Interim Provisions of Henan Province on the Birth of the Second Child in Rural One-Child Families

Article 1 In order to further improve the family planning policy, promote the in-depth development of family planning work, and effectively control population growth, these Provisions are formulated in accordance with the relevant policies of the state and the actual situation of our province. Article 2 On the premise of insisting that a couple can only have one child, and advocating late marriage and late childbearing, fewer children and healthier children, I voluntarily apply for a rural one-child family (both mother and daughter are in agricultural registered permanent residence) with real difficulties, and can take care of the second child. After approval, it is forbidden to have a third child. Article 3 If an administrative village meets the following conditions, it shall be applied by the villagers' committee, audited by the township (town) people's government and approved by the people's government of the county (including the city and municipal district, the same below), and the one-child family may be arranged to have a second child in a planned way:

First, there is no unplanned birth in the village for more than one year;

Two, married couples of childbearing age, in addition to contraindications, the birth of a child has been on the ring, the birth of a second child has been ligated;

Third, leaders attach importance to it, improve the organization and system, and implement the family planning policy well. Article 4 The interval between the birth of a second child in an administrative village and the birth of a second child approved by an only-daughter household is: the mother is 29 years old and the girl is 5 years old.

One-child families who want to have a second child should apply for it themselves. The villagers' committee shall verify the situation, organize mass appraisal, post it, review it by the township (town) people's government, and report it to the county family planning commission for approval. Fifth rural couples who are approved to have a second child should sign a contract with the villagers' committee and report it to the township (town) people's government for the record. The contents of the contract include: after giving birth to a second child, one of the husband and wife must be ligated within six months to ensure that they will not give birth to a third child, and pay the deposit according to the regulations. After the contract is signed, the birth certificate will be issued, and the one-child honor certificate and the one-child health care fee will be recovered. The contract style shall be uniformly formulated by the Provincial Family Planning Commission.

According to the contract, if one of the spouses is ligated on schedule, the deposit will be refunded in full; Those who fail to be ligated on schedule will be ordered to be ligated and will be fined three to five times. The deposit standard is determined by the county people's government. Article 6 The township (town) people's government shall commend or reward the one-child households that comply with the provisions of Article 4 and insist on having only one child for life. Seventh the following one-child households do not take care of the birth of a second child:

One of the husband and wife is a formal employee of a state organ, a people's organization, an enterprise or institution (including a contract worker with a registered permanent residence in rural areas), a temporary worker in the plan, and a private teacher in the plan;

First, resort to deceit, defrauding the administrative village one-child households to give birth to a second child, once discovered, immediately stop, the county people's government is responsible for investigating the responsibility of the relevant leaders and parties;

Second, the administrative village that approved the arrangement for the one-child family to give birth to a second child, when the unplanned birth was found, the township (town) people's government announced that it would stop, carry out rectification, and re-submit it for approval after meeting the conditions;

Three, in violation of the provisions of article fourth, article seventh, by the unit or the villagers' committee according to the family planning;

Four, the relationship between households and grain in rural areas to recruit cadres, temporary workers, private teachers, contract workers within the plan, automatically quit their jobs, back to the countryside to apply for approval to have a second child, no unit may recruit. Ninth counties to arrange the rural one-child families to have a second child index, shall not exceed the annual population plan. The population plan formulated by each county shall be submitted to the provincial municipal people's government and the regional administrative office for approval and implementation, and shall be submitted to the provincial family planning commission for the record. Tenth the Provincial Family Planning Commission shall be responsible for the interpretation of these provisions. Article 11 These Provisions shall come into force as of the date of promulgation. In the past, the provisions on taking care of the second child of rural one-child households were inconsistent with these provisions, and these provisions shall prevail.
