Article 47 The bid-winning candidates recommended by the bid evaluation committee in the written bid evaluation report shall be limited to one to three people, and the order of arrangement shall be indicated. The tenderer shall accept the bid-winning candidates recommended by the bid evaluation committee and shall not determine the bid-winning candidate other than the bid-winning candidates recommended by the bid evaluation committee.

After the bid evaluation committee submits a written bid evaluation report, the tenderer shall generally determine the winning bidder within fifteen days, but at the latest thirty working days before the end of the bid validity period.

Article 48 For projects invested with state-owned funds or financed by the state, the tenderer shall determine the first-ranked candidate as the winning bidder. If the first-ranked bid-winning candidate gives up the bid, claims to be unable to perform the contract due to force majeure, or the bidding documents stipulate that a performance bond should be submitted but fails to submit it within the specified period, the tenderer may determine the second-ranked bid-winning candidate as the winning bidder.

If the second-ranked bid-winning candidate is unable to sign the contract due to the same reasons specified in the preceding paragraph, the tenderer may determine the third-ranked bid-winning candidate as the successful bidder.

The tenderer may authorize the bid evaluation committee to directly determine the winning bidder.

If the State Council has other provisions on the determination of the winning bidder, such provisions shall prevail.

Article 49 The tenderer shall not make any request to the winning bidder to lower the quotation, increase the amount of accessories or after-sales services, or make any other request that exceeds the provisions of the bidding documents and goes against the will of the winning bidder, as a basis for issuing a bid winning notice and Conditions for signing the contract.

Article 50 The notice of winning the bid shall have the legal effect of construction on the tenderer and the winning bidder. After the bid winning notice is issued, if the tenderer changes the bid winning result, or if the winning bidder abandons the winning project, he shall bear legal liability in accordance with the law.

The bid winning notice shall be issued by the tenderer or its bidding agency may be entrusted to issue it.

Article 51 The tenderer and the winning bidder shall conclude a written contract in accordance with the bidding documents and the winning bidder's bidding documents within thirty days from the date of issuance of the bid winning notice. The tenderer and the winning bidder shall not enter into other agreements that deviate from the substantive content of the contract.

If the bidding documents require the winning bidder to submit a performance bond or other form of performance guarantee, the winning bidder shall submit it; if it refuses to submit, it will be deemed to have given up the bid. If the tenderer requires the successful bidder to provide a performance bond or other form of performance guarantee, the tenderer shall also provide the successful bidder with a payment guarantee for the goods.

The amount of the performance bond is generally within 10% of the winning contract price, and the tenderer is not allowed to increase the performance bond without authorization.

Article 52 Within five working days after the tenderer signs a contract with the winning bidder, the bid deposit shall be returned to the winning bidder and the unsuccessful bidder in one go.

Article 53 For engineering construction projects that must be approved, the contract price of goods shall be controlled within the approved investment budget range; if it is indeed necessary to exceed the scope, it shall be reported to the original project approval department before the winning contract is signed. Review agreed. The project approval department shall make a timely decision to approve or disapprove based on the actual situation of the bidding; if the project approval department disapproves, the tenderer shall balance the excess budget on its own.

Article 54 For projects that require goods bidding according to law, the tenderer shall submit a written report on the bidding situation to the relevant administrative supervision department within 15 days from the date the successful bidder is determined.

The written report referred to in the preceding paragraph shall at least include the following contents:
