Chapter 1 General Provisions Article 1 In order to strengthen river management, ensure flood control safety, and maximize the comprehensive benefits of rivers and lakes, these regulations are formulated in accordance with the "People's Republic of China and the National Water Law". Article 2 These regulations apply to rivers within the territory of the People's Republic of China (including lakes, artificial waterways, flood conduction areas, flood storage areas, and flood detention areas).
For waterways within rivers, the "Regulations on Waterway Management of the People's Republic of China" shall also apply. Article 3 The development and utilization of water resources in rivers and lakes and the prevention and control of water hazards shall be comprehensively planned, coordinated, comprehensively utilized, focused on efficiency, obey the overall arrangements for flood control, and promote the development of various undertakings. Article 34: For the establishment and expansion of sewage outlets that discharge sewage into rivers and lakes, the sewage discharging unit shall obtain the consent of the river competent authority before reporting to the environmental protection department. Article 5: The state implements the principle of combining water system management and hierarchical management for river courses.
Main river sections of the Yangtze River, Yellow River, Huaihe River, Haihe River, Pearl River, Songhua River, Liaohe River and other large rivers, important river sections across provinces, autonomous regions and municipalities directly under the Central Government, and boundary rivers between provinces, autonomous regions and municipalities directly under the Central Government As well as national boundary rivers, they shall be managed by river basin management agencies authorized by the state, or by the river channel competent authorities of the provinces, autonomous regions, and municipalities where the above-mentioned rivers are located, in accordance with the unified river basin planning. Other river courses shall be managed by the river course authorities of provinces, autonomous regions, municipalities directly under the Central Government, or cities and counties. Article 6: Classification of river courses. River course grade standards are formulated by the water conservancy administrative department of the State Council. Article 7: The administrative head responsibility system of the local people's government shall be implemented for river flood control and obstacle clearance work. Article 8 The river management authorities of people's governments at all levels and river supervisors must, in accordance with national laws and regulations, strengthen river management, implement water supply plans and flood control dispatch orders, and maintain the safety of water projects and people's lives and property. Article 9 All units and individuals have the obligation to protect the safety of river embankments and participate in flood prevention and rescue operations. Chapter 2 River Regulation and Construction Article 10 The regulation and construction of river channels shall comply with the comprehensive planning of the river basin, comply with the flood control standards, navigation standards and other relevant technical requirements stipulated by the state, maintain the safety of embankments, maintain the stability of river conditions, and ensure the conduction of floods and navigation. unobstructed. Article 11 When constructing various projects to develop water conservancy, prevent and control water damage, and improve river courses, as well as bridges, wharves, roads, ferries, pipelines, cables and other buildings and facilities that cross, cross rivers, cross embankments, or are adjacent to rivers, the construction unit must In accordance with the river management authority, only after the project construction plan is submitted to the river authority for review and approval can the approval procedures be carried out in accordance with the capital construction procedures.
After the construction project is approved, the construction unit shall notify the river course competent authority of the construction arrangements. Article 12 The construction of bridges, docks and other facilities must be carried out in accordance with the river width determined by the flood control standards prescribed by the state, and the flood channels must not be narrowed.
The beam bottoms of bridges and trestles must be higher than the design flood level, and a certain super height must be left in accordance with flood control and shipping requirements. The design flood level is determined by the river authority in accordance with the flood control plan.
The clearance height of pipelines and lines crossing rivers must meet the requirements for flood control and navigation. Article 13: When conducting waterway regulation, the transportation department shall comply with flood control safety requirements and seek the opinions of the river management authority on relevant designs and plans in advance.
When water conservancy departments carry out river regulation that involves waterways, they should take into account the needs of navigation and seek the opinions of the transportation department on relevant designs and plans in advance.
When conducting river and waterway regulation in rivers and important fishery waters where bamboo and wood can be transported according to national regulations, the construction unit should take into account the needs of bamboo and wood water transportation and fishery development, and submit relevant designs and plans to the same level in advance. Forestry and fishery authorities solicit opinions. Article 14 The river management authority shall regularly inspect the buildings and facilities such as culverts, pumping stations, and buried pipelines and cables that have been built on the embankment. If they do not meet the safety requirements of the project, they shall be rebuilt within a time limit.
The new buildings and facilities mentioned in the preceding paragraph on the embankment must be inspected and accepted by the river authority before they can be put into use, and must be subject to the safety management of the river authority. Article 15 If it is really necessary to use the top of an embankment or a platform as a highway, it must be approved by the superior river course authority. The management and maintenance measures for the embankment body and the embankment top road shall be formulated by the river management authority in consultation with the transportation department. Article 16 Urban construction and development shall not occupy river flats. The riverside boundaries of urban planning shall be determined by the river management authority in conjunction with urban planning and other relevant departments. When preparing and reviewing town plans for towns along rivers, they should seek the opinions of the river authorities in advance. Article 17 The utilization and construction of river shorelines shall be subject to the river regulation plan and the navigation channel regulation plan. When examining and approving construction projects that utilize river shorelines, the planning department shall seek the opinions of the river authority in advance.
The boundaries of river shorelines shall be delineated by the river authorities in conjunction with relevant transportation and other relevant departments to the local people's governments at or above the county level. Article 18 The land required for river dredging and embankment reinforcement, soil acquisition, and river regulation according to the flood control plan shall be adjusted and settled by the local people's government.
The available land increased by the construction of reservoirs and river regulation belongs to the state and can be used by people's governments at or above the county level for resettlement and river regulation projects.
Article 19 Where provinces, autonomous regions and municipalities are bounded by rivers, within ten kilometers of both sides of the river, as well as rivers across provinces, autonomous regions and municipalities, without the agreement of the parties concerned or the approval of the water conservancy administrative department of the State Council, Unilateral construction of drainage, water blocking, water diversion, water storage projects and river improvement projects is prohibited.
