Introduction to the seasonal workers industry in France

Summer is coming, and many international students have already started looking for summer jobs, hoping to increase their experience and improve their financial situation. Seasonal workers’ rights and interests

1. Definition

Generally speaking, summer jobs fall into the category of seasonal workers. Seasonal work is repetitive work performed at approximately the same time each year as the seasons or collective lifestyle changes. From a legal perspective, such job changes are regular, predictable, cyclical, and will not change according to the wishes of the employer and employee. Employers can sign limited-term contracts (CDD, see Labor Law Article L.122-1-1) or agency position contracts (see Labor Law Article L.124-2-1) with seasonal workers.

Employers who recruit seasonal workers need to meet one of the following conditions:

Belong to enterprises that only operate business in specific seasons (such as ski stations, mountain safety guards, etc.)

?Belongs to enterprises that are open year-round, but their business volume will increase significantly in specific seasons (such as tourism units that are greatly affected by the peak vacation period, etc.).

2. Notes

There is no limit on the length of time an employer can hire the same seasonal worker. An employee can work with the same employer as a seasonal worker for life, but this working relationship that continues every year cannot be converted from a limited-term contract to an unlimited-term contract. And if you want to maintain long-term cooperation, you must comply with the following two regulations:

?The same seasonal worker shall not work for the entire working season. For example, if the working period of a year is 8 to 9 months, and all the work during the period cannot be completed by one employee, the employer can hire seasonal worker A for the first 6 months, and hire seasonal worker A for the next 2 or 3 months. ?Contracts for the employment of seasonal workers should not contain renewal clauses, otherwise they will be considered open-ended contracts.

In addition, there is a provision regarding the employment of unemployed persons as seasonal workers: at the end of a limited-term contract, the employer shall not deduct instability compensation from the employee's remuneration (see Labor Code Article L.122 -3-4).

3. Work contract and remuneration

The labor contract signed by seasonal workers should include the following contents:

?Applicable labor agreement

Seasonal workers enjoy paid leave, social medical insurance and work-related injury insurance. Minors must obtain parental permission to engage in seasonal work. Teenagers aged 14 to 16 are even required to obtain labor supervision.

Regarding the labor remuneration of seasonal workers:

? It shall not be less than the minimum hourly wage for adults (SMIC horaire)

? If the employee is between 17 and 18 years old If the employee is under 17 years of age, the remuneration shall not be less than 90% of the minimum hourly wage for adults

If the employee is under 17 years of age, the remuneration shall not be less than 80% of the minimum hourly wage for adults

Note: France’s current gross minimum wage for adults (SMIC) is €1,217.88 per month (35 hours per week), or €8.03 per hour. The adjusted minimum wage is generally announced at the end of June or early July each year.

1. Hotel and catering industry

Seasonal jobs available in this industry include: waiters, bartenders, cooks, dishwashers, kitchen managers, sandwich sellers, receptionists, bellhops, maintenance workers, and more.

Candidates who have received relevant professional training will undoubtedly have a strong advantage. But many hotels and restaurants also accept young people with no experience, as long as they have a positive attitude and work hard.

2. Tourism and entertainment industry
