Interim Provisions of Ningbo Municipality on Basic Medical Insurance for Urban Workers (2002)

Chapter I General Provisions Article 1 In order to ensure the basic medical care for urban workers and establish and improve the basic medical insurance system for employees, these Provisions are formulated in accordance with the relevant provisions of the state and the province and in combination with the actual situation of this Municipality. Article 2 These Provisions shall apply to all kinds of urban enterprises, state organs, institutions, social organizations, private non-enterprise units, individual economic organizations (hereinafter referred to as employers) and their employees within the administrative area of this Municipality.

Freelancers shall participate in basic medical insurance in accordance with the relevant provisions of this Municipality.

Unemployed workers can participate in basic medical insurance or participate in hospital medical co-ordination alone in accordance with the relevant provisions of this Municipality. Article 3 The following principles must be adhered to in establishing the basic medical insurance system for employees:

(a) the basic medical insurance financing and security level should be adapted to the local economic and social development level;

(two) all employers and their employees in cities and towns should participate in the basic medical insurance and implement territorial management;

(three) the basic medical insurance premium shall be borne by both the employer and the employee;

(four) the basic medical insurance fund to implement the combination of social pooling and individual accounts. Fourth city and county (city), the district administrative department of labor security in charge of basic medical insurance. Medical insurance agencies under the administrative department of labor security are specifically responsible for the daily management of basic medical insurance.

Departments of health, finance, taxation, price control and drug supervision shall, in accordance with their respective functions and duties, coordinate the implementation of these Provisions. Article 5 The basic medical insurance shall be implemented step by step at the municipal level as a whole.

City level (including Ningbo Economic and Technological Development Zone, Ningbo Bonded Zone, Municipal Science and Technology Park, Daxie Development Zone) and Haishu District, jiangdong district, Jiangbei District, zhenhai district and Beilun District are integrated into the same basic medical insurance co-ordination unit, and unified management is implemented for the basic medical insurance fund and medical assistance for major diseases.

The basic medical insurance for counties (cities) and Yinzhou District shall be separately coordinated by the local people's government for the time being. Chapter II Collection and Management of Basic Medical Insurance Premium Article 6 The basic medical insurance premium shall be paid by the employing units and employees on the job on a monthly basis in accordance with the following provisions, and the government shall give appropriate subsidies:

(1) The employer shall pay the basic medical insurance premium at 1 1% of the sum of the employee payment bases;

(II) On-the-job employees take their average monthly salary of the previous year as the payment base, and I pay the basic medical insurance premium at 2% of the payment base, which is withheld and remitted by the employer on a monthly basis;

(three) the government will give subsidies according to 0.5% of the sum of the payment bases of employees participating in the basic medical insurance this year.

If the average monthly salary of employees in the previous year is higher than 300% of the average monthly salary of employees in the whole city in the previous year, the payment base shall be determined according to 300% of the average monthly salary of employees in the whole city in the previous year; If the average monthly salary of employees in the previous year was lower than 60% of the average monthly salary of employees in the whole city in the previous year, the payment base shall be determined according to 60% of the average monthly salary of employees in the whole city in the previous year.

The basic medical insurance premium shall not be reduced or exempted, excluding tax. Seventh demobilized soldiers, other provinces and cities transferred to the city, new employment and re employment and other new personnel have the base of the year, by the employer truthfully declare; If there is no payment base in that year, it shall be determined by the employer according to the employee's own salary. Article 8 The employing unit shall pay medical assistance for major diseases according to the number of employees in the unit and the standard of 5 yuan per person per month.

Retirees participate in the basic medical insurance according to the relevant provisions of this Municipality, and their individuals do not pay the basic medical insurance premium and medical assistance for major diseases. Article 9 The employing unit shall go through the formalities of basic medical insurance at the medical insurance agency according to regulations. Tenth basic medical insurance and medical assistance for major diseases shall be paid in advance in the current month and enjoyed in the next month. Eleventh basic medical insurance premiums and medical assistance for major diseases paid by the employer shall be collected in accordance with the channels prescribed by the financial department. Article 12 The employing unit shall pay the basic medical insurance premium and medical assistance fee for major diseases in full and on time. If the employer fails to pay in accordance with the provisions, the tax department shall order it to pay within a time limit. Overdue payment or underpayment, from the date of unpaid or underpaid, an overdue fine of 2‰ of the payable amount will be added daily, and the overdue fine will be incorporated into the basic medical insurance fund.

The basic medical insurance premium and medical assistance fee for major diseases shall be collected by local tax authorities at all levels on a monthly basis, and the specific collection measures shall be formulated separately by the local tax authorities of the city. Thirteenth basic medical insurance funds and medical assistance funds for major diseases (hereinafter referred to as medical insurance funds) shall be managed in accordance with the relevant administrative measures of the municipal social security fund. Article 14 The Social Insurance Fund Supervision Committee shall supervise the revenue and expenditure management of the medical insurance fund in accordance with laws, regulations and relevant provisions. Fifteenth medical insurance fund interest is calculated according to the following methods: the part raised in the current year bears interest at the deposit rate; The fund principal and interest carried forward from the previous year shall bear interest at the bank deposit rate of lump-sum deposit for 3 months; The deposited funds deposited in the social security financial special account shall bear interest at the 3-year zero deposit and lump-sum deposit rate not lower than the interest rate of this grade. Article 16 When employees go through retirement formalities, their basic medical insurance payment period (including deemed payment period) is 15 years, and their actual payment period meets one of the following conditions, they can enjoy basic medical insurance benefits after going through retirement formalities:

(a) since the date of implementation of these Provisions, it has been paid for 5 years as required;

(two) unable to pay for 5 years, but continuous payment to the statutory retirement age.

Do not meet the above conditions, according to the provisions of a one-time payment of basic medical insurance premiums and medical assistance for major diseases, can also enjoy the basic medical insurance benefits after retirement procedures.
