Articles of Association of Management Measures for Acceptance of Hydropower Projects

Chapter I General Principles

Article 1 In order to strengthen the construction management of hydropower projects, standardize the acceptance work, and ensure the safety of hydropower projects and the safety of people's lives and property upstream and downstream, these measures are formulated in accordance with the Regulations on the Safety Management of Reservoir Dams, the Regulations on the Quality Management of Construction Projects and relevant national laws and regulations.

Article 2 These Measures shall apply to the hydropower projects invested and built by enterprises, hydropower projects with a total installed capacity of 250,000 kilowatts and above and pumped storage power stations (hereinafter referred to as hydropower projects). Other hydropower projects invested by enterprises can be implemented with reference.

Article 3 The acceptance of hydropower projects includes stage acceptance and completion acceptance.

Stage acceptance is divided into project closure acceptance, water storage acceptance and hydro-generator start-up acceptance. Before the acceptance of river closure and water storage, special acceptance of land acquisition and resettlement for construction shall be conducted.

The completion acceptance of the project is based on the special acceptance of the hub project, land acquisition and resettlement for construction, environmental protection, soil and water conservation, fire protection, labor safety and industrial hygiene, project final accounts and project files.

Article 4 Hydropower projects must be checked and accepted before river closure, water storage, unit start-up and after completion.

Article 5 The acceptance of hydropower projects shall be scientific, objective, fair and standardized.

Article 6 The National Energy Administration is responsible for the management, guidance, coordination and supervision of the acceptance of hydropower projects.

The competent energy departments at all levels shall be responsible for and participate in the management, guidance, coordination and supervision of the acceptance of hydropower projects within their respective administrative areas in accordance with the prescribed authority.

Article 7 The National Energy Administration is responsible for water storage acceptance, special acceptance of key projects and project completion acceptance, and entrusts qualified units as the acceptance host, and organizes the acceptance committee together with the provincial development and reform commission and the Energy Administration where the project is located.

The project completion acceptance shall be carried out by the project legal person in conjunction with the provincial development and Reform Commission and the Energy Bureau where the project is located. The start-up acceptance of the hydro-generator set shall be carried out by the project legal person in conjunction with the acceptance committee of the power grid operation management unit, and the specific requirements shall be implemented in accordance with relevant regulations.

Resettlement for construction land acquisition, environmental protection, soil and water conservation, fire protection, labor safety and industrial hygiene, final accounts of projects and acceptance of project files shall be handled in accordance with relevant laws and regulations.

Eighth hydropower project acceptance is mainly based on:

(a) the relevant laws, regulations and industry regulations of the state;

(2) Relevant national and industrial regulations, norms and technical standards;

(three) project approval, approval and filing documents;

(four) the approved feasibility study and design, construction drawing design, design change and budget adjustment documents;

(five) the relevant tender documents, contract documents and quality standards and technical documents clearly adopted in the contract.

Article 9 The project legal person shall organize and coordinate the design, construction, supervision, monitoring, equipment manufacturing and installation, operation, safety appraisal, quality supervision and other units to submit materials required for acceptance, and assist the acceptance committee in its work.

The above-mentioned units are responsible for the authenticity of the materials submitted in the project acceptance.

Chapter II Acceptance of Project Water Storage

Article 10 A project legal person shall, according to the progress of the project, submit an application for acceptance of water storage to the National Energy Administration six months before the planned water storage after preliminary examination and comments by the provincial development and reform commission and the Energy Bureau where the project is located. Projects belonging to enterprise groups with separate plans or centrally managed enterprises must also be submitted to their affiliated enterprise groups (or centrally managed enterprises) for acceptance. The application report for water storage acceptance of the project shall be copied to the host unit for acceptance at the same time.

Eleventh engineering water storage acceptance application materials shall include the following main contents:

(1) Basic information of the project. Including project development tasks, construction scale, construction scheme, investment scale, major investors, project approval (approval), etc. ;

(2) the progress of the project. Including the project progress, image and appearance, investment completion and its safety flood control measures;

(3) Arrangement of water storage acceptance plan;

(four) the implementation of land acquisition, demolition and resettlement;

(five) suggestions of the project water storage safety appraisal unit.

Article 12 After receiving the application materials for water storage acceptance of the project, the host unit of acceptance shall, together with the provincial development and reform commission and the Energy Bureau where the project is located, invite relevant departments, enterprise groups with separate plans (or centrally managed enterprises), relevant units and experts to form an acceptance committee for acceptance. When necessary, an expert group can be organized to conduct on-site inspection and technical pre-acceptance.

The chairman of the acceptance committee is held by the responsible comrades of the acceptance host unit, and the vice chairman is held by the responsible comrades of the provincial development and Reform Commission, the Energy Bureau and the enterprise groups (or central management enterprises) where the project is located.

Thirteenth basic conditions for water storage acceptance of hydropower projects:

(a) the image of the project meets the requirements of reservoir storage, and the water retaining, water diversion and drainage structures meet the requirements of flood control and engineering safety;

(2) Geological disasters such as landslides, dangerous rocks, collapses and accumulations that affect the safe operation of the project near the dam site have been treated according to the design requirements;

(three) the internal and external monitoring instruments and equipment related to water storage have been buried and debugged according to the design requirements, and the initial values have been measured. The reservoir earthquake monitoring system has been put into operation, and the background values of the projects that need reservoir earthquake monitoring have been obtained;

(4) Formulating the organization design of sluice water storage construction, formulating the reservoir dispatching and flood control plan, and formulating the emergency rescue plan for accidents during the water storage period;

(five) the safety appraisal unit has submitted the project water storage safety appraisal report, and has a clear conclusion that it can store water;

(six) the construction of land acquisition immigrants have passed the special acceptance, and there is a clear conclusion that will not affect the project water storage.

Article 14 After the acceptance committee completes the water storage acceptance, it shall issue a water storage acceptance certificate for the project. The acceptance organizer shall submit the acceptance certificate to the National Energy Administration before the sluice is impounded. The National Energy Administration believes that it does not have the conditions for water storage under the sluice, and shall notify the acceptance organizer and the project legal person within 5 working days.

The acceptance organizer shall report the relevant information of water storage and water storage to the National Energy Administration within 1 month and 3 months after water storage.

Fifteenth hydropower projects that store water by stages can be accepted by stages.

Chapter III Special Acceptance of Hub Project

Article 16 The project legal person shall, according to the progress of the project, submit an application for special acceptance of the hub project to the National Energy Administration three months before the special acceptance plan of the hub project, after the provincial development and reform commission and the Energy Bureau where the project is located have made preliminary examination and put forward their opinions. Projects belonging to enterprise groups with separate plans or centrally managed enterprises must also be submitted to their affiliated enterprise groups (or centrally managed enterprises) for acceptance. The application report for special acceptance of the hub project shall be copied to the acceptance host unit at the same time.

Seventeenth acceptance application report shall include the following main contents:

(a) the basic situation of the project;

(2) Project construction. Including project progress, project appearance, investment completion, etc. ;

(3) Operation of the project. Including water storage, hydro-generator set and single project operation, project operation benefit, etc.

(four) the special acceptance plan of the hub project.

Article 18 After receiving the application materials for special acceptance of the hub project, the acceptance host unit shall, together with the provincial development and Reform Commission and the Energy Bureau where the project is located, invite relevant departments, enterprise groups with separate plans (or centrally managed enterprises), relevant units and experts to form an acceptance committee for acceptance. When necessary, an expert group can be organized to conduct on-site inspection and technical pre-acceptance.

The chairman of the acceptance committee is held by the responsible comrades of the acceptance host unit, and the vice chairman is held by the responsible comrades of the provincial development and Reform Commission, the Energy Bureau and the enterprise groups (or central management enterprises) where the project is located.

Nineteenth through the special acceptance of hydropower projects should have the basic conditions:

(a) the hub project has been completed according to the approved design documents, and the major design changes of the project have been completed;

(two) the construction unit has completed the remaining finishing work and quality defect treatment in time during the quality warranty period;

(3) The project operation has passed the test of at least one flood period, and the multi-year regulation reservoir needs to pass the test of at least two flood periods. The highest water level of the reservoir has reached or basically reached the normal water level, and all units can operate normally according to the rated output. Each unit can run normally for at least 2000 hours (including the standby time arranged by power grid dispatching), and each single project runs normally;

(four) the project safety appraisal unit has put forward the project completion safety appraisal report, and has a conclusion that it can run safely.

Twentieth after the completion of the special acceptance of the hub project, the acceptance committee shall issue a certificate of special acceptance of the hub project. The host unit of acceptance shall submit the acceptance certificate to the National Energy Administration in a timely manner.

Twenty-first hydropower project construction by stages, according to the progress of the project construction by stages or one-time acceptance.

Chapter IV Completion Acceptance

Twenty-second project legal person shall, within one year after the project is basically completed or all units are put into operation, carry out the work related to the completion acceptance, and submit the application for the completion acceptance of the project alone or together with the special project of the hub project.

If it is submitted separately, it must be examined and put forward by the provincial development and reform commission and the Energy Bureau where the project is located, and an application for acceptance shall be submitted to the National Energy Administration. Projects belonging to enterprise groups with separate plans or centrally managed enterprises must also be submitted to their affiliated enterprise groups (or centrally managed enterprises) for acceptance. The application report for completion acceptance shall be copied to the host unit of acceptance at the same time.

Twenty-third acceptance application report shall include the basic situation of the project, the construction and operation of the project, the special acceptance plan and the overall arrangement of the completion acceptance.

Article 24 After receiving the application materials for completion acceptance, the acceptance organizing unit, together with the provincial development and reform commission and the Energy Bureau where the project is located, invites relevant departments, enterprise groups with separate plans (or centrally managed enterprises), relevant units and experts to form an acceptance committee for acceptance. When necessary, an expert group can be organized to conduct on-site inspection and technical pre-acceptance.

The chairman of the acceptance committee is held by the responsible comrades of the acceptance host unit, and the vice chairman is held by the responsible comrades of the provincial development and Reform Commission, the Energy Bureau and the enterprise groups (or central management enterprises) where the project is located.

Twenty-fifth hub project after the completion of special acceptance, the construction of land acquisition and resettlement, environmental protection, soil and water conservation, fire protection, labor safety and industrial hygiene, project final accounts, project files, etc. The project legal person shall summarize the acceptance work and submit the summary report of the project completion acceptance to the acceptance committee.

The summary report of project completion acceptance shall include the basic situation of the project, the main conclusions of each special acceptance certificate, the handling of main problems and suggestions, and the completion acceptance plan of the remaining single projects.

Twenty-sixth conditions for the completion and acceptance of hydropower projects:

(a) has completed all the work of special completion acceptance in accordance with the provisions;

(two) the special acceptance opinion has a clear conclusion that it can pass the project completion acceptance;

(three) has properly handled the problems left over from the completion acceptance and completed the finishing work;

(4) Compliance with other relevant regulations.

Twenty-seventh after the completion of the acceptance work, the acceptance committee shall issue a certificate of completion acceptance. Acceptance of the host unit should be timely completion of the project acceptance summary report, acceptance certificate and related information submitted to the National Energy Administration.

Article 28 After receiving the summary report and acceptance appraisal of the project completion acceptance, the National Energy Administration will issue the completion acceptance certificate (reply) to the hydropower project that meets the completion acceptance conditions.

Twenty-ninth after the completion and acceptance of hydropower projects, the project legal person shall go through the relevant procedures such as the transfer of files and fixed assets in accordance with the relevant provisions of the state.

Chapter V Supplementary Provisions

Thirtieth acceptance conclusion shall be approved by more than two thirds of the members of the acceptance committee, and the members of the acceptance committee shall sign the acceptance certificate. If the members of the acceptance committee disagree with the acceptance conclusion, they shall clearly record their reservations on the acceptance certificate and sign it.

Article 31 If there is any dispute in the acceptance process, the director of the acceptance committee shall coordinate and make a ruling, and the reservations made by the members of the acceptance committee on major issues shall be included in the memorandum as an annex to the acceptance certificate. If more than half of the chairman's ruling opinions are opposed or major issues are difficult to decide, the acceptance Committee shall report to the host unit for decision, and major issues shall be reported to the National Energy Administration in a timely manner.

Thirty-second other relevant requirements of hydropower project acceptance management shall be implemented in accordance with the "Regulations for Acceptance of Hydropower Station Capital Construction Projects".

Article 33 These Measures shall be interpreted by the National Energy Administration and shall come into force as of the date of promulgation.
