Article 5 of the Criminal Law of People's Republic of China (PRC) shall be deemed as "serious circumstances" as stipulated in Article 322 of the Criminal Law in any of the following circumstances: (1) committing acts that harm the interests of the state abroad; (2) Smuggling across the country (border) for more than three times, or three or more people have colluded to sneak across the country (border); (3) Conspiring or inducing others to jointly steal across the country (border); (four) in collusion with overseas organizations and personnel to cross the country (border); (five) within one year after administrative punishment for crossing the border (frontier); (six) other serious circumstances. Article 6 Anyone who has any of the following circumstances shall be deemed as "crossing the country (border) illegally" as stipulated in Section 3 of Chapter VI of the Criminal Law: (1) Entering or leaving the country without entry and exit documents or evading border inspection;
