Chapter I General Provisions Article 1 In order to effectively protect the legitimate rights and interests of the elderly, women and children, these Provisions are formulated in accordance with the Constitution of People's Republic of China (PRC) and relevant laws and regulations. Article 2 These Provisions shall apply to acts that infringe upon the lawful rights and interests of the elderly, women and children but are not serious enough for punishment. Article 3 All organizations and individuals have the obligation to safeguard the legitimate rights and interests of the elderly, women and children. Governments at all levels and relevant departments must find out the facts and deal with them severely for acts that infringe upon the legitimate rights and interests of the elderly, women and children, and must not engage in malpractices for personal gain or shirk responsibility. Do not belong to their own jurisdiction, should be promptly transferred to the relevant departments. If it is necessary to take emergency measures, it shall take emergency measures and properly handle them. Fourth governments at all levels or relevant departments shall commend or reward units and individuals that have made remarkable achievements in protecting the legitimate rights and interests of the elderly, women and children; Those who ignore the legitimate rights and interests of the elderly, women and children should be criticized and educated; For serious consequences caused by serious dereliction of duty and irresponsibility, the leaders of the unit and the person directly responsible shall be investigated for responsibility. Chapter II Protection of the lawful rights and interests of the elderly Article 5 It is forbidden for family members or others to infringe upon the lawful rights and interests of the elderly. One of the following illegal acts, depending on the seriousness of the case, shall be criticized and educated, administrative disciplinary action, public security punishment:

(1) Adult women and their spouses refuse to fulfill their obligations to support the elderly, refuse to pay alimony, refuse to provide help to the elderly and undertake housework;

(two) adult children against the wishes of the elderly, ignoring the economic affordability of the elderly, forcing the elderly to ask for financial assistance;

(3) Adult children or other people encroach on the lawful property of the elderly, and illegally deprive the elderly of their right to possess, use, benefit from and dispose of their lawful property, as well as their right to inheritance according to law;

(four) adult children or other people occupy the housing of the elderly and forcibly change the living conditions of the elderly;

(five) children or other people interfere with the freedom of marriage of the elderly, interfere with the widowed or divorced elderly remarried or remarried after the normal life;

(6) Adult children and their spouses abuse, starve to death, insult, slander or dislike the elderly, fail to provide timely treatment and care when they are sick, force the elderly to engage in heavy labor, or mentally torture them in other ways;

(seven) the staff of welfare institutions such as nursing homes, sanatoriums and apartments for the elderly hate, insult and slander the elderly, and embezzle, misappropriate and occupy the meals, welfare funds and materials of the elderly. Sixth, guarantee the right of retired elderly people to enjoy life security according to law. All units shall ensure that retired old people enjoy the political, economic, medical, convalescent, welfare and housing benefits stipulated by the state according to law. The medical care for the retired elderly should be based on the principle of being on the spot, nearby and convenient, properly arranged and effectively guaranteed. Retired people play their expertise and engage in various beneficial social activities within the scope permitted by laws and policies, and no organization or individual may interfere. Seventh to protect the rights of the elderly to obtain material assistance from the state and society according to law. Governments at all levels, enterprises and institutions, neighborhood offices and villagers' committees implement the "five guarantees" support system for orphans and the elderly. All walks of life should provide convenience and help for the material and spiritual life of the elderly in their later years. Adult children who refuse to support the elderly shall be adopted by nursing homes and nursing homes with the approval of the civil affairs department, but the unit where the adult children belong and the township government (street office) shall impose a fine or administrative disciplinary action on those who have the obligation to support them, and order them to bear all the living expenses of the elderly during the "five guarantees" support period. Refuses to implement, the civil affairs department may apply to the people's court for compulsory execution. Chapter III Protection of Women's Legal Rights and Interests Article 8 Women enjoy equal rights with men in political, economic, cultural, social and family life. In recruitment, enrollment, recruitment, promotion, job transfer, graduation distribution, bonus distribution, housing distribution, homestead division, lease contract, etc. No unit may stipulate additional conditions that discriminate against women. Offenders should be held accountable for the unit leaders and the persons directly responsible.

Except for special jobs and posts, women's employment is not restricted by height, marital status or other reasons. In the employment system, the unit that implements the lease contract should guarantee the labor rights of female employees and implement equal pay for equal work.

All enterprises and institutions should conscientiously implement the state regulations on labor protection and women's health care, and give appropriate care to women during menstruation, pregnancy, puerperium, lactation and menopause. The wages and bonuses of female employees during the puerperium remain unchanged. The wages of female employees who enjoy breastfeeding leave according to regulations shall be borne by both husband and wife; If the man works in the army, other places or organs, the woman's unit shall bear all the wages of the female employees who take breastfeeding leave. Article 9 Protect women's personal rights according to law. Family members and others are prohibited from infringing on women's personal rights. One of the following acts of infringement, depending on the seriousness of the case, shall be criticized and educated, ordered to compensate for economic losses, administrative disciplinary action, public security punishment, reeducation through labor and fines:

(a) Discrimination, abuse, humiliation and torture against women;

(two) do not like blind, deaf and dumb women or women suffering from mental illness or other serious diseases;

(3) publicly insulting or slandering women, damaging their reputation, honor, personality and person, or playing with women by deception;

(4) luring and corrupting women with obscene articles, providing prostitution places, introducing prostitutes, or inciting women to go out blindly by means of deception or seduction;

(5) Deceiving and persecuting women by using feudal superstitions, or insulting and molesting women by taking advantage of their authority, upbringing and affiliation;

(six) without the permission of the relevant departments, taking out intrauterine devices for women, checking the sex of the fetus, or abusing baby girls or infertile women;

(seven) forcing women to engage in street art activities harmful to physical and mental health.
