third country outside the EU can apply for a job visa for up to 6 months as long as they have a certain knowledge of German and can provide proof of income source. Before the introduction of the new law, this provision only applied to graduates who graduated from German universities and left Germany after completing their studies.
Because different countries have different regulations on vocational training and examination certification system, some vocational education certificates issued by third countries cannot be recognized by German officials without German certification. Or, due to the special regulations of Germany, some occupations need additional training for applicants of higher vocational education certificates from third countries outside the EU.
In view of this situation, the new law stipulates that applicants with higher vocational education certificates from third countries outside the EU can apply for a 18-month visa to prove their higher vocational education certificates in Germany or receive supplementary training.
The condition of this visa is that the applicant must have German-related knowledge required for vocational training, generally at the level of German B 1; The certification and supplementary training measures that the applicant wants to implement must be conducive to future employment in Germany; Finally, if vocational training in Germany is carried out in an enterprise, it needs to be approved by the German Federal Labor Bureau in advance. The purpose of this visa is to make it easier for workers with higher vocational training certificates to enter the German market. This visa can be valid for up to 18 months, and can be extended to two years after expiration. This visa can be used to train professionals within the validity period.
6. At the same time, applicants with higher vocational education can apply for a work visa if they have specific jobs; If necessary, the consent of the Federal Labor Office shall be obtained; If necessary, apply for a license; Finally, it is required to provide proof materials of vocational higher education diploma. Work visa holders can apply for permanent residence after working in Germany for four years.
7. For the work visa, if the applicant is under the age of 25 and can provide his own source of livelihood, he can apply for a six-month work visa with a good knowledge of Germany and a diploma from a third-country diploma school like Germany.
8. Under the same conditions as applying for a work visa, the new law also stipulates a new university post visa with a maximum period of 9 months.
9. In addition, the new law also simplifies the visa requirements for students above grade 9 to study in Germany. It stipulates that any public or private school with an international background can apply for a German study visa for students.
10. Applicants from third countries can also apply for independent German visas without applying for German universities or vocational training.
