Regulations of Jilin Province on Surveying and Mapping Management

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the Surveying and Mapping Law of People's Republic of China (PRC) (hereinafter referred to as the "Surveying and Mapping Law") and relevant laws and regulations, and in combination with the actual situation of our province, in order to ensure the smooth development of surveying and mapping and promote surveying and mapping to serve economic construction and scientific research. Second all units and individuals engaged in surveying and mapping activities within the territory of this province must abide by these regulations. Article 3 The Bureau of Surveying and Mapping of Jilin Province is the competent department of surveying and mapping work of the provincial people's government, and is responsible for the administration of surveying and mapping in the whole province.

City, state and county (city) people's government departments in charge of surveying and mapping work, responsible for the administrative area of Surveying and mapping management.

The relevant departments of the people's governments at or above the county level shall manage the surveying and mapping work of their own departments in accordance with the division of responsibilities, and accept the professional guidance of the competent departments of surveying and mapping work at the same level.

The people's governments of townships and towns are responsible for the protection of surveying markers. Article 4 People's governments at all levels shall encourage the strengthening of scientific and technological research on surveying and mapping, adopt advanced technologies and equipment, improve the scientific and technological level of surveying and mapping and the production capacity of surveying and mapping, and reward units and individuals that have made remarkable achievements. Fifth relevant units and individuals shall provide convenience for surveying and mapping work, and shall not hinder or obstruct the surveying and mapping personnel to carry out surveying and mapping activities according to law. Chapter II Surveying and Mapping Datum and Surveying and Mapping System Article 6 Surveying and mapping projects implemented within the administrative area of this province shall adopt the unified national surveying and mapping datum and surveying and mapping system, as well as the national standards and industry standards of surveying and mapping technology. Seventh before the implementation of these regulations, the surveying and mapping results that did not adopt the national unified surveying and mapping benchmark and surveying and mapping system shall be explained to the users by the providers when they are provided for use, and the surveying and mapping results shall be indicated. Article 8 Within the administrative region of this province, a relatively independent plane coordinate system can be established in the same city or local area. In cities and local areas where there are more than two relatively independent plane coordinate systems, the local surveying and mapping authorities should take measures to switch to relatively independent plane coordinate systems.

Surveying and mapping of foreign-related development zones, cooperation zones, bonded zones and foreign-related construction projects must adopt a relatively independent plane coordinate system.

Large and medium-sized cities and large-scale construction projects to establish a relatively independent plane coordinate system shall be audited by the provincial competent department of Surveying and mapping, and after the audit, the examination and approval and filing procedures shall be performed in accordance with the relevant provisions of the Surveying and Mapping Law. Chapter III Surveying and Mapping Planning and Its Implementation Article 9 The competent department of surveying and mapping of the province may, in conjunction with relevant departments, formulate plans for basic surveying and mapping and other major surveying and mapping projects in local areas of the province according to needs, and organize the implementation after reporting to the competent department of surveying and mapping administration of the State Council for the record.

The relevant departments of the provincial people's government and the units directly under the central government in this province can prepare the professional surveying and mapping planning of their own departments, and organize the implementation after being submitted to the competent surveying and mapping department of the province for the record. Tenth provincial departments of Surveying and mapping shall, jointly with the provincial land management departments and other relevant departments, prepare a cadastral surveying and mapping plan, and the provincial departments of Surveying and mapping shall organize and coordinate the cadastral surveying and mapping work according to the plan. Eleventh units undertaking surveying and mapping tasks (hereinafter referred to as surveying and mapping units) must have qualified technical personnel, instruments and equipment and quality assurance system that are suitable for the surveying and mapping work they are engaged in, and the provincial competent department of surveying and mapping shall conduct qualification examination. Those who pass the examination shall be issued with a qualification certificate for surveying and mapping. After obtaining the "Surveying and Mapping Qualification Certificate", we can undertake surveying and mapping tasks.

Units directly under the central government of this province shall undertake surveying and mapping tasks outside the business scope of this department, and shall also go through the formalities for surveying and mapping qualification examination in accordance with the provisions of the preceding paragraph of this article.

The specific measures for surveying and mapping qualification examination shall be formulated separately by the provincial people's government. Twelfth surveying and mapping units to undertake surveying and mapping tasks, shall not exceed the "Surveying and mapping qualification certificate" approved business scope. Surveying and mapping units to terminate the surveying and mapping business, should promptly notify the provincial competent department of Surveying and mapping work, and return the "Surveying and mapping qualification certificate". Thirteenth no unit or individual may forge, alter, lend or transfer the qualification certificate of Surveying and mapping. Fourteenth units undertaking surveying and mapping tasks in this province shall register surveying and mapping tasks with the competent departments of surveying and mapping at or above the county level before the survey. The scope and method of surveying and mapping task registration shall be implemented in accordance with the relevant provisions of the provincial people's government. Fifteenth surveying and mapping personnel shall hold surveying and mapping work certificates when surveying and mapping. Sixteenth surveying and mapping units in the implementation of surveying and mapping, must use qualified surveying and mapping measuring instruments, and strictly implement the national and provincial regulations on measuring instruments. Seventeenth surveying and mapping units shall maintain the order of the surveying and mapping market, and shall not take the following unfair competition means:

(a) unauthorized use of other surveying and mapping units to undertake surveying and mapping tasks;

(two) accepting bribes to undertake surveying and mapping tasks;

(three) for the purpose of crowding out competitors, undertake surveying and mapping tasks at a price lower than the cost;

(four) fabricating and spreading false facts, damaging the professional reputation of competitors;

(5) Bidders collude in bidding to raise the bid price or lower the bid price. Bidders collude with each other to crowd out the fair competition of competitors. Chapter IV Surveying and Mapping of Boundaries Article 18 Surveying and mapping of administrative boundaries of cities, prefectures and counties (cities) shall be organized and implemented by the provincial competent department of surveying and mapping.
