Measures for the implementation of transitional provisions of Manila amendment to STCW Convention

Article 1 In order to do a good job in the training, examination and certification of seafarers during the transitional period of the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (hereinafter referred to as Manila Amendment to STCW Convention), according to Article I/ 15 of the Annex to Manila Amendment to STCW Convention, Rules of People's Republic of China (PRC) Municipality on Certification of Seamen's Competency Examination (OrderNo. 1 1 of the Ministry of Transport of the People's Republic of China) (hereinafter referred to as "165438") are based on the Administrative Measures for Certification of Seamen's Training (Haijian [20 12] 170).

Article 2 These Measures shall apply to the following persons who apply for seafarers' competency certificates issued in accordance with 1 1 Rules (hereinafter referred to as1/Rules) and seafarers' training competency certificates issued in accordance with the new training certificate method (hereinafter referred to as "new training certificate"):

(1) Persons who worked as seafarers before March 20121;

(2) 1, personnel who have received education and training for seafarers before July 2065438, but whose education and training did not meet the requirements of Manila Amendment to STCW Convention.

Article 3 From July 12 to July/0/2, the issuance, visa and renewal of seafarers' certificates of competency shall be implemented in accordance with the Rules 11. Those who originally held the certificates of competency for the captain and senior crew in the near-sea area will be renewed from July 1 2065438. Since July 1 2006, the issuance, visa and renewal of seafarers' certificates of competency have been stopped in accordance with the Rules for Examination, Assessment and Certification of Seagoing Crews in People's Republic of China (PRC) promulgated by the former Ministry of Communications (Order No.6 of the Ministry of Communications in 2004, hereinafter referred to as "Rule 04"), and the certificate of competency issued in accordance with "Rule 04" is valid.

12, 1, July 2065438, the training, examination and issuance of seafarers' training certificates were started according to the new training certificate method, and the training, examination and issuance of People's Republic of China (PRC) Professional Training Certificate and People's Republic of China (PRC) Special Training Certificate (hereinafter referred to as "old training certificate") were stopped. Personnel who have completed training but have not obtained the old training certificate shall apply for a new training certificate in accordance with the provisions of these Measures. During the validity period, the old training certificate can be used until 20 16 12 3 1.

Article 4 Seagoing seamen must hold the "Rules 1 1" competency certificate and new training certificate when they embark for work on 20 17 1.

Article 5 The competency examination for seafarers conducted in accordance with the "04 Rules" shall be suspended from February 6, 2003, and the make-up examination shall be suspended from July 6, 2003. Since the date of issuance of these Measures, the make-up exam conducted in accordance with the "04 Rules" is not limited by an interval of 60 days, but the number of make-up exams after the "1 1 Rules" takes effect shall not exceed 5 times.

Before July, 2065438+2003 1, those who failed to pass the seafarer's competency examination according to the "04 Rules" may apply for changing the scores of the competency examination in coastal navigation areas if all the scores except English subjects or items have passed and the results have not exceeded the validity period; Those who fail in other subjects or projects except English shall not apply for the results of competency examination in coastal navigation areas, and the overdue results will be invalid.

Article 6 From July 20 12 1 day, the seafarer competency examination will be held in accordance with the "Rules 1 1".

Article 7 Students of technical secondary schools and two-year maritime education who entered the school before the entry into force of "Rule 1 1" may complete the transitional competency training specified in Annex 1 or the post competency training that meets the requirements of "Rule1",and may be given a certificate on 20/kloc-0.

Article 8 Maritime colleges and training institutions that have obtained seafarers' competency training qualifications shall meet the requirements of the Notice on Preparing for the Implementation of Manila Amendment to STCW Convention (No.923 [20 1 1]) before July 20 13. If they can't meet the requirements, they can't engage in sea training in the future.

A person who holds a valid certificate of competency as an officer of the 04 Rules shall be deemed to have completed the post competency training meeting of 1 1 Rules in the maritime colleges and training institutions that meet the requirements of the preceding paragraph, and passed the post promotion competency examination for seafarers according to 1 1 Rules.

Article 9 When applying for the certificate of competency of "1 1 rules" in accordance with the provisions of these Measures, the personnel who hold the "04 Rules" and the previously issued certificates of competency of captains and officers shall complete the following training and examinations:

(1) The holders of valid certificates of competency in Rules 04 for the captain and senior crew members may apply for the corresponding certificates of competency in Rules 11after completing the transitional competency training specified in Appendix1of these Measures and passing the examination.

(2) The holders of the certificates of competency of the captains and officers of the 04 Rules that have expired may apply for the 11Rules after completing the transitional competency training specified in Appendix1of these Measures and passing the competency sampling test specified in1Rules.

(3) Persons who hold the certificates of competency for captains and officers issued before August 1 2004 may apply for the certificates of competency for Rules 1 1 in accordance with the provisions of these Measures after completing the post competency training specified in Rules1.

Seafarers should obtain a new training certificate before applying for the "1 1 rules" competency certificate.

Article 10 Persons holding valid "04 Rules" certificates of competency for captains and officers may apply for "1 1 rules" certificates according to the following corresponding navigation areas and grades:

(1) Persons who hold the "04 Rules" competency certificates for captains and officers in the infinite navigation area and near the sea area can apply for the "1 1 Rules" competency certificate in the infinite navigation area.

(2) Those who hold the certificates of competency for the captain and senior crew in the coastal navigation area stipulated in the 04 Rules may apply for the certificates of competency in the coastal navigation area of the corresponding level stipulated in the 1 1 Rules.

(3) Holders of "04 Rules" certificates of competency for captains and officers in coastal navigation areas may apply for "1 1 Rules" three types of certificates of competency for coastal navigation areas.

Article 11 When a captain and an officer holding a valid certificate of competency under "Rules 04" apply for a certificate of competency under "1 1 Rules" in accordance with these Measures, their maritime service qualifications shall be:

(1) If the provisions of Item (1) or Item (2) of Article 15 of the Rules 1 1 are met, the maritime administrative agency may issue a certificate of competency with a validity period of not more than five years;

(2) Where the provisions of Item (1) or Item (2) of Article 15 of the Rules 1 1 are not met, the maritime administrative agency may issue a certificate with the same validity period as the original certificate of competency, or issue a certificate of competency with a validity period of not more than five years after participating in simulator training and passing the examination.

Article 12 The crew members who have passed the "04 Rules" competency examination can apply for the "11Rules" competency certificate in accordance with the provisions of Article 9 of these Measures if they have completed the transitional competency training specified in Appendix1of these Measures and passed the examination.

Article 13 Units that have conducted training on electronic chart display and information system (ECDIS), bridge resource management (BRM) and engine room resource management (ERM) before 20 1 March 2/KLOC-0 shall report the training outline, teaching plan, trainee list and relevant records to the maritime administrative agency directly under the Central Government. If they pass the exam, their training will be recognized, and during the transition period, the trainees will be competent for the training content.

Article 14 A person who holds valid certificates of competency for Class III and Class III seafarers in Rules 04 may apply for the certificate of competency for Class II seafarers in Rules 1 1, complete the transitional competency training specified in Appendix 1 of these Measures and pass the examination, and may apply for the certificate of competency for Class II seafarers in Rules 16544 accordingly.

Article 15 When applying for the third-class coastal competency certificate of 1 1 Rules in accordance with these Measures, the crew members who hold a valid certificate of competency as captain or pilot in the coastal navigation area of "04 Rules" do not need to provide the Training Certificate of Radar Observation Plotting and Radar Simulator and the Training Certificate of Automatic Radar Marker.

Article 16 A person who holds a valid certificate of competency for a seaman on duty with a gross tonnage of 500 tons or above or a mechanic on duty with a tonnage of 750 kilowatts or above in Rule 04, has not less than 65,438+08 months of work experience and a good safety record, shall complete the post competency training for a senior seaman or mechanic on duty as stipulated in Rule 65,438+065,438+0, and pass the corresponding competency examination.

Article 17 Anyone who meets one of the following conditions and has completed the transitional competency training for electronic and electrical personnel specified in Appendix 1 of these Measures and passed the examination may apply for the competency certificate for electronic and electrical personnel in the corresponding navigation area:

(1) Holding a certificate of competency as an electrical engineer in accordance with the Rules for the Examination and Certification of Seamen in People's Republic of China (PRC) promulgated by the Ministry of Communications 1987 (hereinafter referred to as "Rule 87");

(2) For seafarers with full-time college education or above, if they have actually performed their duties as electrical engineers or electronic electricians on board for 24 months within 1 10 years before the Rules come into effect, the company will issue their employment certification materials.

Article 18 The holder of the old training certificate shall apply for the renewal of the corresponding new training certificate in accordance with the provisions of these Measures before July 20 16 1, and the crew members may apply for the renewal of the new training certificates for all their related projects at one time.

Nineteenth crew members with valid old training certificates shall be trained, tested and replaced with transitional certificates in accordance with the following principles:

(1) Before applying for the renewal of the new version of the Basic Safety Training Certificate, the crew members who hold the old version of the Certificate of Familiarity and Basic Safety Training shall complete the make-up training for the transition certificate specified in Annex 2 of these Measures and pass the examination.

(2) The crew members who hold the proficiency certificate of the old version of survival craft and rescue boat training, the proficiency certificate of fast rescue boat training, the advanced fire fighting training certificate, the proficiency certificate of first aid training and the medical training certificate on board can directly apply for the new version of the corresponding training certificate.

(3) Crew members who hold the old version of the Training Certificate for Ship Security Officers may directly apply for the renewal of the new version of the Training Certificate for Security Awareness and the Training Certificate for Seafarers with Designated Security Duties, complete the transitional certificate training specified in Annex 2 of these Measures, and renew the Training Certificate for Ship Security Officers after passing the examination.

(4) The crew members who hold the old version of the Special Training Certificate for Oil Tankers (Safety Knowledge) or the Special Training Certificate for Chemical Tankers (Safety Knowledge) shall complete the transitional certificate training specified in Annex 2 of these Measures and pass the examination before applying for renewal of the Basic Training Certificate for Cargo Operation of Oil Tankers and Chemical Tankers;

(5) The crew members who hold both the old version of the Special Training (Safety Knowledge) Certificate for Oil Tankers and the Special Training (Safety Knowledge) Certificate for Chemical Tankers may directly apply for the renewal of the Basic Training Certificate for Cargo Operation of Oil Tankers and Chemical Tankers.

(6) The crew members who hold the old version of the Certificate of Special Training for Oil Tanker Crew (Safe Operation) may apply for renewal of the Certificate of Advanced Training for Oil Tanker Cargo Operation only after passing the make-up examination and training specified in Annex 2 of these Measures;

(7) A crew member who holds both the old version of the Special Training Certificate for Oil Tanker Crew (Safe Operation) and the Special Training Certificate for Oil Tanker Crew (Crude Oil Washing) may directly apply for the renewal of the Advanced Training Certificate for Oil Tanker Cargo Operation.

(8) The crew members who hold the special training (safe operation) certificate of the old chemical tanker crew can directly apply for the renewal of the advanced training certificate for cargo operation of the chemical tanker.

(9) Crew members who hold the old version of the Certificate of Special Training (Safety Knowledge) for LPG Ship Crew can directly apply for renewal of the Certificate of Basic Training for Cargo Operation of LPG Ship.

(10) Crew members who hold the old version of the Special Training (Safe Operation) Certificate for LPG Ship Crew can directly apply for renewal of the Advanced Training Certificate for Cargo Operation of LPG Ship.

(11) The crew holding the old version of the Special Training Certificate for Passenger Ship Crew can only apply for a new version of the Special Training Certificate for Passenger Ship Crew if they have passed the supplementary training with the transitional certificate specified in Annex 2 of these Measures and passed the examination.

(12) Crew members who hold special training certificates for old passenger ships and ro-ro passenger ships can directly apply for renewal of new special training certificates for passenger ships.

(13) The crew members who hold the old version of the Special Training Certificate for Large Ship Manipulation and the Special Training Certificate for High-speed Ship Crew can directly apply for the renewal of the corresponding new training certificate.

Article 20 Passing the examination of Training Certificate of Radar Observation Plotting and Radar Simulator and Training Certificate of Automatic Radar Plotter at the same time is the same as passing the examination of Radar Operation and Application required by Rules 1 1.

Twenty-first crew members who have been employed on board before 2012/year 10, who have not less than 6 months' maritime service experience in the three years before the application date, or who have 3 months' maritime service experience before the application date and have fulfilled their security duties according to the security plan, can be employed on 20 14 1.

For crew members who are not satisfied with the above conditions in the first paragraph of this article, they shall complete the training of safety awareness and designated safety duty crew before obtaining the certificate of safety awareness training and the certificate of designated safety duty crew training.

From 20 14 65438+ 10/0/day, all crew members on board shall obtain the Safety Awareness Training Certificate and the Safety Duty Designated Crew Training Certificate in accordance with regulations before taking up their posts on board.

The provisions of the first three paragraphs of this article are only applicable to the crew working on ships on international routes, and the crew working on ships on domestic routes shall be implemented in accordance with the requirements of the Regulations of People's Republic of China (PRC) on Ship Security.

Twenty-second captain and senior crew training and competency certificate training can be carried out at the same time.

Article 23 Shipping companies, ship management companies, seamen's service agencies or seamen's overseas agencies that have passed the safety management system audit may organize ordinary seamen who have signed labor contracts or service agreements with them to carry out transitional certificate replacement training (Annex 2 Table 1), but no fees shall be charged, and the training plan and certificate shall be reported to the authorized maritime agency for the record.

Twenty-fourth crew members holding old training certificates shall apply to the maritime administrative agency in accordance with the following principles:

(a) the holder of the certificate of competency applies for replacement, and in principle applies to the issuing authority;

(two) for the first time to apply for a certificate of competency, you can apply to the issuing authority for renewal at the same time as applying for a certificate of competency;

(three) those who do not hold the certificate of competency apply for replacement, which can be applied by the training unit.

Twenty-fifth transitional training conducted in accordance with these measures shall not exceed 8 hours a day.

Article 26 These Measures shall be implemented from March 20 12 to March 36, 20 1 6.
