Chapter I General Provisions Article 1 In order to strengthen the management of urban planning, ensure the implementation of the overall planning of Jinan, and build Jinan into a modern socialist city with beautiful environment, clean civilization and prosperous economy as soon as possible, these measures are formulated in accordance with the relevant laws and regulations of the state and the relevant provisions of Shandong Province, and combined with the actual situation of this Municipality. Article 2 The overall urban planning of Jinan is an important basis for urban construction, development and planning management. Any unit or individual must strictly implement it and shall not change it without authorization. When the Municipal People's Government deems it necessary to change, it shall submit it to the Municipal People's Congress or its Standing Committee for examination and approval; Major changes involving the nature, scale and overall layout of the city must be reported to the State Council for approval according to legal procedures. Article 3 Urban planning and management shall adhere to the principles of unified planning, rational layout, comprehensive development and coordinated development, strictly control the scale of cities, rationally develop small and medium-sized towns, strengthen urban environmental protection, transform old urban areas in a planned and step-by-step manner, and protect the traditional features of cities. Article 4 The overall planning of Jinan shall be implemented under centralized leadership and unified management, and the power of examination and approval of urban planning management shall be concentrated in the municipal planning management department. The district planning administrative department is responsible for supervising and inspecting the implementation of district planning and the governance of illegal acts. Article 5 All units and individuals that build, expand, rebuild or renovate houses, civil air defense projects, public facilities, pipelines, railways, ports, airports, roads, bridges and culverts, parks, green spaces, flood control water systems, wells, fences and other structures within urban planning areas shall abide by these measures. Chapter II Management of Planning and Design Article 6 Urban planning and design must strictly implement the quota targets set by the state, and be linked with the urban economic and social development plan, relying on each other and jointly implemented. Seventh design units that undertake the planning and design tasks of this Municipality must carry out the design according to the "Jinan Master Plan" and the design points put forward by the municipal planning management department. Planning and design must be sent to the municipal planning administrative department for approval. Important planning and design should also be approved by the municipal planning and management department to the Municipal People's government. Planning and design changes should be re-submitted for approval, and construction changes can only be carried out after the projects related to design changes are approved. Eighth city construction engineering surveying and mapping must adopt the unified coordinate system, elevation and related surveying and mapping data provided by the municipal surveying and mapping management department. Chapter III Planning and Management of Construction Land Article 9 Land use in urban planning areas shall conform to urban planning. All construction projects must make rational use of and save land, make use of wasteland and inferior land as much as possible, occupy less cultivated land, strictly control the occupation of vegetable fields and lotus fields, and shall not occupy scenic woodlands, urban green spaces and green belts. Tenth units and individuals applying for the use of land shall be submitted for approval in accordance with the overall design, and shall not be used separately. Projects built by stages shall be requisitioned by stages and shall not be used after requisition. Eleventh units and individuals in the construction of new areas adjacent to the planned road, must be levied on the corresponding road width of half of the road land, and the demolition of buildings within its scope; Adjacent to the old road construction, it is necessary to dismantle the buildings within the scope of land acquisition (allocation) on one side of the planned road center line. Twelfth land units and individuals are not allowed to change the nature of land use, and should obey the unified adjustment and use of urban planning. Thirteenth construction units and individuals need temporary land, should be approved by the municipal planning and management department, approved by the municipal land management department. Permanent buildings (structures) shall not be built on temporary land. Temporary land use period is generally not more than two years. After the expiration of the use period, the land-using unit shall restore the original state of the land and handle the land recovery procedures in time. Article 14 The utilization of natural resources such as mineral deposits, water sources, forests, mountains and wasteland in a planned urban area must be approved by the municipal planning administrative department and reported to the relevant departments for approval, and then used or developed according to the designated location, scope and time limit. After the land is mined, the user shall carry out renovation and greening, and shall not occupy it by himself. If it is really necessary to use it for other purposes, it must be approved by the municipal planning administration department and reported to the municipal land administration department for examination and approval. Fifteenth urban construction requisition and allocation of land should be handled according to the following procedures:
1, the construction unit shall apply to the municipal planning administrative department for site selection with the relevant documents such as the construction plan and design task book of the year approved by the procedures prescribed by the state;
2, the city planning management department initially determine the location and scope of land use, put forward the planning and design points;
3. The construction unit entrusts the design department to carry out the general layout design according to the planning and design points, and applies to the land management department for land use planning;
4, issued by the municipal planning administrative department of construction land survey notice;
5, the municipal land management department for examination and approval for land requisition (allocation) procedures. Article 16 (Allocated) If the land has been idle for more than two years and has not applied for extension of use, the land use certificate shall be cancelled with the approval of the Municipal People's Government and another plan shall be made. Seventeenth construction projects using foreign capital, the construction unit shall, one month before the formal signing of the contract with the foreign party, submit the project feasibility study report and other relevant documents to the municipal planning administrative department for preliminary planning; After the contract is approved by the competent department, the procedures for construction land shall be handled according to the prescribed procedures. Chapter IV Planning and Management of Construction Projects Article 18 New construction, expansion and reconstruction projects must conform to urban planning. New large and medium-sized construction projects, in addition to public facilities that really need to be built in urban areas, should be arranged in suburban counties and suburban industrial areas. Units that require the entire construction system to move into urban areas should be strictly controlled. If it is really necessary to move in, it must be approved by the Municipal People's government and submitted to the provincial people's government for approval before applying for construction projects.
