Notice of Chongqing Municipal People's Government on Relevant Matters Concerning Adjustment of Land Requisition Compensation and Resettlement Policy

According to the Decision of the State Council on Deepening Reform and Strict Land Management (Guo Fa [2004] No.28), the Notice of the State Council on Strengthening Land Regulation (Guo Fa [2006] No.31) and the relevant provisions of land management laws and regulations, combined with the actual situation of our city, the Municipal People's Government adopted it on 10/7/2008.
The first is to adjust the methods and standards of land acquisition compensation and resettlement.
(A) the main city
1. Land compensation fee and resettlement subsidy are calculated separately. The land compensation fee is calculated according to the area of the expropriated land regardless of the land type. The land compensation standard for the first-class area (within the central city 1062 square kilometers) is RMB per mu 16000, and that for the second-class area (within the sub-central city 1062 square kilometers to 2737 square kilometers) is RMB per mu 15000. The resettlement subsidy is calculated according to the number of agricultural population transferred to non-resettlement, and the resettlement subsidy standard for each agricultural population transferred to non-resettlement is 28,000 yuan.
Land compensation fee is the compensation obtained by rural collective economic organizations whose land has been expropriated. 80% of the total land compensation fee is first used as a whole for landless farmers to participate in the basic old-age insurance for urban enterprise employees, and the land administrative department will allocate it to the labor and social security department on their behalf; The remaining 20% is paid to the rural collective economic organizations whose land has been expropriated, which is used to develop the collective economy and arrange the production and life of the members of the collective economic organizations. The payment of resettlement subsidies is determined according to the different age groups of landless farmers, and the resettlement subsidies are paid in full to individuals under the age of 16. For 16-year-old and above landless farmers, their individuals should pay 50% of the total cost of participating in the basic old-age insurance for employees of urban enterprises according to relevant regulations, and the land administrative departments will allocate it to the labor and social security departments from their resettlement subsidies to be used exclusively for the basic old-age insurance for landless farmers, and the rest of the resettlement subsidies will be paid to individuals to arrange their production and life.
If 80% of the land compensation fee and the monks who pay the basic old-age insurance fee can't meet the capital demand of the landless peasants to participate in the basic old-age insurance, the difference will be made up by the land-expropriated units until the capital demand of the landless peasants to participate in the basic old-age insurance is met.
2. The compensation standards for rural houses, young crops and above-ground structures (attached) shall be implemented according to Schedule 2 and Schedule 3 respectively. The compensation standard for the above-ground structures (attached) within the scope of the right to use the homestead shall be implemented according to schedules 4 and 5; The above-ground buildings (attachments) within the scope of the remaining expropriated land shall be compensated by means of comprehensive quota compensation. The specific standards and calculation methods of comprehensive quota compensation shall be formulated by the people's governments of all districts.
3. Housing placement
The per capita construction area of rural residents' housing resettlement for land acquisition and demolition is 30 square meters.
Actively promote housing monetary resettlement, and the specific standards for monetary resettlement shall be formulated by the people's governments of all districts in accordance with the principle of not less than the sales price of affordable housing in the adjacent areas of land acquisition.
The people's governments of all districts can provide the right to use state-owned land in the form of "government guidance and market operation", and determine the construction units to build houses through bidding, which will be sold by the construction units to landless farmers who have been given monetary resettlement to meet their housing needs. People who move from rural areas to cities and towns should enjoy preferential policies for the construction of affordable housing in the directional construction and sale of housing.
After June 65438+1 October1in 2008, self-built housing resettlement will no longer be implemented in urban (town) planning areas.
(II) The people's governments of other counties (autonomous counties) outside the main urban area shall, in accordance with the principle of ensuring that land-expropriated farmers participate in the basic old-age insurance for urban enterprise employees in accordance with the relevant provisions and the requirements of this circular, and in combination with local conditions, pay close attention to formulating specific policies for land acquisition compensation and resettlement, and report them to the Municipal People's Government for the record.
The second is to adjust the determination method of the number of landless farmers. All the land of the collective economic organization is expropriated, and all the members of the collective economic organization are farmers; If the land of collective economic organizations is partially expropriated, the number of farmers converted to non-agriculture shall be calculated and determined according to the sum of the expropriated cultivated land area (the area of orchards and pastures is calculated according to the cultivated land area, the same below) multiplied by the non-cultivated land area divided by 0.5 times the per capita cultivated land area of the expropriated collective economic organizations. The per capita cultivated land area is the cultivated land area recorded in the collective land ownership certificate (excluding the expropriated cultivated land area) divided by the total population of rural collective economic organizations.
When the land of the collective economic organization is partially expropriated, and the contracted farmland of the landless farmers is expropriated, and the remaining cultivated land area is less than 0.5 mu per household, the landless farmers may separately apply to increase the number of farmers in rural areas in accordance with the above provisions until the remaining cultivated land area of the household reaches more than 0.5 mu per household. Land-expropriated farmers have not applied for conversion from rural areas to non-rural areas, and rural collective economic organizations should adjust their contracted cultivated land if conditions permit.
In the urban (town) planning area, if houses are demolished, the relocated households can apply for all farmers to transfer to the countryside.
Three. The collection of social security co-ordination fee for land-expropriated farmers started from June 5438+1 October1in 2008, and the social security co-ordination fee for land-expropriated farmers (hereinafter referred to as land-expropriated co-ordination fee) was collected when the land was examined and approved.
The land acquisition fee is charged according to the land area, and the operating land (including the state-owned construction land in stock) and urban development land are charged according to the standard of 30,000 yuan per mu in the main city and 20,000 yuan per mu in other counties (autonomous counties); Newly-requisitioned industrial land is charged according to the standard of 0.000 yuan per mu in the main urban area and 0.000 yuan per mu in other districts and counties (autonomous counties).
The land acquisition fee is included in the land cost and collected by the municipal finance department. As a municipal special income, it will be included in the special account management, which will be used for overall adjustment of social security fees for landless farmers.
Four, the establishment of the basic living security system for landless farmers.
(A) to promote the employment of land-expropriated personnel
All districts and counties (autonomous counties) should establish and improve the unemployment registration system and employment service system for working-age land-expropriated farmers, actively provide services such as policy consultation, employment guidance, employment training and employment introduction, develop jobs through multiple channels, enhance employment absorption capacity, improve and optimize the employment environment, and promote the employment of working-age land-expropriated farmers with employment aspirations. Land-expropriated farmers of working age can enjoy relevant preferential policies for the employment of urban registered unemployed people. Land-expropriated farmers or children of land-expropriated farmers attending all kinds of secondary vocational schools within the administrative area of this Municipality can enjoy the subsidy policy for studying with reference to the relevant provisions of Chongqing Municipal Committee's Decision on Accelerating the Industrial Development of the Reservoir Area, Focusing on Solving the Employment of Immigrants and Promoting the Prosperity and Stability of the Reservoir Area (Chongqing Municipal Committee [2006]18).
(II) Establishment of the Basic Old-age Insurance System After the rural residents whose land has been expropriated are registered as urban residents according to law, they will be incorporated into the basic old-age insurance system for employees of urban enterprises in accordance with relevant regulations. The basic old-age insurance for land-expropriated farmers was expropriated in accordance with the Notice of Chongqing Municipal People's Government on Printing and Distributing the Trial Measures for the Basic Old-age Insurance for Land-expropriated Farmers and the Trial Measures for the New Basic Old-age Insurance for Land-expropriated Farmers after 2007 1 (Yu Fu Fa [2008] No.26) in June 2008.
(3) Establishing a relief system for living difficulties All districts and counties (autonomous counties) should establish a multi-channel and multi-form relief system for landless peasants. Families of landless farmers who have difficulties in living and meet the minimum living guarantee conditions for urban residents shall be handled by the civil affairs department in accordance with the relevant provisions of the minimum living guarantee for urban residents.
Five, strengthen leadership, clear responsibility
(a) the people's governments of all districts and counties (autonomous counties) should take Theory of Three Represents Theory as a guide, firmly establish the ruling philosophy of Scientific Outlook on Development and "people-oriented", strengthen organizational leadership, take effective measures, actively promote the employment of landless farmers, conscientiously implement the basic old-age insurance system for landless farmers, strive to solve the living difficulties of landless farmers, and effectively protect their legitimate rights and interests.
(two) the people's governments of all districts and counties (autonomous counties) and the relevant departments of the municipal government shall, in accordance with their respective responsibilities, do a good job in land acquisition compensation and resettlement and social security for landless farmers, and realize a smooth transition between old and new policies. Land administrative departments shall do a good job in the implementation of land acquisition compensation and resettlement and the transfer payment of the basic old-age insurance fund for rural residents, and cooperate with relevant departments to do a good job in the identification and registration of rural residents and insured persons.
Labor and social security departments should do a good job in employment training for landless farmers, establish and improve employment services and social security systems, and formulate corresponding measures.
The civil affairs department shall do a good job in the minimum living guarantee for eligible families of landless farmers.
The public security department shall provide the household registration information of rural residents whose land has been expropriated, do a good job in household registration examination, approval and statistics, and handle the household registration of rural households in accordance with the regulations. The agricultural sector should do a good job in the guidance and supervision of the distribution, use and management of the property of the collective economic organizations whose land has been expropriated and the adjustment of the contractual management right of land.
The financial department should do a good job in the supervision and management of the collection and use of land acquisition fees and the transfer and disbursement of basic old-age insurance subsidies.
Audit and supervision departments should do a good job in the supervision and inspection of the implementation of land acquisition compensation and resettlement policies and the collection and use of land acquisition fees.
Planning and construction departments should do a good job in the site selection, construction and quality management of land-expropriated farmers' unified resettlement houses and targeted housing sales.
Six, large and medium-sized water conservancy and hydropower projects compensation and resettlement in accordance with the relevant provisions of the state and our city.
Seven, the notice referred to in the main city refers to Yuzhong District, dadukou district, Jiangbei District, Shapingba District, Jiulongpo District, Nan 'an District, Beibei District, Yubei District, Banan District belongs to the administrative region (including the northern new district).
Eight, this notice shall be implemented as of June 2008 1 day. Where the relevant provisions of the original land acquisition compensation and resettlement are inconsistent with the provisions of this notice, the provisions of this notice shall prevail. The original document [2005] No.67 issued by Yu Fu shall be abolished at the same time. Compensation and resettlement for land requisition implemented before June 65438+1 October12008 shall be handled according to the original regulations.
