According to the Housing Ordinance, ownership cannot be freely transferred unless the unit is resold in the secondary market or the premium has been paid two years after the date of first sale. However, under special circumstances, the Housing Authority (HA) may, on a case-by-case basis, approve applications for transfer of ownership. The reasons for applying for general ownership transfer are as follows:
Apply to join your spouse as a co-owner
Transfer of ownership to spouse due to divorce or separation application
Transfer of ownership to other family members due to marriage and moving out to live with spouse.
Owners transfer their ownership to other family members because of emigration or long-term work overseas.
Owners or spouses or registered family members change their ownership because they apply for housing benefits for civil servants or housing benefits provided by employers.
Application for change of ownership due to down payment or mortgage contribution of registered family members.
Apply for change of ownership due to the death of the owner
Owners apply for change of ownership due to old age (that is, 65 or above)
Owners apply for change of ownership due to major diseases (such as cancer)
Because of bankruptcy, the owner changed his ownership.
In addition to the above reasons, other reasons will be considered under special circumstances.
Prerequisites for application
The transfer of ownership must be handled in the form of a transfer contract that does not involve monetary consideration (except bankruptcy cases); and
The prospective transferee must be a registered family member of the property owner (except the death of the owner).
Application description
The applicant must fill in all the information required for the application, otherwise we have the right to refuse the application.
The applicant must explain the reasons for the transfer of ownership in the application form and submit copies of relevant supporting documents, such as:
-When applying for transfer because of moving out to live with your spouse after marriage, you must submit a copy of your marriage certificate and proof of your new address;
-When the owner, spouse or registered family member applies for transfer due to the housing benefits provided by the employer, they must submit a copy of the approval certificate issued by the employer;
-When applying for transfer of ownership on the grounds of divorce, a copy of the absolute judgment (divorce) and the court order must be submitted;
-To apply for change of ownership due to the death of the owner, a copy of the letter of administration (together with the confirmation of the identity of the administrator)/probate, death certificate and exemption from inheritance tax/balance sheet must be submitted; or
-When applying for the transfer of property rights due to the bankruptcy of the owner, a copy of the bankruptcy order, summary procedure order and consent form of the Official Receiver's Office for the transfer of property rights must be submitted.
The personal data provided by the applicant in the application will be used for processing the application for transfer of title and providing it to the Rating and Valuation Department for issuing a demand for rates/government rent.
Providing personal data is voluntary. However, if the applicant fails to provide sufficient information, we may not be able to process the application.
Applicants have the right to access or correct personal data. Enquiries about access to or correction of personal data can be addressed to the "departmental data management officer" of the China Hong Kong Housing Authority's head office at 33 Foguang Street, Homantin, Kowloon.
Applicants are required to pay a handling fee (currently HK$ 2,654,38+000) when submitting their applications. Even if the application is not approved, or the applicant intends to cancel the transfer application, the handling fee paid will not be refunded.
After the application is completed, it must be sent to the lease management office.
After receiving all the documents, the housing subsidy branch office usually sends a letter to inform the applicant of the application result within about six weeks.
