Tips for buying a house: Is it invalid to change the "foreign name" real estate license?

Ms. Chen, an American Chinese, was in trouble when handling the transfer of real estate. How to prove that the "I" on the passport is the "I" on the real estate license?

"After entering the United States, my name has been very different from the original. If I transfer, how can I prove that I am me? " Not long ago, Ms. Chen, who has emigrated overseas, asked reporters that the name on her passport had been changed at least once during the immigration process. In her early years, she had a property under the name of Guangzhou, which was registered with her current ID card. If she wants to go through the transfer formalities in the near future, how can she prove that she is now on the American passport and the Chinese mainland real estate certificate?

In an interview with reporters yesterday, the person in charge of the Guangzhou Real Estate Transaction Registry revealed that in recent years, with more and more mainland residents moving abroad, there are more and more cases like Ms. Chen. Because some people leave the country through abnormal channels, some people do not go to the local police station to cancel their accounts after emigration, which is actually a dual identity. It is difficult for such people to have a clear and unified answer when handling real estate registration. The transaction registration department has the guidance of relevant technical specifications and will be more cautious in handling related cases.

Many years ago, Ms. Chen's parents bought a house in Guangzhou. For various reasons, Ms. Chen's mother and her name were used in the real estate license, and at that time, the second-generation ID card had not been launched, and Ms. Chen registered with the first-generation ID card.

"The real estate license is registered by me with a generation of ID cards. However, the first-generation ID card is now invalid, and the ID number on my original China passport is now invalid. " Ms. Chen is a little confused, saying that she will go through the transfer formalities in the near future. How can she prove her identity?

What's more worth mentioning is that Ms. Chen's China passport at that time was marked with her name according to pinyin letters. Later, after she married her American husband, she added her husband's British surname to her passport. Later, she officially naturalized in the United States. Ms Chen kept only her China surname and changed her China name to her English name. "Now my American passports are basically English names. Can you transfer the ownership smoothly without a valid domestic certificate? " Ms. Chen said doubtfully.

Coincidentally. Ms. Ye bought a property in Haizhu District more than ten years ago. Since she later married to Hong Kong and obtained Hong Kong status, the house has always been her brother's. However, some time ago, she decided to sell the house because her business needed liquidity. As a result, after everything was settled, under the guidance of the intermediary, I went to the real estate transaction registration department with the buyer to prepare for the transfer formalities. When she took out her Hong Kong identity card to handle the transfer, she was told that she could not handle it, because her house was bought when she still had mainland status, and the transaction registration department could not determine whether the holder of the Hong Kong identity card and the original holder were the same person.

"The transaction registration department wants us to go to the police station to issue a certificate to prove that I am the same person as the original Hong Kong identity." Ms. Ye told reporters that for this reason, she had to go to the local police station again.

Transaction Registration Department: materials to be submitted for the replacement of identity change.

"This kind of situation involving the change of identity information has become more and more in recent years. Some people who have acquired new identities abroad even want to go through new registration procedures without providing any information. " The relevant person in charge of Guangzhou Real Estate Trading Center told reporters that cases like Ms. Chen and Ms. Ye are actually very common. In line with the principle of ensuring the safety of personal property, the transaction registration department strictly controls the relevant applications.

"In addition to the date of birth, we have to check a lot of information to ensure that the person who provided the new identity information is the same person as the original real estate registration." The person in charge said that generally speaking, as long as you leave the country through normal channels, you must cancel your account at the police station where your original household registration is located, and you will also have relevant entry certificates at the place of entry. If you want to go through the new registration procedures, you need to have the certificate provided by the original police station, as well as your own exit certificate and entry certificate of the place where you moved in. If you want to change your name, you even need some documents to prove where you moved in. Because the situation in different countries and regions is different, it is actually difficult to have a unified standard answer. Only after obtaining the information provided by the registration applicant can we see whether additional information is needed.

According to reports, in practice, the staff of the real estate transaction registration department often encounter some applicants who leave the country through abnormal channels and obtain new identities. Because it is difficult for such people to provide the cancellation certificate of their original residence, the transaction registration department will be more strict in handling it and require more proof materials.

Seven types of rights holders: change of identity information requires proof of change.

Guangzhou Real Estate Transaction Registration Center revealed that the "Technical Specification for Urban Real Estate Registration in Guangzhou" issued last year further clarified the registration after the change of the identity information of real estate rights holders, requiring mainlanders who have obtained the status of overseas residents to submit notarized or certified certificates of identity change. If it cannot be provided, it shall submit other materials that can prove that it is the same person before and after the change, such as the historical identity record before leaving the country or the sworn statement of identity change issued by the household registration administration department where the original account is located.

It is reported that in the following seven cases, the identity information of real estate owners has changed. When applying for registration of new registered items of real estate, the materials proving that the subject of application and the subject recorded in the register are the same person shall meet the following requirements:

(a) the domestic natural person submits the identity change certificate issued by the public security organ where the household registration is located;

(2) If the serviceman is retired or transferred to other jobs, and the real estate is registered with the original military officer's certificate and other identity documents, the identity change certificate issued by the original serviceman's identity document issuing department and the public security organ or civil affairs department where the current household registration is located shall be submitted;

(3) If a domestic natural person obtains the status of an overseas resident, a notarized or certified certificate of identity change shall be submitted; If it cannot be provided, submit other materials sufficient to prove that it is the same person before and after the change, such as the historical identity record before leaving the country or the sworn statement of identity change issued by the household registration administration department where the original account is located;

(4) If an overseas natural person obtains the status of a domestic resident, a notarized certificate of identity change shall be submitted;

(5) An overseas natural person shall submit a certified certificate of identity change;

(6) Domestic legal persons and other organizations shall submit the corresponding identification documents issued by their main registration agencies;

(7) Overseas legal persons and other organizations shall submit certificates of identity change issued by their approval and registration agencies.
