Regulations of Changchun Municipality on Gas Management

Chapter I General Provisions Article 1 In order to strengthen gas management, ensure gas supply, prevent and reduce gas accidents, safeguard citizens' lives, property and public safety, safeguard the legitimate rights and interests of gas trading enterprises and gas users, and promote the healthy development of gas industry, these Regulations are formulated in accordance with the relevant provisions of laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the management of gas within the urban area of this Municipality. Article 3 The municipal public utilities department is responsible for the management of gas in this Municipality.

The District People's Government shall, in accordance with the division of responsibilities, be responsible for the management of gas within its jurisdiction.

Development and reform, planning, construction, land, real estate, industry and information technology, public security, safety supervision, quality supervision, environmental protection, industry and commerce, transportation and other relevant departments shall, according to their respective functions and duties, do a good job in gas management according to law. Fourth gas work should adhere to the principles of overall planning, ensuring safety, ensuring supply, standardizing services, energy saving and high efficiency. Article 5 The Municipal People's Government shall encourage and support the research of gas science and technology, and promote the use of new technologies, new processes and new products of gas that are safe, energy-saving, efficient and environmentally friendly. Sixth municipal public departments should establish and improve the supervision and management system of gas safety, publicize and popularize gas laws and regulations and safety knowledge, and raise the awareness of gas safety of the whole people. Chapter II Gas Planning and Construction Article 7 The municipal public utility department shall, jointly with the municipal urban and rural planning department, organize the preparation of special gas planning according to the overall urban planning, and organize its implementation after approval by the Municipal People's Government. Eighth municipal public utilities, municipal development and reform departments shall be responsible for coordinating the supply of gas sources in accordance with their respective responsibilities, balancing the city's gas demand, formulating long-term and annual gas plans, and organizing their implementation. Ninth Municipal People's Government shall establish and improve the gas emergency reserve system, organize the preparation of gas emergency support plans, and take comprehensive measures to improve the gas emergency support capacity.

The gas emergency support plan shall specify the gas emergency gas sources and types, emergency supply methods, emergency disposal procedures and emergency rescue measures.

The municipal public sector shall monitor, forecast and warn the gas supply and demand. Tenth gas supply is seriously insufficient, supply interruption and other emergencies, the Municipal People's Government shall promptly take emergency measures such as using reserves, emergency dispatching, gas enterprises and other relevant units and individuals shall cooperate and undertake relevant emergency tasks. Eleventh in the construction of new areas and the transformation of old areas, gas facilities should be built or land reserved for gas facilities in accordance with urban and rural planning and special gas planning.

In the construction of gas facilities within the scope of special gas planning, the competent department of urban and rural planning of the city shall solicit the opinions of the municipal public utilities department on whether the construction of gas facilities conforms to the special gas planning; Do not need to issue site submissions, the municipal competent department of urban and rural planning shall solicit the opinions of the municipal public utilities department on whether the construction of gas facilities conforms to the special gas planning when issuing the construction land planning permit or the rural construction planning permit according to law. Twelfth new construction, expansion and reconstruction of gas facilities construction projects, should meet the requirements of national norms and industry technical standards, and approved by the municipal public authorities. If the laws and regulations require the approval of other departments, the relevant departments shall also handle the relevant procedures. Thirteenth units engaged in the survey, design, construction and supervision of gas facilities construction projects shall have corresponding qualifications and engage in business activities according to law within the scope of their qualification grades. Fourteenth gas facilities construction engineering design documents shall be reviewed by institutions with the qualification of gas engineering design review; Without examination or examination unqualified, shall not be used. Fifteenth gas facilities after the completion of the construction project, the construction unit shall organize the completion acceptance according to law, and within fifteen days from the date of completion acceptance, the completion acceptance information and the safety operation guarantee scheme of gas facilities shall be reported to the municipal public authorities for the record.

The construction unit shall, within three months after the completion and acceptance of the gas facilities construction project, submit the project files to the municipal urban construction archives management institution. Sixteenth new construction, expansion and reconstruction projects within the scope of special gas planning, the supporting gas facilities construction should be designed, constructed and accepted at the same time as the main project. Seventeenth approved pipeline gas project, the household pipeline really needs to pass through the relevant units or residential buildings, the relevant units and individuals shall cooperate.

The construction unit shall solicit the opinions of the obligee before construction and sign an agreement with the obligee; If the construction causes damage to the relevant facilities of relevant units or individuals, it shall be repaired or compensated. Eighteenth construction, survey, design, construction, supervision units and other units related to the safety production of gas facilities construction projects shall abide by the provisions of laws and regulations on safety production, ensure the safety production of gas facilities construction projects, and bear the corresponding safety production responsibilities according to law.

Municipal public departments should strengthen the safety supervision and management of gas facilities construction projects. Chapter III Gas Operation and Service Article 19 Enterprises engaged in gas operation in the urban areas of this Municipality shall obtain gas operation licenses.

Enterprises engaged in pipeline gas business shall also obtain the franchise granted by the Municipal People's Government.
