Decision of the Standing Committee of the People's Congress of Ningxia Hui Autonomous Region on Amending the Regulations on Legal Aid in Ningxia Hui Autonomous Region (20 17)

One item is added as Item 7 of Article 8: "Handling judicial expertise". Two, the first paragraph of Article 9 "citizens with financial difficulties may apply for legal aid in any of the following circumstances" is amended as "citizens with financial difficulties may apply for legal aid".

Item 3 of the first paragraph of Article 9 is amended as "destitute dependents".

One item is added as Item 6 of Paragraph 1 of Article 9: "Persons who are receiving assistance from civil affairs departments due to illness, payment of basic education fees, emergencies and other factors".

The second paragraph of Article 9 is amended as: "The standard of citizens' financial difficulties shall be determined according to twice the minimum living standard of urban and rural residents in the autonomous region. "

The third paragraph of Article 9 is amended as: "If it is really necessary to expand the scope of recipients, the people's government of the autonomous region may make adjustments according to the actual situation". Three. Item 5 of Article 10 is amended as: "Demanding payment of labor remuneration, economic compensation or claiming the legitimate rights and interests of other laborers".

Nine items are added as items 8 to 16 of Article 10:

"(8) claiming civil rights and interests arising from acts of doing good deeds or protecting social public interests;

"(nine) the disabled, the elderly, minors and women request to confirm the right of inheritance or claim compensation for personal injury;

"(ten) because the legitimate rights and interests of ecological immigrants have been violated;

"(eleven) due to land acquisition and demolition, the transfer of land contractual management rights, the legitimate rights and interests of farmers have been violated;

"(twelve) due to enterprise restructuring, reorganization and merger, the legitimate rights and interests of employees have been infringed;

"(thirteen) the legitimate rights and interests of female workers during menstruation, pregnancy, childbirth and lactation are infringed;

"(fourteen) because of domestic violence, abandonment, abuse or spouse bigamy, cohabitation with others, gambling, drug abuse and other acts, advocate the dissolution of marriage;

"(fifteen) the employee brings an administrative reconsideration or administrative lawsuit for reasons such as work-related injury identification, work-related injury treatment or one to four levels of disability identification, occupational diseases, etc.;

"(16) military personnel and their families request preferential treatment, claim compensation for personal injury or property loss caused by personal injury cases such as medical treatment, traffic accidents and industrial accidents, claim civil rights and interests due to disputes over the sale contract of affordable housing and low-rent housing, as well as disputes over military marriage and family, agricultural product quality, land contract disputes, homestead disputes and insurance claims disputes". Four. Article 11 is amended as: "In criminal proceedings, citizens may apply for legal aid from legal aid institutions under any of the following circumstances:

"(1) The criminal suspect or defendant fails to entrust a defender due to financial difficulties or other reasons;

"(two) the victims of public prosecution cases and their legal representatives or close relatives, the parties to criminal incidental civil litigation and their legal representatives have not entrusted agents ad litem due to financial difficulties;

(3) One article is added as Article 12: "If a criminal suspect or defendant fails to appoint a defender under any of the following circumstances and the people's court, people's procuratorate or public security organ notifies the legal aid institution to appoint a defender, the legal aid institution shall appoint a lawyer to provide criminal defense for him:

"(1) Minors;

"(2) Blind, deaf or dumb;

"(3) mental patients who have not completely lost the ability to identify or control their own behavior;

"(4) Persons who may be sentenced to life imprisonment or death;

"(5) Other circumstances prescribed by law." 6. One article is added as Article 13: "If the defendant fails to appoint a defender under any of the following circumstances, and the people's court notifies the legal aid institution to appoint a defense, the legal aid institution shall appoint a lawyer to provide criminal defense for him:

"(a) * * * In the same criminal case, other defendants have entrusted defenders;

"(2) Cases with significant social impact;

"(3) Cases protested by people's procuratorates;

"(four) the defendant's behavior may not constitute a crime;

"(5) Other circumstances in which it is necessary to entrust a lawyer to provide defense." 7. Article 14 is renumbered as Article 15, and the second item of the first paragraph is amended as: "materials issued by the township (town) people's government, sub-district offices, county (city, district) civil affairs departments and other relevant competent departments that can prove the applicant's financial difficulties". Eight. Article 12 is renumbered as Article 16, and the first paragraph is amended as: "If an applicant meets any of the following circumstances, it is not necessary to provide proof of financial difficulties:

"(1) claiming the civil rights and interests arising from the act of being courageous or protecting the public interests;

"(two) enjoy the minimum living allowance for urban and rural residents;

"(three) enjoy the treatment of poor support;

"(four) due to illness, payment of basic education fees and emergencies and other factors leading to life difficulties are receiving assistance from the civil affairs department;

"(five) disabled and without a fixed source of income;

"(six) the elderly and no fixed source of life;

"(seven) migrant workers request payment of labor remuneration, compensation for work-related injuries and settlement of labor security, social insurance and labor contract disputes;

"(8) Family members of conscripts, family members of supply students, family members of soldiers who have fought and carried out major non-war military operations, martyrs, soldiers who died in the line of duty, and soldiers who died of illness apply for legal aid."

Delete the second paragraph.
