After the interview, the applicant and his lawyer make a final statement, at which time they can provide additional information in their favor. At the end of the interview, the examiner usually won't tell you whether to approve asylum at that time.
The applicant receives the decision. In most cases, the Immigration Department will ask the applicant to return to the Immigration Department to accept the decision at some time two weeks after completing the interview. If the Immigration Bureau determines that the applicant meets the requirements, the applicant will receive an approval letter or a recommendation approval letter (if the background check of the FBI has not been completed). If at this time, the examiner has received the results of the FBI review, he will directly issue a notice of approval.
If the applicant does not meet the requirements, the Immigration Bureau has two decisions: if the applicant has stayed in the United States illegally, the political asylum examiner will hand over the case to the immigration judge and inform the applicant when and where to go to the immigration judge's office for hearing.
If the applicant's identity is still legal, the examiner will send a notice to the applicant, indicating that he intends to refuse the asylum application and explaining the reasons for his intention to refuse. The applicant has 16 days to write a defense and explain the reasons. After reviewing the applicant's defense, if it is reasonable, the examiner will give a letter of approval; If the defense fails to convince the examiner, a letter of refusal will be given.
One year after the political asylum of the approved person is approved, the applicant can apply for adjusting his permanent resident status in the United States.
