Notice of the Municipal Government on Adjusting the Compensation Standards for Land Acquisition to the County (City) and District People's Governments , all municipal committees, offices, bureaus (companies), and all units directly under the municipality:
In order to further standardize the management of collective land acquisition and house demolition, ensure the smooth progress of urban construction, and protect landless farmers and rural areas The legitimate rights and interests of collective economic organizations are based on Su Zhengfa [2003] No. 14 "Opinions of the Provincial Government on Deepening the Reform of the Land Use System and Optimizing the Allocation of Land Resources", Xuzhou Municipal Government Order No. 98 "Xuzhou City Management Measures for the Acquisition of Collective Land and Housing Demolition", Xu Zhengfa [2004] No. 43 "Notice of the Municipal Government on Comprehensively Establishing a Basic Living Security System for Land-expropriated Farmers" and other documents, the municipal government has decided to adjust the relevant compensation standards for land expropriation. The notice is now as follows:
1. About Compensation and resettlement standards for “villages in the city”? According to the spirit of Provincial Government Su Zhengfa [2003] No. 14 document, the methods and standards for compensation and resettlement for the demolition of “villages in the city” houses in our city’s urban planning areas involved in the requisition of collective land shall be based on the urban housing The demolition measures are implemented, and the legal construction area of ??the demolished houses is determined in accordance with the municipal government's Order No. 98. The scope of "urban villages" refers to village groups with less than 0.1 acres of cultivated land per capita within the city's Third Ring Road.
2. Adjust and raise the land acquisition compensation standard? The municipal government decided to adjust and raise the relevant land acquisition compensation standard stipulated in Xu Zhengfa [1999] No. 155 "Municipal Government Notice on Implementing the Government's Unified Land Acquisition". The adjusted average annual output value of cultivated land in the first three years is shown in Appendix 1, the compensation standards for trees and flowers are shown in Appendix 2, and the compensation standards for ground attachments are shown in Appendix 3. Compensation fees for young crops are generally calculated based on the output value of crops in one season, and those that can be harvested as scheduled will not be compensated. The adjusted compensation standards for young crops are as follows: in Category III areas, dry land is RMB 800 per mu, paddy fields are RMB 900 per mu, and vegetable fields are RMB 1,350 per mu; in Category IV areas, dry land is RMB 700 per mu, paddy fields are RMB 800 per mu, and vegetable fields are RMB 700 per mu. The land price is 1,250 yuan per mu.
3. Regarding other standards involved in the requisition of collective land and house demolition
The implementation procedures for the demolition of collective land houses under the Municipal Government Order No. 98 "Xuzhou City Management Measures for the Requisition of Collective Land and House Demolition" , resettlement methods, etc. have been stipulated in principle. The specific standards and relevant regulations required for the implementation of this method shall be implemented in accordance with Annexes 4, 5, 6, 7 and 8 in addition to the above-mentioned Annexes 2 and 3.
This notice will come into effect on July 1, 2004. Land acquisition projects approved before this date will be subject to the original land acquisition compensation standards. If the compensation standards for land acquisition in Xu Zhengfa [1999] No. 155 "Notice of the Municipal Government on the Implementation of Unified Government Acquisition of Land" are inconsistent with this document, this document shall prevail.
