Article 1 In order to strengthen the construction and management of Liujiaxia Reservoir ecological environment protection zone, maintain ecological balance, and promote the sustainable utilization of environmental resources in the reservoir area, this document is formulated in accordance with relevant laws and regulations and in combination with the actual conditions of the reservoir area. regulations. Article 2 The Liujiaxia Reservoir Area Ecological Environment Protection Area (hereinafter referred to as the reservoir area) is divided into key protection areas and planned management areas.
The Linxia Hui Autonomous Prefecture People's Government (hereinafter referred to as the Prefecture People's Government) organizes relevant parties to make detailed plans for the reservoir area, determine the scope of protection, and make an announcement after approval. Article 3: All organizations and individuals engaged in management, development, production and life in the ecological environment protection zone of the reservoir area must abide by these regulations. Article 4 The reservoir area ecological environment construction management agency of the Autonomous Prefecture People's Government (hereinafter referred to as the reservoir area competent department) is responsible for the coordination, services, unified planning, supervision and management of ecological environment protection and construction in the reservoir area.
The state government and the administrative departments of agriculture, forestry, animal husbandry, hydropower, transportation, construction, environmental protection, land resources, tourism and other relevant counties in the reservoir area shall, according to their respective responsibilities, cooperate with the competent departments of the reservoir area in accordance with the law. We will do a good job in environmental protection in the reservoir area. Article 5 The construction of ecological environment protection zones in the reservoir area shall follow the following principles:
(1) The principles of unified planning, contiguous management, rational development, and combination of prevention and control;
( 2) The principle of connecting the construction of the reservoir area with the local national economic and social development plan, overall land use plan, water transportation development plan, and village and town planning;
(3) The principle of overall planning, highlighting key points, and comprehensive management ;
(4) The principle of who invests in development and who operates and manages it;
(5) Development and utilization pay attention to maintaining the original style of natural landscapes and cultural landscapes, and the layout and shape of construction projects , height, scale, style and color are in harmony with the surrounding environment. Article 6 Ecological environment protection projects in the reservoir area shall be carefully verified and determined by relevant parties organized by the government and organized for implementation.
The maintenance funds for the reservoir area extracted from Liujiaxia Power Station every year and the government’s investment in ecological environment protection are exclusively used for ecological environment protection infrastructure projects in the reservoir area. Article 7 For key protected areas in the reservoir area, engineering measures and biological measures should be combined to gradually and comprehensively implement comprehensive management and protection.
Within the scope of environmental protection in the reservoir area, a target responsibility system for environmental protection construction among state, county, and township (town) heads will be implemented.
Under the premise of unified planning, the county people's government is specifically responsible for the implementation of the ecological environment protection plan for the area under its jurisdiction. The construction plan of water supply and small water conservancy projects must be subject to the management of the entire river basin. Article 8: Project units and individuals that develop and construct within the reservoir area are conducive to protecting the ecological environment. In addition to enjoying preferential policies under relevant national laws and regulations, they will also enjoy relevant preferential policies formulated by states and counties. Article 9: Encourage units and individuals to engage in water-water breeding, commerce, catering, entertainment, tourism, shipping and other business activities in protected areas. Article 10: Supporting units and individuals are encouraged to lease and contract development of barren hills, slopes, wasteland, and shoals in the area around the reservoir, and the government provides funding for various infrastructure constructions.
The contracting period for barren hills, wasteland, barren slopes and barren shoals is 50 years. During the contracting period, they can be inherited and subcontracted in accordance with the law. When the contracting period expires, they can be continued to be contracted.
If the barren hills, slopes, wasteland, or beach where the contract is signed have been left idle for more than 2 years, the contract issuing party shall take them back and re-contract and lease them. Article 11 Within key protected areas, no unit or individual may build permanent buildings without approval.
Existing buildings or facilities in key protected areas that do not comply with the plan must be demolished or relocated within the prescribed period. Article 12: All units and individuals have the obligation to protect the ecological environment of the reservoir area, and have the right to stop and report behaviors that pollute and damage the ecological environment. Article 13 Units and individuals undertaking development and construction projects within the reservoir area shall submit project environmental impact assessment reports and soil and water conservation plan reports (forms). The construction of villages and towns in the reservoir area must also comply with the relevant requirements of the overall planning of the reservoir area. Article 14 New construction, reconstruction, and expansion projects in the reservoir area must strictly implement the environmental impact assessment report (form) review and approval system and the soil and water conservation plan report (form) review and approval system. No construction is allowed without review and approval.
If a development and construction project causes vegetation damage or environmental pollution during the construction process, the project builder shall restore and control the vegetation and environmental pollution or provide treatment compensation. Article 15 Construction projects that pollute seriously and have purification devices that do not meet standards are prohibited in key protected areas. No projects that affect the ecological environment shall be constructed within the planning management area. Article 16 The number of ships developing tourism and shipping in the reservoir area shall be controlled and uniformly managed by the competent department of the reservoir area and the state shipping department. Motorized vessels must install oil leakage and feces recovery facilities, and dump domestic and tourist garbage in designated locations. Article 17 The forest and grass protection range shall be delineated within the reservoir area and shall be closed and managed. Steeply sloping land above 25° will be gradually converted into forests and grasslands, and farmland sloping below 25° will be transformed into terraced fields. Article 18: Prevent water and soil erosion, implement mountain closures for afforestation, promote pen breeding, and encourage planting grass and raising livestock.
It is prohibited to open up wasteland indiscriminately, cut down trees, and graze animals at will.
Sand digging, quarrying, and soil extraction are prohibited in key protected areas. Article 19 The management unit of the water conservation project in the reservoir area is responsible for the maintenance and management of the project, ensuring the normal operation of the project facilities, and prohibiting the following behaviors:
(1) Management and protection of the water conservation project Exploding rocks, digging wells, building houses, piling up waste, etc. within the scope;
(2) Destroying and occupying water conservation projects, shipping terminal projects and their ancillary facilities;
(3) ) Acquire various testing equipment and facilities for water conservation projects, shipping, and safe operation of power stations and occupy the land used for observation points.
