Legal basis: Article 29 of the Law on the Entry and Exit of China People and Foreign Nationals stipulates that public security organs at or above the county level may punish those who illegally enter or leave the country in violation of the provisions of this law, illegally reside or stay in China, travel to areas closed to foreigners, hold valid travel documents, forge, alter, falsely use or transfer entry or exit documents, and impose a warning, a fine or a detention penalty of not more than 10 days; If the circumstances are serious enough to constitute a crime, criminal responsibility shall be investigated according to law. Foreigners who are fined or detained by public security organs and are not satisfied with the punishment can lodge a complaint with the public security organ at the next higher level within 15 days from the date of receiving the notice, and the public security organ at the next higher level will make a final decision, or they can directly bring a lawsuit to the local people's court.
