Announcement of two foreigners going to China
With the announcement of the China Embassy in the United States that "it is not necessary, it is not urgent, and no travel", and a large number of green cards with tourist visas and American green cards can't get the green code to return to China these days, many foreigners came to the airport in the news, and some of them got the green HDC code. Many readers don't quite understand and even have many misunderstandings about which foreigners can enter China. This article explains the policy of foreigners entering China under the epidemic situation.
First of all, we must carefully interpret the two announcements. The first is the Announcement of the Ministry of Foreign Affairs and the State Administration of Immigration of People's Republic of China (PRC) on Temporarily Stopping the Entry of Foreigners with Valid Chinese Visa and Residence Permit (hereinafter referred to as Announcement No.3-26) issued by the Ministry of Foreign Affairs and the State Administration of Immigration on March 26, 2020, and the second is the Announcement of the Ministry of Foreign Affairs and the State Administration of Immigration of People's Republic of China (PRC) on Allowing Three Kinds of Effective Residence issued by the Ministry of Foreign Affairs and the State Administration of Immigration on September 23, 2020.
The announcement of March 26th not only tells us that foreigners are prohibited from entering China from March 28th, 2020, but also tells us two important messages:
1. Foreign affairs, official duties, courtesy and C visa entry are not affected.
2. The entry of foreigners with visas issued after March 28, 2020 will not be affected.
The 9-23 announcement did not abolish the 3-26 announcement, but was an important supplement to the 3-26 announcement:
Foreigners with valid residence certificates such as work, private affairs and reunion in China are allowed to enter the country.
If the above permit expires after March 28, 2020, you can re-apply for the corresponding Chinese visa.
Knowing this, we will specify which foreigners can go to China:
1. Foreigners with diplomatic, official, courtesy and C visas can enter China.
2. Foreigners who issue visas after March 28, 2020 can enter the country.
3. Foreigners with valid residence certificates such as work, private affairs and reunion in China can enter China.
4. Foreigners who hold residence permits for work, private affairs and reunion in China that expire after March 28, 2020 can re-apply for visas.
Some exceptional countries
On June 4, 2020, the Chinese Embassy in the UK issued the Notice on Temporarily Stopping Entry of Persons with Valid Chinese Visa and Residence Permit into the UK. Soon, including China's embassies in Britain, France, Italy, Belgium, Russia, the Philippines, India, Ukraine, Bangladesh and other countries issued an announcement to the effect that:
Foreigners from these countries need visas issued after June 3, 2020. 165438+ can enter China.
Foreigners from these countries are not allowed to enter China with residence permits for work, private affairs and reunion in China.
Note that the visas of foreigners from these countries from March 28th to June 28th165438+1October 2nd did not expire, but the local embassies and consulates did not allow these foreigners to go directly to China, and they could not get the health declaration form (later changed to HDC code). That is to say, foreigners from these countries can enter other countries (such as the United States to China) as long as they hold the above three kinds of residence or visas from March 28th to165438+10.2.
Frequently asked questions and answers
I hold a 10 China visa issued before the outbreak. Can I enter the country?
You can't.
What are the diplomatic, official, courtesy and C visas that will not be affected?
Diplomatic and official visas are issued to government officials, diplomats, consular officials, their accompanying spouses and minor children who hold diplomatic and official passports or United Nations red and blue passports for temporary business or transit in China.
Courtesy visas are issued to the above-mentioned people who come to China, visit relatives or transit on private business.
Class C visas refer to international train attendants, crew members of international aircraft, crew members of international sailing ships and their accompanying families, as well as automobile drivers engaged in international road transport and performing crew, aviation and shipping tasks.
Are Hong Kong, Macao and Taiwan compatriots and their children with valid China travel permits affected by these bans?
Compatriots from Hong Kong and Macao hold Home Visit Certificates (full name "Hong Kong and Macao Residents' Pass to and from the Mainland"), and compatriots from Taiwan Province Province hold Taiwan Province Compatriots' Cards (full name "mainland travel permit for taiwan residents"). Passengers with valid China travel permits can enter the country normally.
What is a foreigner's residence permit?
China Residence Permit is a residence certificate issued by domestic public security organs to foreigners who meet the requirements and need to stay in China for a long time (the residence period exceeds 180 days). During the validity period of the residence permit, the holder can stay in China and enter and leave the country many times with the residence permit. Foreigners' residence permits are generally divided into work, private affairs, reunion, study, journalists and so on. At present, only work, private affairs and reunion are allowed to go to China.
What's the difference between a foreigner's residence permit and a visa?
Generally, foreigners who need to live in China go to China with a visa, and after arriving in China, they go to the local public security organ with a visa to apply for a residence permit. For student visa and study residence permit, we can understand student visa as F 1 visa in the United States (called X 1 visa in China or study visa in Canada), and study residence permit as I20 visa in the United States or study permit in Canada. But unlike the United States, China's residence permit has both residence and entry functions. That is to say, when a student enters China for the first time with an X 1 visa and obtains a study and residence permit, theoretically, after leaving China, he can enter China directly with a valid study and residence permit, without having to apply for a student visa again. Obviously, the United States can't use I20 to enter the country directly.
What are the three residence permits allowed to go to China in the announcement?
Work residence permit, issued to people working in China;
Residence permit for personal affairs is issued to spouses, parents,/kloc-children under 8 years old, parents of foreign spouses who have been visiting relatives for a long time because of work and study, and persons who need to stay in China for other personal affairs;
Family reunion permits are issued to the families of China citizens who need to reunite in China, the families of foreigners who have permanent residency in China, and those who need to stay in China due to foster care and other reasons.
If my residence permit expires after March 28th, can I still go to China?
Of course. However, you need to apply for the corresponding visa again (relatively simple. Visa Z is required for work, visa S 1 for personal affairs and visa Q 1 for reunion.
If my residence permit expires before March 28th, can I still go to China?
No, you need to apply for a new visa. That is, you need to apply for a business or humanitarian visa from scratch (this is more difficult, and you can't simply apply for the corresponding Z, S 1 or Q 1 visa.
Can I go to China if my residence permit is still valid?
Of course. Of course, we should follow epidemic prevention measures like China citizens. After getting the negative report of double inspection at the place of departure, you should apply for HDC code (similar to WeChat health code.
abstract
To sum up, the current policy of foreigners going to China is as follows:
Ordinary 10 visas issued before the outbreak are temporarily invalid.
Diplomacy, official duties, courtesy and C visa to China will not be affected.
After March 28th, foreigners from most countries in the world can come to China with visas.
Foreigners from most countries in the world can go directly to China as long as they have valid residence permits for work, private affairs and reunion.
Foreigners in most countries in the world can apply for corresponding visas to China as long as they hold residence permits for work, private affairs and reunion that expire after March 28.
Foreigners from several countries (Britain, France, Italy, Belgium, Russia, Philippines, India, Ukraine and Bangladesh, etc. 165438+1You need a visa to go to China after October 3rd. None of the above three residence types can stay in China. Of course, in theory, holders of residence permits can go to other countries and other places to "whitewash" and go to China.
Of course, whether you can go to China depends on whether the local embassy or consulate has published the green code of HDC health, such as the recent DL289, AA 127. The Chinese embassy in the United States hardly issues HDC green codes to foreigners.
