Article 2 These regulations shall apply to the planning, construction, management, protection, restoration, utilization and supervision of the Yanghe River Basin (hereinafter collectively referred to as management and protection). The management and protection of world natural heritage sites, nature reserves, scenic spots, national forest parks, etc. in the Yanghe River Basin shall be implemented in accordance with relevant laws and regulations. Article 3 The Yang River Basin referred to in these regulations refers to the waters and land areas within the first ridge line on both sides of the Yang River mainstream and its first-level tributaries in this autonomous prefecture. The specific scope shall be determined by the state people's government in accordance with relevant regulations and the needs of Yanghe ecological environment management and protection, and shall be announced to the public. Article 4 The management and protection of the Yanghe River Basin shall follow the principles of green development, priority in protection, overall planning and rational utilization. Article 5 The people's government of the prefecture and the people's governments of Huangping County, Shibing County, Zhenyuan County and Cengong County where the Yangtze River flows (hereinafter referred to as the people's governments at the prefecture and county levels within the basin) work together to manage the Yangtze River. Watershed management and protection.

The state people's government should establish a joint meeting system for watershed management and protection work, strengthen cross-regional work coordination with neighboring cities (states) and counties, coordinate and resolve major issues in watershed management and protection in a timely manner, and supervise the implementation of management and protection measures.

The Standing Committee of the Autonomous Prefecture People’s Congress should, based on the needs of protecting the Yang River Basin, establish a collaborative supervision mechanism with the Standing Committee of the People’s Congress at the same level in neighboring regions to promote the implementation of cross-regional linkage coordination and protection mechanisms.

The people's governments at the county level within the basin shall organize and lead the Yanghe River water resources management, protection and utilization, river management, water pollution prevention and control, water environment management and other work within their respective administrative regions at different levels and in sections.

The relevant administrative departments of the people's governments at the state and county levels within the basin and the people's governments of the townships (towns) within the basin shall be responsible for the management of the Yang River Basin in accordance with laws and regulations and the division of responsibilities determined by the people's governments at the state and county levels. protection related work.

County-level people's governments and relevant administrative departments within the basin should establish a mutual notification and collaborative law enforcement mechanism for ecological and environmental violations. Article 6: Encourage and support villagers' committees, residents' committees and other mass autonomous organizations in the Yangtze River Basin to formulate villagers' conventions and residents' conventions in accordance with the law, assist in the management and protection of the Yangtze River Basin, and guide villagers and residents in the Yangtze River Basin to protect the ecological environment. Article 7 People's governments at all levels within the basin shall implement the river chief responsibility system for the management and protection of the Yang River Basin, and organize and lead the management and protection of the Yang River within their respective administrative regions at different levels. Article 8 The relevant administrative departments of the people's governments at the prefecture and county levels within the basin shall organize basic surveys of the Yang River water system and waters in their respective administrative areas, establish and improve Yang River water quality, sewage outlet settings, key pollution discharge units, and water pollution Information archives on prevention and control, water engineering construction, water resources utilization, water environment emergencies, administrative licenses, administrative penalties, etc., strengthen the informatization construction of Yanghe River Basin management and protection, and promote the social sharing of information resources. Article 9 The people's governments at the state and county levels within the basin shall incorporate the management and protection of the Yangtze River Basin into the national economic and social development plan, and include the funds for the management and protection of the Yangtze River Basin in the fiscal budget of the government at the same level. Article 10: Establish and improve the compensation mechanism for ecological protection in the Yanghe River Basin. Involving cross-county compensation, ecological protection and restoration, sewage and garbage and other environmental management, expropriation, development and utilization of important natural resources in accordance with the law, ecological migration and relocation, agricultural cleaner production and other matters that should be compensated according to law, the state people's government shall formulate specific ecological compensation way.

The people's governments at the state and county levels within the river basin should actively explore the establishment of a diversified ecological protection compensation mechanism and reasonably determine the scope and standards of compensation. Article 11 The people's governments at the prefecture and county levels within the basin shall report to the Standing Committee of the People's Congress at the same level every year on the management and protection of the Yang River Basin. Article 12 People's governments at all levels within the basin and their relevant administrative departments, primary and secondary schools shall strengthen publicity and education on the management and protection of the Yang River Basin, popularize knowledge on ecological and environmental protection, and guide the public to consciously abide by the relevant laws and regulations on the management and protection of the Yang River Basin. regulations. Article 13: People's governments at the state and county levels within the basin encourage and support citizens, legal persons and other organizations to participate in the management and protection of the Yang River Basin in accordance with the law.

Rewards will be given to units and individuals that have made outstanding achievements in the management and protection of the Yanghe River Basin. Article 14: Any unit or individual has the right to dissuade, report and accuse violations of these regulations. The relevant administrative departments of the people's governments at the state and county levels within the river basin shall handle complaints and reports in a timely manner after receiving them.

For behaviors that pollute the water environment of Yanghe River Basin and harm the interests of the public, agencies and relevant organizations that comply with legal provisions may file public interest litigation with the People's Court. Chapter 2 Management and Protection Article 15 The relevant departments of the state people's government and the county-level people's governments in the basin shall prepare a comprehensive plan and special plan for the protection of the Yanghe River Basin in accordance with the land and spatial planning, and implement it after approval. Article 16: The management, protection, development and utilization of water resources in the Yanghe River Basin shall ensure the ecological base flow and fully consider the ecological environment carrying capacity of the basin. The water resources in the Yanghe River Basin should give priority to meeting domestic water needs, taking into account the needs of production, ecological water use and tourism development, and maintaining reasonable water levels in the main and tributary rivers.
