Provisions of Zhongshan Municipality on Safety Management of Spontaneous Mass Gathering Activities
If there are other provisions in the Law of People's Republic of China (PRC) on Assemblies, Demonstrations and Demonstrations, those provisions shall prevail. Article 3 The term "spontaneous gathering activities of the masses" as mentioned in these Provisions refers to the spontaneous gathering activities of unspecified people in public gathering places.
The public places where people gather as mentioned in these Provisions refer to the following places:
(a) scenic spots (spots), parks, passenger stations, passenger terminals, rail transit stations, exhibition venues, stadiums, cultural and entertainment venues, shopping malls and markets;
(2) Hospitals, schools and places for religious activities;
(3) Public places where other people often gather. Article 4 The municipal government shall strengthen the leadership over the safety management of spontaneous mass gathering activities, and promote the information sharing and emergency linkage between various departments and the town government (administrative committee, street offices). Article 5 The town government (administrative committee, sub-district offices) is responsible for organizing and coordinating the safety management of spontaneous mass gathering activities in accordance with the principle of "hierarchical management and territoriality first", establishing an overall coordination mechanism, and coordinating and urging relevant working institutions to perform safety management duties according to law.
City public security, safety supervision, housing and urban construction, transportation, tourism, health and family planning, education and sports, culture, radio and television, press and publication, civil affairs, ethnic and religious, food and drug supervision, urban management and law enforcement and other relevant competent departments shall, according to their respective functions and duties, be responsible for safety management and emergency response related to spontaneous gathering activities of the masses.
The town government (administrative committee, sub-district offices) and relevant competent departments shall strengthen information communication and resource sharing, and monitor, prevent, control and eliminate potential safety hazards related to spontaneous mass gathering activities. Chapter II Safety Responsibility Article 6 Managers of public places where people gather shall perform the following duties:
(a) to ensure that the venues and facilities meet the national, provincial and municipal safety standards and regulations;
(two) to ensure that fire facilities, monitoring equipment, emergency broadcasting, emergency lighting, evacuation lights and other facilities and equipment comply with the provisions of laws, regulations and technical standards, and regular maintenance to ensure their normal operation;
(3) Significantly mark the safe evacuation passages and routes to ensure that the evacuation passages and safety exits are unobstructed;
(four) to take corresponding safety precautions, according to the need to equip security personnel, formulate emergency plans, and carry out emergency drills in combination with the actual situation;
(5) If the number of people gathered in public places exceeds the safe capacity, report to the local town government (administrative committee, sub-district office) in time, and actively do a good job in maintaining order at the scene to prevent emergencies;
(six) after the emergency, immediately report to the relevant competent departments and start the emergency plan, and cooperate with the relevant competent departments to organize emergency rescue work;
(seven) other safety management duties as prescribed by laws and regulations. Seventh people who participate in the spontaneous gathering activities of the masses shall abide by the following provisions:
(a) abide by laws, regulations and public order and good customs, and shall not interfere with social order, affect social order, and shall not harm the legitimate rights and interests of the state, the collective and other citizens;
(2) Abide by the management system of activity places, and shall not carry explosive, flammable, radioactive, toxic or corrosive dangerous goods or illegally carry guns, ammunition or control devices;
(3) Do not display insulting slogans or banners, and do not place or litter. Disturbing the order of spontaneous gathering activities of the masses;
(4) Abide by safety precautions, obey the guidance and command of on-site staff, and cooperate with relevant competent departments to deal with emergencies;
(5) Other regulations that personnel participating in spontaneous mass gathering activities shall abide by. Article 8 The town government (administrative committee, street offices) shall gradually bring public places such as squares and roads where people often gather into the corresponding monitoring network; Set up electronic display screens, speakers and other safety warning facilities in public places where people often gather, such as squares and roads, and issue early warning information and other early warning information; Organize regular publicity to popularize safety knowledge related to crowd gathering.
The town government (administrative committee, street offices) shall organize relevant working institutions to regularly conduct safety inspections in public places where people gather, and make safety inspection records. If a potential safety hazard is found, it shall be ordered to make rectification according to law.
In case of major holidays, the town government (administrative committee, sub-district offices) should strengthen safety risk monitoring, organize public security, safety supervision, housing and urban construction, transportation, tourism, health and family planning, education and sports, culture, radio, film and television, press and publication and other working institutions to carry out joint inspections according to safety needs, and urge managers of public places where people gather to implement safety measures according to law to prevent and deal with emergencies.
