Regulations of Zibo Municipality on the Protection and Management of Mengshan Reservoir (revised on 20 18)

Chapter I General Provisions Article 1 In order to strengthen the protection and management of Mengshan Reservoir, prevent water pollution and give full play to the reservoir's flood control, water supply and ecological functions, these Regulations are formulated in accordance with the provisions of People's Republic of China (PRC) Water Law and other laws and regulations, combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the protection and management of Mengshan Reservoir (hereinafter referred to as the Reservoir), engineering facilities, water bodies and catchments. Article 3 The protection and management of reservoirs shall adhere to the principles of overall planning, comprehensive utilization, combination of prevention and control, and simultaneous protection and development, so as to realize the sustainable utilization of reservoir water sources. Fourth municipal water administrative department is responsible for the supervision and guidance of reservoir protection and management; Wenchang Lake Tourism Resort Management Committee (hereinafter referred to as Wenchang Lake Management Committee) is responsible for the protection and management of the reservoir; Mengshan Reservoir Management Organization undertakes the responsibility of reservoir protection and management.

Zhoucun, Zichuan, Boshan, Zhangdian District People's Government, Wenchang Lake District Management Committee and relevant administrative departments shall, according to their respective functions and duties, do a good job in the protection and management of reservoirs. Article 5 The reservoir water body shall be protected according to the national Class III standard for surface water. Article 6 The municipal and relevant district people's governments and Wenchang Lake District Administrative Committee shall incorporate reservoir protection into the national economic and social development plan, cultivate vegetation, conserve water sources, protect water quality and implement effective management. Article 7 The reservoir water source and its affiliated engineering facilities belong to the state and are protected by law.

Any unit or individual has the obligation to protect the reservoir water source and its ancillary facilities, and has the right to report the acts of occupying or destroying the reservoir project and its ancillary facilities.

Units and individuals that have made remarkable achievements in reservoir protection and management shall be commended and rewarded by the Municipal People's Government. Chapter II Protection and Management Article 8 The scope of reservoir protection and management is:

(a) the back slope and toe of the reservoir dam (referring to the toe and toe of the back slope) extend 200 meters as the management scope, and the area 200 meters to 500 meters outside the toe of the dam is the protection scope;

(two) the management scope is within 50 meters outside the edge of the reservoir spillway, and the area from 50 meters outside the edge to 100 meters is the protection scope;

(three) the dam slope, dam crest pavement and self-built flood control highway pavement of the reservoir are the management scope;

(four) the scope of management is within four meters outside the foot of the slope on both sides of the main canal of the reservoir, and the area from four meters to fifteen meters outside the foot of the slope is the scope of protection;

(five) the management scope is within two meters on both sides of the outer edge of the water pipeline, and the area from two meters to five meters on both sides of the outer edge is the protection scope;

(six) the scope of land ownership of other reservoir management facilities is the scope of management, and the scope of protection is within five meters outside the scope of land ownership;

(seven) the waters and land within the reservoir flood control water level line are the management scope, and the river basins from the reservoir flood control water level line to Fanyang River and Baini River River are the protection scope. Article 9 The following acts are prohibited within the scope of reservoir management:

(a) the construction of buildings and structures that hinder flood discharge;

(2) occupying the reservoir capacity;

(3) Blasting, drilling wells, quarrying, sand mining, earth borrowing, pond digging, planting and grazing;

(four) occupation and destruction of water projects, hydrological observation facilities and other equipment and facilities;

(five) non reservoir management personnel to open and close the reservoir engineering facilities;

(six) tracked vehicles and vehicles with a load of more than ten tons are driving on the dam crest pavement and the spillway bridge;

(seven) the establishment of oil depots and chemical warehouses;

(eight) dumping, piling up garbage, muck and other wastes, planting trees and tall crops that hinder flood discharge;

(nine) set up sewage outlets to discharge pollutants into reservoirs and channels;

(ten) cleaning vehicles and equipment with pollutants in the water;

(eleven) poisonous fish, fried fish, electric fish, livestock and poultry breeding, cage fish farming, hunting wild waterfowl, unauthorized fishing and other activities;

(twelve) other acts prohibited by laws and regulations. Article 10 Within the scope of reservoir protection specified in Items 1, 2, 4, 5 and 6 of Article 8 of these Regulations, it is prohibited to engage in activities such as blasting, drilling wells, quarrying, sand mining and earth borrowing. Affecting the operation of water conservancy projects and endangering the safety of water conservancy projects. Eleventh in the provisions of article eighth of this Ordinance within the scope of reservoir protection, prohibit the following acts:

(a) new construction, renovation and expansion projects that directly discharge pollutants into the river or indirectly discharge pollutants into the river that exceed the standard;

(two) new construction, renovation and expansion of construction projects that have serious pollution to water bodies and the environment;

(3) Dumping urban garbage, industrial waste residue, waste water and other wastes into rivers;

(4) Setting up warehouses for toxic and harmful chemicals;

(five) the destruction of revetment forest, water conservation vegetation;

(6) moving or destroying boundary markers, boundary markers and protective facilities. Twelfth Wenchang Lake District Management Committee and the relevant district people's governments shall strengthen the construction of environmental protection infrastructure in reservoir protection areas, equip with sewage and garbage collection facilities, and carry out centralized treatment. Article 13 The water administrative department of Wenchang Lake Management Committee shall conduct daily monitoring on the water quantity and water quality of the reservoir, and evaluate the water quality of the reservoir jointly with the administrative department of environmental protection.
