In order to further deepen the reform of household registration management system and promote urban and rural economic development, according to the Opinions of Yunnan Provincial People's Government on Deepening the Reform of Household Registration Management System in Yunnan Province and the Opinions of Yunnan Provincial Public Security Department on Circular, combined with the actual work of household registration management in our region, these implementation measures are formulated.

I. General requirements

(a) the full implementation of "unified" household registration management system.

(two) unified cancellation of the nature of household registration conversion.

Since June 65438+1 October12008, Hongta District has cancelled the procedures for examination and approval of "rural to non-agricultural" and "rural to non-agricultural" accounts and registered them as "resident households" in a unified way; In order to maintain the continuity of work, the original household registration nature is temporarily retained in the population information database (the retention period is tentatively set at two years) to ensure the work needs of relevant government departments.

(3) Standardized household registration certificate

1. Citizens who have obtained resident ID cards and engaged in relevant social activities in Hongta District will prove their identity with their resident ID cards or household registration books, and the public security organs will no longer issue household registration certificates, and no unit or individual will require citizens to provide household registration certificates.

Citizens who have not applied for the "Resident Identity Card" are required to issue household registration certificates. Anyone who meets the requirements for applying for a "Resident Identity Card" shall apply for a "Resident Identity Card" first, and then the public security organ shall issue a household registration certificate in the original way.

For citizens under the age of sixteen who have not applied for the "Resident Identity Card", the public security organ shall issue the household registration certificate according to the original method.

2. If a citizen requests to issue a household registration certificate, the copy of the home page provided by the masses and his own household registration card shall be stamped with "agricultural registered permanent residence or agricultural registered permanent residence before February 2007, and unified registration after the reform of unified household registration management system from June 65438 to February 2008 10". "Stable source of life" refers to the situation that you have legitimate income, can support yourself and do not need to receive subsistence allowances. "Units" refer to all communities, villagers' committees, villagers' groups, organs, enterprises, institutions and other units that assist the public security organs in household registration management.

1. The relocation and resettlement of the asylum seekers mainly depends on whether the asylum seekers have a legal and fixed residence, and whether the asylum seekers and the asylum seekers live together and do not receive the "minimum living allowance". 4. For those who meet the conditions of relocation and birth settlement, but the unit does not sign the opinion of agreeing to settle down, the applicant shall go to the unit that should settle down with the notice of settlement issued by the police station, and the unit that should settle down shall sign the opinion (agree or disagree). After the applicant signs the opinions and signs them according to the opinions of the units to be settled, the public security organ will directly approve the settlement in accordance with the regulations on household registration in People's Republic of China (PRC).

Second, the approval authority and procedures

Within the scope of Hongta District, the examination and approval authority for "three refuges" and the examination and approval authority for newborn babies to settle down shall be examined and approved by the directors of each police station in the sub-bureau, and the police station where they moved in shall issue the "Permit to Move"; Outside personnel "three refuge" settled in Hongta District, and other household registration examination and approval authority stipulated in these Measures shall be in Hongta Branch of the Municipal Public Security Bureau. Third, specific measures

If two or more natural persons who are not immediate family members jointly purchase houses, only one family of the house owner on the house ownership certificate is allowed to move into the household registration relationship.

Housing owners who own multiple sets of commercial housing in this city apply for settlement in the real property right.

After buying a second-hand house and settling down, the ownership of the house where the owner has settled is transferred or changed, and the original household registration is all moved out, the newly moved residents can be allowed to settle down.

The public security organ shall not accept the application for relocation and resettlement of persons who move freely in towns and surrounding areas, illegally occupy land to build houses, illegally reclaim land, illegally build houses or rent houses. However, public security organs should be included in the scope of actual population management according to regulations.

(2) University and technical secondary school graduates move in and settle down.

4. Students who are admitted to colleges and universities in our district, because their parents' household registration changes in this district, have not implemented their work when they graduate, and can be allowed to move with their parents.

5. Students who have been admitted to ordinary colleges and universities in the region have already gone through household registration transfer when they enter school. If they are employed in our district when they graduate, they can directly move their household registration relationship to the place of employment and may not stay in the police station where the school is located; If you are not employed in our district when you graduate, the local police station where the school is located will move the household registration relationship to the place where the household registration is located before entering school or voluntarily move to the employment place outside the district, and you may not stay at the local police station.

6. Non-local students admitted to ordinary colleges and universities in the region who have not moved to registered permanent residence at the time of admission shall be compiled by the school according to the Measures for the Application of Temporary Residence Permit by the Ministry of Public Security of People's Republic of China (PRC) and China and the Measures for the Administration of Temporary Population in Yunnan Province by the People's Government of Yunnan Province, and sent to the local police station for registration. The police station shall not apply for temporary residence permits for them, nor shall it charge any fees.

7. For the purpose of transferring household registration, the employer signs a false employment contract with the actual unemployed graduates and provides false certification materials; Even if the employer collects money from graduates for the purpose of making profits and applies to the public security organ for registered permanent residence relocation, once verified, the public security organ will forcibly move its household registration to the original household registration place and notify me. The persons directly in charge and other directly responsible personnel of the unit that commits fraud, as well as the actor himself, shall be investigated for legal responsibility in accordance with relevant laws.

8. Graduates from ordinary colleges and universities (including higher vocational schools and technical schools) who have been admitted from other provinces and come to our region for employment shall still be executed according to the original relevant regulations when they migrate in registered permanent residence.

Previous graduates of Hongta District who have not settled down so far shall be handled with reference to the relocation and settlement methods of recent graduates.

(C) "three asylum" personnel settled down

1. If the husband and wife take refuge in each other and live together, regardless of marriage age or age, the household registration relationship will be transferred according to the legal residence of the spouse who takes refuge. To apply for relocation of a spouse, the following materials shall be provided:

1. If an abandoned baby is adopted according to law, the following materials shall be provided when applying for settlement at the adopter's legally fixed residence:

2. If the actual investment in Hongta District reaches 5 million yuan, the business is more than 1 year, and the annual tax payment of the enterprise is more than 300,000 yuan, foreign investors and their immediate family members and 10 senior management personnel (including technical backbone) can apply for permanent residence, and the following materials are required:

(1) Fill in the application form for settlement in Hongta District.

(3) Business License of Enterprise as a Legal Person issued by the administrative department for industry and commerce;

3. (4) the annual tax payment certificate of the tax authorities at or above the county level;

(5) If the investor applies for the spouse or minor children to settle down, provide a copy of the marriage certificate (the original is submitted for inspection), and one of the materials such as lineal relatives certificate, birth medical certificate and one-child certificate issued by the original household registration police station;

(6) A copy of the labor contract in Yunnan Province that the senior managers and technical backbones applied for registration with the labor and social security department at or above the county level (submit the original), a copy of the certificate of "Five Risks" purchased by the enterprise for the senior managers and technical backbones (submit the original) and a written opinion that the enterprise legal person agrees to settle down.

(7) senior managers and technical backbones who have settled down must apply for spouses and minor children to settle down in accordance with the requirements of "three refuges";

The senior management of an enterprise refers to the personnel above the manager of the internal department of the enterprise, and shall be handled by the official letter of appointment or appointment of the company.

(9) Relocation and resettlement.

1. When the public security organ handles the household registration transfer procedures in this city, it no longer marks the nature of the household registration certificate, nor does it need to issue a certificate of the nature of the household registration.

2. When the public security organ goes through the procedures for the migration of residents across provinces, municipalities directly under the Central Government and autonomous regions, if the migration personnel require to indicate the nature of the household registration, the local public security police station shall indicate "agricultural registered permanent residence" or "non-agricultural registered permanent residence" in the remarks column of the household registration form and population information database; If there is no hukou in the permanent population registration form and population information database, it is "non-agricultural population" if it is registered in the urban community neighborhood Committee according to the hukou; If the household registration is registered in the rural villagers' committee and the second round of land contractual management right is obtained according to law, it shall be handled as "agricultural population".

The main leaders of the department should personally take the lead, attach great importance to and strengthen leadership from the overall situation of reform, development and stability, and keep abreast of the progress of the work; The leaders in charge of the department should be personally responsible, coordinate and solve the problems and difficulties encountered in the work, establish a leadership responsibility system, grasp the first level and be responsible for the first level, and do a good job in the reform of the household registration management system. The police station should do a good job in household registration management in time, strengthen supervision and inspection, and prevent the enthusiasm of the masses to participate in the reform from being dampened because the policy is not implemented; Prevent slow action, even long-term indecision and procrastination, which will affect the reform process; Prevent the reform of household registration management system as an excuse to charge for hitchhiking and increase the burden on the masses; It is necessary to comprehensively clean up and cancel the "local policy" of household registration management, remove obstacles to the reform of household registration management system, and ensure the smooth and smooth progress of the reform.

(two) the public security organs shall exercise the power of account examination and approval in a unified manner and standardize the time limit for handling. In principle, the examination and approval of household registration transfer shall be implemented by the Public Security Bureau. The examination and approval authority for household registration migration and newborn babies' settlement within Hongta District shall be examined and approved by the directors of each police station of the sub-bureau; Foreign personnel to settle in Hongta District and other accounts stipulated in these Measures shall be audited by the public security police station and approved by the public security bureau. Especially difficult and complicated household registration migration issues or organizational relocation, large-scale infrastructure construction migration and other household registration migration issues, reported to the higher public security organs for approval.

1. If it complies with laws, regulations and policies, and the application materials are complete and approved by the police station, it shall be handled in time after receiving the materials;

2. If the application materials need to be investigated, verified and submitted for approval, the police station shall complete the investigation and verification within five working days from the date of accepting the application materials, and report the materials to the Public Security Management Brigade of the Public Security Bureau for approval;

3. After receiving the submitted materials, the Public Security Management Brigade of the Public Security Bureau shall, upon examination, make a decision on approval or disapproval of the household registration matters that have the right to make a decision on examination and approval within five working days after receiving the materials submitted by the police station, and feed back the examination and approval results to the police station;

4. After receiving the approval decision from the public security organ at a higher level, the police station shall notify the applicant of the approval result within five days. If it is not approved, it shall explain the reasons to the parties concerned.

5. If the application materials are incomplete, the applicant shall fill in the Notice of Supplementary Materials for Household Registration, indicate the contents and names of supplementary materials, and submit them to the applicant. For household registration items that do not meet the requirements of laws, regulations and policies, the applicant shall be informed on the spot of the reasons for not handling them.

(three) open policies and procedures, establish and improve the household registration responsibility system. The public security management department of the Public Security Bureau should conscientiously practice the purpose of serving the people wholeheartedly, strictly enforce the law, provide enthusiastic service, simplify procedures to the maximum extent, improve work efficiency, and avoid the people who handle affairs rushing back and forth. The policies and procedures should be made public in the window of the convenience center of the sub-bureau and the window of the police station; Establish and improve the household registration responsibility system, household registration supplementary materials notification system, unsettled notification system and mass appraisal system.

Units that do not need to set up collective households should cancel their collective households through rectification. At the same time, all localities should strictly limit the approval of new collective households. Secondly, it is necessary to intensify the efforts to clean up and rectify one household and many households. For the situation that many families have settled in one residence before June 365438+February 3, 2007/KLOC-0, all the families and personnel who have settled down will be ordered to gradually move their household registration relationship into the legal fixed residence according to the principle of only going out but not entering.

(5) Increase publicity. Relevant departments, especially the Public Security Bureau, should widely publicize the specific content and significance of the reform of the household registration management system, increase transparency, hand over policies to the masses, dispel their doubts, mobilize the enthusiasm of the masses to participate in the reform, and create a good atmosphere for the reform.

These Measures shall come into force as of June 22, 2008. Where the provisions in the original Notice on Printing and Distributing the Provisions on the Examination and Approval Authority of Hongta District Accounts are inconsistent with these measures, these measures shall prevail. The specific application of these Measures shall be interpreted by Hongta Branch of Yuxi Municipal Public Security Bureau.
