Legal analysis: 1. Citizens who are involved in smuggling and are currently seized by frontier inspection departments or other public security organs shall be punished according to law.

2. Citizens who are repatriated by foreign countries after taking part in smuggling abroad, or who are seized and repatriated by the authorities without legal residence certificates abroad, shall be deemed as the continuation of smuggling and punished according to law.

3. After citizens participate in smuggling out of the country, they apply to foreign embassies and consulates.

When the passport or legal residence certificate of the country where the application is made needs to be handled in China or the relatives and friends in China are entrusted to handle the notarization of innocence. Smuggling within the two-year limitation of prosecution prescribed by the Administrative Punishment Law shall be punished according to law. Smuggling is not within the limitation of prosecution and is generally not punished.

4. After citizens participate in smuggling out of the country, when they enter or leave the country with passports without exit inspection seals or with fake inspection seals issued by China, the border inspection department will generally seize them on the spot and punish them, and the exit and entry administration department will not punish them any more.

5. If citizens' smuggling activities found in daily public security work have been recorded, they will not be subject to the limitation of prosecution in the Administrative Punishment Law, and will be punished according to law after the parties arrive at the case.

Legal basis: Article 62 of the Law of People's Republic of China (PRC) on Public Security Administration Punishment provides conditions for people who illegally cross the country (border), and they shall be detained for more than five days and less than ten days, and fined more than 500 yuan but less than 2,000 yuan.

Those who illegally cross the country (border) shall be detained for not more than five days or fined not more than five hundred yuan.
