Enrollment requirements for children of migrant workers in Xi’an

Legal analysis: Household registration certificate: The original household registration certificate and the parents’ ID card (copy) of the migrant children who have the same household registration as their parents.

Residence certificate: Xi'an residence permit or Xi'an residence certificate of both parents of the children who are moving with them. Among them, migrant workers with non-Xi'an household registration must provide Xi'an residence certificate and related materials processed by the public security department; migrant workers with household registration outside the 10 districts of Xi'an City (including Fengdong New Town) must provide Xi'an residence certificate and related materials processed by the community.

Article 8 When recruiting workers, the employer shall truthfully inform the workers of the work content and working conditions , work place, occupational hazards, safety production conditions, labor remuneration, and other information that workers require to know; the employer has the right to know the basic information of workers directly related to the labor contract, and workers should explain it truthfully.

Article 9 When an employer recruits workers, it shall not detain the workers’ resident identity cards and other documents, require the workers to provide guarantees, or collect property from the workers in other names.

Article 10 To establish a labor relationship, a written labor contract shall be concluded. If a labor relationship has been established but a written labor contract has not been concluded at the same time, a written labor contract must be concluded within one month from the date of employment. If the employer and the employee conclude a labor contract before employment, the labor relationship is established from the date of employment.
