How do China companies hire foreigners?
If it is limited to RMB payment and temporary employment, no special procedures are needed. Involving foreign currency payment and notarization of labor relations, relevant departments need to file.
Foreigners staying in China for visa reasons need to go through the following procedures:
1. The labor department handles the employment permit for him.
2. Send the invitation letter of the employed person to the Foreign Trade and Economic Cooperation Bureau with the employment certificate.
3. Employees should apply for a Chinese visa (Z professional visa) to the consulate of China in their country by telegram with an invitation letter.
4. After entering the country, apply to the Labor Bureau for a foreigner's employment permit with the Z visa and employment permit certificate.
5. Go to the entry-exit inspection and quarantine bureau for physical examination.
6. Go to the exit and entry administration department of public security to apply for residence permit.
7. If the salary of overseas residents exceeds the threshold of individual income tax in China, the individual income tax shall be paid by foreigners (or withheld and remitted by enterprises). Generally speaking, there is no need to file a case, and the public security organ will inform the tax authorities about foreigners and inquire about their tax payment.
When employing foreigners, the employer must fill out an application form for employment of foreigners? (hereinafter referred to as the application form), apply to the competent department of industry at the same level as the labor administrative department (hereinafter referred to as the competent department of industry), and provide the following valid documents:
(1) Resume certificate of the foreigner to be employed;
(2) letter of intent for employment;
(3) A report on the reasons for the proposed employment of foreigners;
(four) the qualification certificate of the foreigner to be employed in this job;
(5) The health certificate of the foreigner to be employed;
(6) Other documents as prescribed by laws and regulations.
The competent department of industry shall conduct examination and approval in accordance with the provisions of Article 6 and Article 7 of these Provisions and relevant laws and regulations.
