Administrative Measures for the Examination and Approval of Rural Homestead in Guangxi Zhuang Autonomous Region Article 1 In order to strengthen the management of rural homesteads, standardize the application and examination and approval procedures of rural homesteads, promote the economical and intensive use of land, safeguard the legitimate rights and interests of villagers, and promote the construction of a new socialist countryside, these measures are formulated in accordance with land management laws, regulations and related policies, and combined with the rural reality of this autonomous region.

Article 2 The term "rural homestead" as mentioned in these Measures refers to the collective construction land legally acquired by rural villagers outside the urban (including county) planning area for building houses and their ancillary facilities.

The term "household" as mentioned in these Measures refers to all family members registered in the household registration book issued by the public security department. All family members registered in the household registration book are one household.

The term "villagers" as mentioned in these Measures refers to members of rural collective organizations whose household registration address is an administrative village or township (town) community according to law.

Article 3 These Measures shall apply to the administration of application, examination and approval of all rural residential sites within the administrative area of this autonomous region.

City, county (city) administrative departments of land and resources shall be responsible for the examination and approval of the application for rural homestead, and report to the people's government with the power of examination and approval for approval.

Article 4 The management of examination and approval of the right to use rural residential land shall follow the principles of unified planning, rational layout and economical and intensive land use.

Strictly implement rural homestead? One household and one house? System, villagers should dismantle abandoned old houses in time after building new houses, and reclaim and restore greening.

It is forbidden to occupy basic farmland to build houses. Strictly control the occupation of non-basic farmland to build houses.

Villagers are prohibited from building houses in the identified hidden danger areas of geological and other natural disasters and the prohibited construction areas determined by the overall land use planning.

Urban residents are prohibited from buying homesteads and building houses in rural areas.

Fifth villagers to apply for the use of rural homestead should comply with the overall land use planning, town planning. Encourage villagers to make full use of the original homestead, village homestead and unused land to build houses in combination with the transformation of old villages and land improvement. There are unused land, idle homesteads and study places in the village, and it is not allowed to occupy cultivated land to build houses.

Seventh villagers to apply for homestead, shall apply to the administrative department of land and resources of the city and county (city), and shall be examined and approved by the people's government with the power of examination and approval. The specific procedures are as follows:

(a) the villagers to the village (neighborhood) people's group to apply, fill out the "Guangxi Zhuang Autonomous Region rural residential construction land application form";

Eighth villagers to apply for homestead materials should be submitted:

(1) A copy of the applicant's household registration book and ID card;

Article 9 People's governments at all levels shall make overall consideration of the reclamation of abandoned old residential bases and the arrangements for the construction of new homes for farmers, organize and guide farmers to live in concentrated areas, gradually increase the concentration of farmers' living, and intensively arrange rural homesteads. Before the implementation of these measures, the original homestead that has been approved for new residential buildings in different places shall be cancelled in time.

Eleventh new rural homestead, should be included in the annual land use plan, arranged in the annual land use plan issued by the autonomous region to the city and county (city), and effectively protect the reasonable land demand of villagers' housing construction.

Twelfth rural homestead area, plain areas and urban suburbs shall not exceed 65438 000 square meters per household, hilly areas and mountainous areas shall not exceed 65438 050 square meters per household.

City, county (city) people's government in the rural homestead area standard, according to local conditions, determine the specific area standard of rural homestead, reported to the government at the same level for approval.

Article 13 The Municipal People's Government with districts shall be responsible for the examination and approval of rural homestead within the scope of municipal districts; County (city) people's government is responsible for the examination and approval of rural homestead within its jurisdiction.

Where the construction of rural homestead involves the occupation of agricultural land, the examination and approval procedures for the conversion of agricultural land shall be handled according to law. The people's governments of counties (cities, districts) put forward an application for the conversion of rural residential land to agricultural land step by step to the people's governments with the power of examination and approval every year, and the people's governments of counties (cities, districts) organize the implementation case by case after approval. The implementation shall be summarized by the Municipal People's Government with districts on an annual basis and reported to the administrative department of land and resources of the autonomous region for the record.

Fourteenth villagers to apply for homestead, city and county (city) land and resources administrative departments shall promptly accept. Does not involve the conversion of agricultural land, audited that meet the application conditions and submit complete materials, the city and county (city) people's government shall accept the application for rural homestead within 20 working days from the date of accepting it; If the situation is complicated, it may be extended by 10 working days with the approval of the person in charge of the examination and approval authority. Involving the conversion of agricultural land, the people's government of the city or county (city) shall incorporate the land for application into the annual rural homestead approval plan, and go through the relevant formalities in accordance with the provisions of the second paragraph of Article 13 of these Measures.

Audited does not meet the application conditions, the administrative department of land and resources of the city and county (city) shall reply to the applicant according to law, and explain the reasons; If the submitted materials are incomplete, the applicant shall be informed of all the contents that need to be corrected on the spot or within 5 days.

The document format of rural homestead application and approval shall be uniformly formulated by the administrative department of land and resources of the autonomous region.

Fifteenth villagers to apply for homestead, one of the following circumstances, shall not be approved:

(a) does not conform to the overall land use planning, town planning;

(two) the original homestead area has reached the upper limit of the area stipulated in Article 12 of these measures;

(three) disputes over the application for land ownership in rural homesteads;

(four) the existing rural homestead area can meet the needs of children to set up separate households;

(five) the original rural housing (homestead) is leased, donated, transferred or has been included in the planning and transformation scope of the local government;

(six) other circumstances stipulated by laws, regulations or policies.

Sixteenth villagers to build residential land occupied by the approval, by the city, county (city) people's government to organize the reclamation of the same amount and quality of cultivated land to be supplemented, the implementation of cultivated land occupation and compensation balance task.

Seventeenth villagers apply for homestead occupation of forest land, should first apply to the administrative department of forestry for examination and approval, and then go through the formalities for examination and approval of land use in accordance with the relevant land management laws, regulations and provisions.

Eighteenth city, county (city) administrative departments of land and resources shall standardize the archives management of rural homestead, and timely file the application materials of homestead.

Nineteenth city, county (city) land and resources administrative departments and township (town) people's government shall publicize the application conditions, examination and approval procedures, examination and approval authority, examination and approval time limit and annual land use plan of rural homestead, and accept supervision by the masses.

(three) approved beyond the approval authority;

(four) in violation of laws, regulations and policies approved.

Acts that violate laws and regulations should be investigated for responsibility according to law. The directly responsible person in charge and the directly responsible person shall be given administrative sanctions according to the seriousness of the case; Anyone suspected of committing a crime shall be transferred to judicial organs for handling according to law. Illegal approval of rural homestead, in addition to dealing with the parties, should revoke the approval documents in accordance with the law, to recover the homestead. If losses are caused to the villagers, the relevant units and responsible persons shall bear corresponding liability for compensation according to law.
