Article 1 In order to strengthen border management, effectively stop smuggling and flight, maintain social order, consolidate stability and unity, and ensure the smooth progress of the four modernizations, these Provisions are formulated in accordance with the spirit of Articles 176 and 177 of the Criminal Law of People's Republic of China (PRC).
Article 2 Every citizen must uphold socialist law and discipline and consciously abide by the laws and regulations on border control. All personnel entering and leaving the border areas must hold legal and valid certificates and enter and exit according to the designated routes and open ports.
Article 3 It is illegal to smuggle or flee in violation of national (border) administrative regulations. If the case constitutes a crime, it shall be punished according to law.
Article 4 Illegal immigrants who are intercepted shall be sent to the designated place for detention and examination, and shall be dealt with according to the seriousness of the case. The review time is generally not more than fifteen days, and a few complicated cases can be extended as appropriate.
Article 5 Whoever commits any of the following acts shall be investigated for criminal responsibility and punished according to law:
(1) Organizing and planning smuggling and flight as a leader;
(two) to create rumors or use feudal superstition to incite smuggling and flight, and the consequences are serious;
(3) Leading, transporting others or forging border defense documents for smuggling or fleeing activities;
(4) fleeing by boat, damaging state property or traffic facilities and endangering traffic safety;
(five) robbery, theft of vehicles and other means of transportation to sneak out of the country;
(6) Attacking border guards and intercepting illegal escapees;
(seven) revenge, framed anti-smuggling personnel and their families;
(eight) manufacturing, reselling ships or providing other means of transportation for flight personnel;
(nine) organizing and planning attacks on reception stations, intercepting and hijacking refugees who have been accommodated;
(10) State functionaries use their powers to accept bribes, support or cover up smuggling and escape;
(eleven) carrying confidential documents and guns to go out without permission;
(12) Smuggling and fleeing for counter-revolutionary purposes.
Article 6 Whoever commits one of the following acts shall be given reeducation through labor, compulsory labor or administrative detention according to the circumstances:
(a) smuggling escape, refused to correct;
(two) altered documents for smuggling and hiding;
(three) do not listen to dissuasion, forced to escape by boat;
(four) the impact of border defense, forced cross-border flight;
(5) resisting asylum and repatriation, making troubles without reason and disturbing the asylum order;
(six) harboring illegal immigrants, if the circumstances are serious;
(seven) one of the items listed in article fifth, and the circumstances are relatively minor.
Article 7 Whoever leads, transports or harbours illegal fugitives, manufactures or resells smuggling tools, forges or resells border defense documents for the purpose of making profits shall be confiscated according to law and may also be fined.
The funds raised by partnership smuggling and the smuggling tools, weapons and contraband carried by the fleeing personnel shall be confiscated.
Those who steal cars, boats and other means of transportation and escape illegally, or cause property losses to the state, collectives and others due to illegal escape, shall compensate for the losses.
Article 8 Anyone who gives compulsory labor, administrative detention, confiscates illegal property or orders compensation for economic losses shall be approved by the public security organ at or above the county level. Send reeducation through labor, according to the "Supplementary Provisions" on reeducation through labor in the State Council. If criminal responsibility is investigated according to law, it shall be handled in accordance with legal procedures.
Article 9 It is everyone's responsibility to crack down on illegal immigrants and illegal immigrants. Cadres and the masses who actively crack down on smuggling and flight should be commended and protected; Those who make meritorious deeds should be rewarded.
Article 10 These Provisions shall come into force as of the date of promulgation.
