Regulations of Suining Municipality on the Protection of Guanyin Lake

Chapter I General Provisions Article 1 In order to strengthen the protection of Guanyin Lake, prevent and control environmental pollution and ecological damage, and promote green and sustainable development, these Regulations are formulated in accordance with the Environmental Protection Law of People's Republic of China (PRC), the Water Pollution Prevention Law of People's Republic of China (PRC) and other relevant laws and regulations, combined with the actual situation in Suining. Article 2 These Regulations shall apply to the planning, construction, protection, management and other related activities within the protection scope of Guanyin Lake. Where there are provisions in laws and regulations, such provisions shall prevail. Article 3 The protection scope of Guanyin Lake is east to Huang Jinghao Levee, Dongqu Levee and Guangji Levee, west to Guti Levee, City Levee and Nanqiang Levee, south to Du Guojun Power Hub Dam and north to Tangjia Watari Wataru Power Hub Dam. Article 4 The protection of Guanyin Lake adheres to the principles of scientific planning, strict protection, rational utilization and public participation. Article 5 The Municipal People's Government shall strengthen the leadership over the planning, construction, protection and management of Guanyin Lake, and the Municipal Urban Management and Law Enforcement Bureau shall be responsible for the unified supervision and comprehensive coordination of Guanyin Lake protection.

Chuanshan district Municipal People's Government is responsible for the protection and management of the waters within the protection scope of Guanyin Lake, while chuanshan district Municipal People's Government, Suining Economic and Technological Development Zone Administrative Committee, Suining Hedong New District Administrative Committee and Suining High-tech Industrial Park Administrative Committee (hereinafter referred to as the Three Parks Administrative Committee) are responsible for the protection and management according to the management areas. Article 6 The Municipal People's Government, the chuanshan district Municipal People's Government and the relevant departments of the Sanyuan Management Committee shall perform the following duties according to law in the protection and management of Guanyin Lake:

(a) the natural resources and planning department is responsible for the preparation of Guanyin Lake protection planning and the examination and approval of construction project planning;

(two) the ecological environment department is responsible for the supervision and management of environmental protection, water quality monitoring and environmental monitoring in Guanyin Lake;

(three) the water administrative department is responsible for the protection, supervision and management of Guanyin Lake water resources, rivers and their coastlines;

(four) the transportation department is responsible for the management of Guanyin Lake waterway, wharf, floating facilities, ships, water traffic safety and land and water traffic;

(five) the housing and urban-rural construction department is responsible for the construction of urban centralized sewage treatment facilities and supporting pipe networks, and strengthen the supervision and management of the operation of urban centralized sewage treatment facilities;

(6) The Department of Culture, Radio, Film and Television Tourism is responsible for the business guidance on the planning and development of Guanyin Lake cultural tourism resources, the promotion and marketing of cultural tourism products and the supervision and management of the cultural tourism industry.

Development and reform, public security, forestry, agriculture and rural areas, emergency management and other departments shall, in accordance with their respective responsibilities, do a good job in the protection and management of Guanyin Lake. Seventh Municipal People's Government and chuanshan district Municipal People's Government shall incorporate the protection of Guanyin Lake into the national economic and social development plan, and the required funds shall be included in the fiscal budget at the corresponding level.

Sanyuan Management Committee shall include the special funds for the protection of Guanyin Lake in the financial budget. Article 8 All units and individuals have the obligation to protect Guanyin Lake, and have the right to dissuade and report acts that pollute the water quality of Guanyin Lake and destroy the ecological environment.

Encourage and support all sectors of society to participate in the protection of Guanyin Lake through charity and voluntary service.

Units and individuals that have made remarkable achievements in protecting Guanyin Lake may be commended and rewarded. Chapter II Planning and Construction Article 9 The Municipal People's Government shall organize the relevant municipal departments, the chuanshan district Municipal People's Government and the Sanyuan Management Committee to draw up a protection plan for Guanyin Lake, which shall be promulgated and implemented according to law. Guanyin Lake Protection Plan was reported to the Standing Committee of the Municipal People's Congress for the record.

Guanyin Lake protection planning should be linked with urban economic and social development planning and Fujiang River basin comprehensive planning. Article 10 The Municipal People's Government, the chuanshan district Municipal People's Government and the Sanyuan Administrative Committee shall build and maintain the ecological wetlands, flood control dams, sewage interception systems, offshore docks and other facilities within the protection scope of Guanyin Lake. Eleventh chuanshan district Municipal People's Government and Sanyuan Management Committee shall co-ordinate the construction of supporting facilities such as drainage, sewage disposal and garbage collection within the protection scope of Guanyin Lake, and ensure its normal operation. Twelfth Guanyin Lake within the scope of protection of rain and sewage diversion.

Where rain and sewage meet, rain and sewage should be transformed separately. The transformation of rain and sewage diversion should be carried out simultaneously with the transformation of the old city and road construction, and connected with the construction of sponge city and underground common ditch. Thirteenth Guanyin Lake within the scope of protection of culture, tourism, sports and other development projects should meet the planning, environmental protection and safety requirements. Article 14 The construction projects within the protection scope of Guanyin Lake shall conform to the protection plan of Guanyin Lake and be in harmony with the environment within the protection scope of Guanyin Lake.

During the construction of a construction project, the water, vegetation and landforms around the construction site shall be protected. After the construction, the site shall be cleaned and restored in time. Chapter III Environmental Protection and Management Article 15 The water quality within the protection scope of Guanyin Lake shall comply with Class III standard of National Environmental Quality Standard for Surface Water (GB 3838-2002).

The water quality monitoring results of Guanyin Lake shall be announced to the public regularly. When the water quality exceeds the standard, it shall be dealt with in time according to law. Article 16 The chuanshan district Municipal People's Government and the Sanyuan Management Committee shall strengthen the supervision and management of the water quality of the tributaries such as Yueming River, Lianmeng River and Kaishan River within the management area, and be responsible for the water quality of the tributaries entering the lake. Seventeenth new construction, renovation and expansion of sewage outlets within the scope of protection of Guanyin Lake shall be approved by the competent department of ecological environment, and the environmental impact report of the construction project shall be examined and approved by the competent department of ecological environment.

It is forbidden to set up concealed pipes privately, and to discharge water pollutants by means of leaking wells, pits, tampering with or forging monitoring data, or abnormal operation of water pollution prevention facilities.
