Regulations of Zaozhuang Municipality on Rural Roads

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the National Highway Law of the People's Republic of China, the Regulations of Shandong Province on Rural Roads and other relevant laws and regulations, in combination with the actual situation of this Municipality, in order to promote the development of rural roads, serve the rural revitalization and promote and guarantee the modernization of agriculture and rural areas. Article 2 These Regulations shall apply to the planning, construction, management, maintenance, operation and related activities of rural roads within the administrative area of this Municipality.

The term "rural roads" as mentioned in these Regulations refers to county roads, township roads, village roads and their ancillary facilities that are incorporated into rural road planning and built in accordance with national and provincial technical standards. Article 3 The development of rural roads shall follow the principles of overall planning, adjusting measures to local conditions, protecting the ecological environment, and paying equal attention to construction, management and transportation, and shall be led by the government, coordinated by departments, participated by the society, responsible at different levels, and managed at different levels. Article 4 The municipal, district (city) people's governments shall strengthen their leadership over rural highway work, incorporate rural highway development into the national economic and social development plan, establish and improve the rural highway construction, maintenance and management system, improve the working mechanism, increase policy and financial support, and promote the coordinated and sustainable development of rural highway undertakings.

The district (city) people's government is the main body responsible for the construction, management and maintenance of rural roads within its administrative area, and should incorporate rural road work into the government's work objectives, and organize and coordinate relevant departments to do a good job in rural road work.

Town People's Government and sub-district offices shall, within the scope of duties determined by the district (city) people's government, do a good job in rural highway work, and designate corresponding working institutions and staff to be specifically responsible for the construction, maintenance and management of township roads and village roads.

Villagers' committees and residents' committees, under the guidance of the town people's government and sub-district offices, assist in the management and daily maintenance of village roads, and guide villagers and residents to incorporate the protection of village roads into village rules and regulations. Article 5 The municipal transportation department is responsible for supervising and guiding the construction, management, maintenance and operation of rural roads in the whole city.

District (city) transportation departments are responsible for the construction, operation, maintenance and management of county roads and rural roads within their respective administrative areas.

Development and reform, public security, finance, natural resources and planning, ecological environment, housing and urban construction, urban and rural water supply, agriculture and rural areas, culture and tourism, emergency management, urban management, forestry and greening, market supervision and other relevant departments shall, in accordance with the division of responsibilities, do a good job in rural roads. Sixth people's governments at all levels should strengthen publicity and education of rural highway laws and regulations, and raise the awareness of the whole society to care for highway and traffic safety. Article 7 No unit or individual may destroy, damage, illegally occupy or use rural roads, land used for roads and ancillary facilities of roads, or illegally interfere with the construction, management, maintenance and operation of rural roads. Chapter II Planning and Construction Article 8 Rural highway planning shall conform to the national spatial planning and ecological environment protection planning, and build a rural highway network with appropriate proportion, reasonable layout, smooth connection, safety and convenience, and be coordinated with the development planning of national highways, provincial highways and other modes of transportation, and adapt to the planning of rural passenger transport and rural logistics. Article 9 Rural highway planning includes county road planning, township road planning and village road planning. County road planning should be coordinated with provincial road planning, township road planning should be coordinated with county road planning, and village road planning should be coordinated with township road planning.

County road planning by the district (city) department in charge of transportation in conjunction with the relevant departments at the same level, after the audit by the people's government at the same level, reported to the Municipal People's government for approval, and submitted to the provincial department in charge of transportation for the record.

Township road planning, village road planning by the district (city) department in charge of transportation to assist the town people's government, street offices to organize the preparation, reported to the district (city) people's government for approval, and reported to the municipal department in charge of transportation for the record. Tenth national economic and social development planning, land space planning, etc ... , involving the content of rural highway planning, should seek the opinions of the transportation departments at the same level.

Village road planning should listen to the opinions and suggestions of villagers' committees, residents' committees, schools, enterprises and other organizations along the line. Rural passenger stations and logistics outlets should be unified planning and overall construction with rural roads, and meet relevant standards. Article 11 Land for construction of county roads and township roads shall be incorporated into the overall arrangement of the annual land use plan of the district (city) people's government, and land for construction of village roads shall be settled by the district (city) people's government, the town people's government and the sub-district office in accordance with the relevant provisions within the scope of unused land and agricultural land. If it is necessary to go through the relevant formalities, it shall be handled according to law. Twelfth rural highway construction should save land, protect cultivated land, and make full use of existing roads and other resources for reconstruction or expansion.

Encourage the application of new technologies, new materials, new processes and new equipment in rural highway construction, rationally use environmental protection technologies and materials, and promote the recycling of resources. Thirteenth new county roads are not less than the technical standards of secondary roads, and the rebuilt county roads are not less than the technical standards of tertiary roads; New construction and reconstruction of rural roads shall not be lower than the technical standards of tertiary roads; Newly built and rebuilt village roads shall not be lower than the technical standards of two-lane four-grade highways.
