Control standard of compensation for homestead area This Municipality shall give compensation according to the principle of one household and one house, and strictly control the compensation standard for homestead area.

Control standard for compensation of homestead area for one household and one residence: 1982 (inclusive) The former homestead shall not exceed 267 square meters; The homestead identified after 1982 shall not exceed 200 square meters, and the specific compensation control standard for the homestead area shall be determined by the people's governments of each district according to the actual situation of this district.

The part of the homestead area of one household and one house that exceeds the compensation control standard will not be compensated. However, the district people's government shall file a case for the part identified as the homestead area exceeding the compensation control standard before 1982 (inclusive), and pay monetary compensation according to the maximum compensation price not exceeding half of the homestead position.

If more than one household is formed due to legal factors such as housing inheritance, the area of each household's homestead shall be determined in accordance with the compensation control standard stipulated in the preceding paragraph and then calculated together to compensate for one household's homestead; For the part of the total area of the homestead that exceeds the compensation control standard, the District People's Government shall file a case as the case may be, and make monetary compensation according to the highest compensation price where the homestead is located. When determining the homestead area of each house, if it is before 1982 (inclusive), it can be added according to the original area.

Article 19

Identification of compensation area of homestead housing The identification of compensation area of homestead housing should be based on the registered area of real estate ownership certificate. For those who have not obtained the certificate of real estate ownership but have approved the construction documents, the town (street) shall be identified according to the approved construction area. If there is no real estate ownership certificate and building approval document, the township (street) shall, jointly with the village collective economic organization or the village (neighborhood) people's committee, comprehensively study and determine the compensation area in combination with the surveying and mapping area of the house, the construction area to be approved and related policies, and issue a certificate to confirm it after no objection within 0/0 days of publicity.

The part beyond the compensation area of homestead housing will not be compensated.
