Interim Measures of Wuhan Municipality on the Administration of Police Auxiliary Personnel of Public Security Organs

Chapter I General Provisions Article 1 These Measures are formulated in accordance with the relevant laws, regulations and provisions of the State and in the light of the actual situation of this Municipality in order to standardize the management of police auxiliary personnel in public security organs, safeguard their legitimate rights and interests, and give full play to their auxiliary role in social security management. Article 2 These Measures shall apply to the employment, performance, security, supervision and management of police auxiliary personnel of public security organs in this Municipality. Unless otherwise stipulated by the state or province, such provisions shall prevail. Article 3 The term "police auxiliary personnel" as mentioned in these Measures refers to non-people police personnel who are openly recruited by the public security organs with the approval of the people's government at the same level according to their work needs and provide auxiliary support for the daily operation and police activities of the public security organs. Article 4 The municipal and district public security organs (including Wuhan East Lake New Technology Development Zone, Wuhan Economic and Technological Development Zone, East Lake Eco-tourism Scenic Area and Wuhan Chemical Industry Zone, the same below) are responsible for the use and management of police auxiliary personnel. The municipal public security organ shall be responsible for guiding and supervising the use and management of police auxiliary personnel of district public security organs.

The municipal and district financial departments shall include the salary and welfare, social security, clothing and equipment, education and training, pension subsidies and daily management of police auxiliary personnel into the financial budget at the corresponding level, and increase the level of protection year by year according to the economic and social development.

City, district human resources and social security, civil affairs and other departments shall, in accordance with their respective responsibilities, do a good job in the supervision, management and protection of police auxiliary personnel. Article 5 The management of police auxiliary personnel shall follow the principles of combining management according to law with standardized use, and combining supervision and restraint with incentives and guarantees. Article 6 Auxiliary police shall consciously accept the supervision of citizens and society when performing their duties.

Any unit or individual may complain and report to the public security organ about the acts of police auxiliary personnel in violation of the provisions of these measures. Chapter II Rights and Obligations Article 7 Under the command and supervision of the public security organs and the people's police, auxiliary police officers shall assist the people's police in carrying out corresponding work.

According to the job responsibilities and nature, police auxiliary personnel are divided into civilian auxiliary police and service auxiliary police. Eighth civilian auxiliary police engaged in the following work:

(a) clerical assistant, file management, wiring inquiry, window service, certificate handling, network information access, video surveillance, information collection and entry and other administrative assistant work;

(2) Psychological consultation, medical treatment, translation, audio-visual production, computer network maintenance, data analysis, software development, communication guarantee, financial management, on-site investigation, technical inspection, marine engine driving and maintenance, etc. ;

(3) Police services, such as keeping and maintaining police equipment other than weapons and police equipment, and logistics services;

(4) Other jobs performed by civilian auxiliary police. Article 9 The auxiliary police in active service shall engage in the following work:

(a) To help prevent and stop illegal and criminal activities;

(two) to assist in the development of bayonet duty, public security patrol, public security inspection and safety inspection of personnel gathering places;

(three) to assist in the investigation, blocking, monitoring and detention of criminal suspects;

(four) to help maintain the order of cases (events), protect cases (events), and rescue the wounded;

(five) to help ease traffic, inform, discourage and correct traffic safety violations;

(six) to assist in the daily management of drug addicts, to inspect precursor chemicals enterprises and to collect drugs;

(seven) to assist in the management and supervision of public security;

(eight) to participate in fire fighting and rescue, and to assist in fire supervision and management;

(nine) to assist in carrying out legal publicity and education on safety prevention, traffic safety and drug control;

(10) Training police dogs;

(eleven) other work carried out by the service auxiliary police. Tenth auxiliary police shall not engage in the following work:

(1) domestic security, technical reconnaissance, anti-cult and anti-terrorism work;

(2) Handling work matters involving state secrets;

(three) the case investigation and evidence collection, issue an appraisal report, and identify the responsibility for traffic accidents;

(4) Implementing administrative or criminal compulsory measures, making administrative decisions and examining cases;

(5) Keeping weapons and police equipment;

(six) the work that must be completed by the people's police of the public security organ according to laws and regulations. Article 11 The public security organ shall, in accordance with the provisions of Articles 8 and 9 of these Measures, formulate job descriptions for police auxiliary personnel, and make specific provisions on their job responsibilities, tasks and standards. Article 12 Auxiliary police officers shall enjoy the following rights:

(a) to obtain the working conditions that should be met to perform their duties;

(two) to receive wages and enjoy social insurance, paid annual leave, casualty pension and other benefits;

(three) to participate in business knowledge training;

(four) to put forward opinions and suggestions on the work of this unit;

(five) unable to implement the work arrangements or orders in violation of laws, regulations and the provisions of these measures;

(six) to lodge complaints and accusations according to law;

(seven) to terminate the labor contract according to law;

(eight) other rights stipulated by laws, regulations and these measures. Thirteenth police auxiliary personnel shall abide by the work discipline and perform the following obligations:

(a) abide by laws, regulations, rules and the management system of public security organs;

(two) according to the authorization to use the public security information system, to ensure the security of the public security information network, and to keep the secrets of police work;

(3) Obey the management of public security organs and the command of the people's police, and consciously safeguard the reputation and image of public security organs;

(four) civilized duty, fulfill their duties, abide by social morality, respect people's customs.
