Chapter I General Provisions Article 1 In order to strengthen the management of talent flow, standardize the order of talent flow, promote the rational allocation of talents, safeguard the legitimate rights and interests of the parties and ensure the healthy development of economic construction, these Regulations are formulated in accordance with the relevant laws and regulations of the state and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the flow of talents and related behaviors and activities within the administrative area of this Municipality.

The term "talent flow" as mentioned in these Regulations refers to obtaining professional and technical post qualifications, and employing or changing professional and technical personnel, management personnel and other personnel with professional skills and management ability through mutual selection with the employer.

The relevant behaviors and activities mentioned in the first paragraph of this article refer to the behaviors and activities such as talent recruitment, job application, dispute settlement of talent flow and providing intermediary services for talent flow.

These Regulations shall not apply to the management of labor contracts, the management of employment introduction and the arbitration of labor disputes. Article 3 The flow of talents shall follow the principles of respecting employers and talents' independent job selection and being conducive to the rational allocation, development and use of human resources. Article 4 People's governments at all levels shall, according to the needs of economic and social development, formulate policies and measures, create conditions, guide and promote the rational flow of talents, support employers to increase investment, train and attract talents, and establish a mechanism for rational use of talents.

Encourage talents to flow to the key and urgently needed construction projects, scientific research projects, industries, departments and regions of the country and this Municipality. Article 5 The municipal personnel administrative department is the competent department of talent flow in this Municipality.

The district and county personnel administrative departments shall, under the guidance of the municipal personnel administrative department, supervise and manage the flow of talents within their respective administrative areas.

Industry and commerce, finance, price, public security, education and other departments shall, according to their respective responsibilities, do a good job in the management of talent flow. Chapter II Intermediary Service Organizations Article 6 The flow of talents can be conducted through intermediary service organizations for the flow of talents. Article 7 The establishment of an intermediary service agency for the flow of talents shall meet the following conditions:

(1) Having a standardized name, a fixed activity place and necessary facilities;

(2) Its registered capital is not less than 200,000 yuan;

(3) The business scope and activities of the application comply with the provisions of relevant laws and regulations;

(4) Having a sound management system and articles of association;

(five) full-time staff of not less than five people, must have a college degree or above, and obtain a certificate of talent flow business training;

(6) Being able to bear civil liability independently.

Overseas companies, enterprises, other organizations or individuals set up intermediary service agencies for talent flow in this city, which shall be handled in accordance with the relevant provisions of the state. Eighth the establishment of talent flow intermediary service institutions shall be approved by the municipal personnel administrative department.

Municipal units, the central government and other provinces and cities shall submit a written application to the municipal personnel administrative department for the establishment of talent flow intermediary service institutions in this Municipality; Other units that set up talent flow intermediary service institutions in this Municipality shall submit a written application to the personnel administrative department of the district or county where they are located. When submitting an application, the applicant shall also submit the relevant certification materials stipulated in Article 7 of these Regulations.

The district and county personnel administrative departments shall put forward preliminary examination opinions within fifteen days from the date of receiving the written application and report to the municipal personnel administrative department for examination and approval.

After receiving the application or preliminary examination opinions, the municipal personnel administrative department shall make a decision on approval or disapproval within fifteen days. Meet the conditions, approved the establishment, and issued the "talent flow intermediary service license"; Do not meet the conditions, shall not be approved, and explain the reasons to the applicant. Article 9 An applicant can only carry out intermediary service activities after receiving the Permit for Intermediary Service of Talent Flow and going through corresponding procedures in accordance with relevant regulations. Tenth talent flow intermediary service institutions need to change the registered items or terminate the business, it shall go through the formalities of change or termination in accordance with the original application procedures. Eleventh personnel administrative departments to implement the annual inspection of talent flow intermediary service institutions. Twelfth talent flow intermediary service institutions approved by the competent department, can carry out the following business:

(1) Collecting, sorting, storing and publishing information on talent supply and demand;

(two) to carry out the evaluation of talent quality;

(3) Organizing talent recruitment;

(4) organize personnel training;

(5) Providing talent consultation;

(6) Other businesses permitted by laws and regulations. Thirteenth approved by the municipal administrative department of personnel with the ability of file management intermediary service institutions, can be entrusted by the administrative department of personnel to carry out file management and related business. Fourteenth talent flow intermediary service institutions to hold a city-wide or regional large-scale talent exchange fair, it should submit a written application to the municipal or district/county personnel administrative department in advance; The municipal or district/county personnel administrative department shall make a decision of approval or disapproval within five days from the date of accepting the application, and notify the applicant in writing. Fifteenth talent intermediary service institutions to hold a city-wide or regional large-scale talent exchange fair, shall meet the following conditions:

(a) there are funds and places needed to hold talent exchange meetings;

(2) The name and activities of the fair are in line with the business scope of the organizer;

(3) Qualification examination of talent recruitment units;

(4) Having working institutions, personnel and safety measures suitable for the scale of the fair;

(5) Having the approval document of the public security department.
