1996 to 1997 studied in the third grade of junior high school in Pennsylvania, and won the provincial key middle school binyang middle school with excellent results; 65438+ 1997-2000 studied in binyang middle school; 1999-2000 studied in the third grade of senior high school, with excellent results, and was rated as "three excellent students in the province"; From 2000 to 2004, I studied biotechnology in the School of Biochemistry of Yunnan University. On the night of February 13, 2004, one person was killed, and on the night of February 1 4, two people were killed and fled Kunming Railway Station. On March 5, 2004, Kloc-0 was listed as a wanted criminal by the Ministry of Public Security. He was executed on 6 July 2004.

In 2004, four people were killed in Dayun University dormitory, which triggered the Ma Jiajue incident and caused a sensation throughout the country.

On February 23, 2004, the Public Security Bureau of Kunming City, Yunnan Province, after receiving the report, found four dead people who were beaten to death by blunt instruments in the cupboard of a dormitory in the student apartment of Yunnan University. On March 1, the Ministry of Public Security issued an A-level wanted order against Ma Jiajue, a fugitive murder suspect. The public security organ offered a reward of 200,000 yuan to catch the criminals wanted all over the country.

On March 6th, when interviewed by reporters, Ma Jiajue's father wrote a letter to persuade his son to turn himself in. He said in the letter: You usually say that you should repay your parents when you grow up. Now, after you disappeared, we cried every day. Your mother is very ill. How much she wants to see you! ..... Son, you have been a good boy who respects your parents since childhood. We believe that you won't let us suffer this pain forever.

On March 12, the Guangdong Provincial Public Security Department forwarded the Circular of the Ministry of Public Security on the Investigation of Ma Jiajue Clues: The police investigation found that it was possible for Ma Jiajue to leave Kunming for Guangdong by train on the afternoon of February 17, 2004, and the itinerary and time involved included: 2060 Kunming-Zhanjiang, with the time of 20: 41; Kunming-Guangzhou 1 166 times at 23:23. At about 7: 30 pm on March 15, Ma Jiajue was captured in Hexi District, Sanya City.

On April 22nd, Kunming Intermediate People's Court held a public hearing on Ma Jiajue's case of suspected intentional homicide and incidental civil action, and made a criminal incidental civil judgment on April 24th, finding Ma Jiajue guilty of intentional homicide, sentenced to death and deprived of political rights for life. He was ordered to pay 20,000 yuan to Tang Xianhe, 20,000 yuan to Shao and Huang Xiemei, and 20,000 yuan to Yang Shaoquan and Ma Cunying. After the verdict was pronounced, Ma Jiajue failed to appeal within the statutory time limit, and the Kunming Intermediate People's Court requested the Yunnan Provincial High Court to approve Ma Jiajue's death sentence.

At 9: 00 am on June 17, 2004, the Higher People's Court of Yunnan Province ruled that the Kunming Intermediate People's Court sentenced Ma Jiajue to death for intentional homicide and deprived him of his political rights for life. After sentencing, Ma Jiajue was taken to the execution ground for execution.

After examination, the Yunnan Higher People's Court held that Ma Jiajue had the evil thoughts of revenge and murder because he couldn't correctly handle interpersonal relationships, ignored national laws, and had a deep grudge with his classmates because of some trivial matters. After careful planning and preparation, he brutally killed four classmates, subjectively intentionally deprived others of their lives, and objectively carried out the act of illegally depriving others of their lives, which constituted the crime of intentional homicide.

In the whole criminal process, the murderer who killed Ma Jiajue was firm and cruel when committing the crime; Hiding the victim's body and absconding after killing is a criminal act with great social harm, especially bad circumstances and serious consequences, which should be severely punished according to law. Ma Jiajue's defender's defense opinion about Ma Jiajue's confession and repentance is true, but Ma Jiajue's crime is extremely serious and will not be given a lighter punishment. The first-instance judgment is accurate, the sentencing is appropriate, and the trial procedure is legal. Therefore, it made a ruling and approved the Kunming Intermediate People's Court to sentence Ma Jiajue to death for intentional homicide.
