Legal Basis

"Regulations on Household Registration of the People's Republic of China"

Article 5 Household registration is based on household units. Those who live in the same place as the person in charge are considered to be one household, with the person in charge being the head of the household. A single person living alone has his own household, with himself as the head of the household. Those who live in agencies, groups, schools, enterprises, institutions and other units or in public dormitories must open one household or separate households. The head of household is responsible for reporting household registration in accordance with the provisions of these regulations.

Article 6 Citizens should register as permanent residents in the place where they usually live. A citizen can only register as permanent residents in one place.

Article 10 When a citizen moves out of the jurisdiction of his/her household registration, the person or the head of the household must declare the move-out registration to the household registration authority before moving out, receive the migration certificate, and cancel the household registration. Citizens who move from rural areas to cities must hold an employment certificate from the urban labor department, a school admission certificate, or a certificate from the urban household registration authority approving the move, and apply to the household registration authority at the place of permanent residence to handle the move-out procedures. Citizens relocating to border areas must obtain approval from the public security organs of the county, city, or municipal district where their permanent residence is.
