Measures for the maintenance and management of rural roads in Qinghai Province

Chapter I General Provisions Article 1 In order to strengthen the management of rural highway maintenance, realize highway maintenance, ensure the integrity, safety and smoothness of rural roads, and promote the sustainable development of rural economy and society, these measures are formulated in accordance with the Highway Law of People's Republic of China (PRC) and the relevant provisions of the state, combined with the actual situation of this province. Article 2 These Measures shall apply to the maintenance and management of rural roads within the administrative area of this province.

The rural roads mentioned in these Measures refer to county roads, township roads and village roads.

The naming and numbering of county roads, township roads and village roads shall be determined by the provincial transportation department in accordance with the relevant provisions of the the State Council transportation department. Third rural highway maintenance management follows the principles of overall planning, grading responsibility, county-oriented, township (town) village cooperation, management according to law, and ensuring smooth flow. Article 4 Rural highways, land used for highways and their ancillary facilities shall be protected by law. No unit or individual may damage, occupy or hinder maintenance and construction operations.

Citizens and organizations have the right to report and accuse rural roads, land for roads, ancillary facilities and other acts that affect the safety of rural roads. Chapter II Responsibility for Maintenance and Management Article 5 The people's governments of provinces and prefectures (cities and prefectures) shall strengthen their leadership over the maintenance and management of rural roads.

The provincial transportation department is in charge of the maintenance and management of rural roads in the province, and its subordinate highway management agencies are specifically responsible for supervising and guiding the maintenance and management of rural roads in the province. State (prefecture, city) transportation departments are responsible for the maintenance and management of rural roads within their respective administrative areas.

The departments of development and reform, finance, land and resources, public security, housing and urban construction, water conservancy, agriculture and animal husbandry, forestry and environmental protection of the people's governments at or above the county level shall, according to their respective functions and duties, do a good job in the maintenance and management of rural roads. Article 6 The people's government at the county level is the main body responsible for the maintenance and management of rural roads within its administrative area, and shall establish and improve the management system of rural road maintenance. Organize and lead relevant departments and township (town) people's governments to do a good job in rural highway maintenance and management.

The township (town) people's government, under the leadership of the county people's government, is responsible for the daily maintenance and management of township roads and village roads within their respective administrative areas. Seventh transportation departments at the county level shall be responsible for the maintenance and management of rural roads within their respective administrative areas, and perform the following duties:

(a) responsible for the preparation and supervision of the implementation of rural highway maintenance plan;

(two) responsible for the management and use of rural highway maintenance funds, and announced to the public;

(three) supervision and inspection, assessment of rural highway maintenance quality;

(four) to guide the township (town) people's government to maintain township roads and village roads;

(five) the establishment of rural highway maintenance basic data files;

(six) responsible for rural road management. Article 8 The village (animal husbandry) committee shall, under the guidance of the township (town) people's government and in accordance with the principle of villagers' voluntary and democratic decision-making, organize farmers and herdsmen to do a good job in the maintenance and management of roads in their villages. Chapter III Maintenance Funds Article 9 The people's governments at or above the county level shall establish a stable mechanism for raising and disbursing maintenance funds with government input as the main factor, bring rural road maintenance funds into the fiscal budget at the corresponding level, and gradually increase rural road maintenance funds according to the growth of fiscal revenue and the needs of rural road development.

Encourage all sectors of society to invest and support participation in rural road maintenance. Tenth transportation departments at the county level shall, according to the basic data and road conditions of rural roads within their respective administrative areas, prepare the annual rural road maintenance plan and report it to the provincial transportation departments step by step.

The provincial department in charge of transportation is responsible for examining and approving the annual rural road maintenance plan of each region, and jointly with the provincial financial department, according to the annual rural road maintenance plan of each region, make overall arrangements for rural road maintenance subsidy funds according to the determined proportion.

The Provincial Department of Transportation shall establish and improve the database of rural highway maintenance in the whole province. Eleventh national and provincial financial subsidies for rural road maintenance funds, according to the annual rural road maintenance plan, in accordance with the relevant provisions of the timely and full disbursement.

Rural road maintenance funds raised by local (state, city) and county-level people's governments in accordance with the prescribed proportion shall be allocated in full and on time by the financial department in conjunction with the transportation department at the same level according to the annual rural road maintenance plan. Twelfth rural highway maintenance funds should be earmarked, and no unit or individual may intercept, occupy or misappropriate them.

The transportation department at the county level shall establish a system for the management and use of maintenance funds, improve the efficiency of the use of funds, publicize the subsidy standards for maintenance funds to the people along the line, and report the annual use of funds to the provincial transportation department for the record.

Finance, auditing and supervision departments shall supervise and inspect the use of rural highway maintenance funds. Chapter IV Maintenance of Rural Roads Article 13 Rural roads shall be maintained in accordance with national and provincial technical specifications and operating procedures for highway maintenance, and the subgrade slope shall be kept stable, the road surface shall be flat, the shoulders shall be clean and tidy, the drainage shall be smooth, and the bridge and culvert structures shall be in good condition. Fourteenth large and medium-sized rural roads and roads, bridges and other highly technical maintenance projects, the county-level transportation departments in accordance with the road sections or regions through bidding and other means to select professional maintenance units. Fifteenth county roads shall be maintained by professional maintenance units organized by the transportation departments at the county level, and maintenance contracts shall be signed; The township (town) people's government shall organize farmers and herdsmen along the highway to carry out daily maintenance through employment, entrustment and contracting, and sign a maintenance contract; The village (animal husbandry) committee shall organize farmers and herdsmen to carry out daily maintenance by means of segmented contract maintenance and centralized maintenance by the masses; The village (animal husbandry) committee shall organize farmers and herdsmen to maintain the roads in the village in a way that conforms to the local conditions. Outstanding achievements in maintenance work shall be rewarded by the people's government at the county level.

Units and individuals along rural roads shall support and cooperate with rural road maintenance.
