Regulations of Shenzhen Special Economic Zone on Auxiliary Police

Chapter I General Provisions Article 1 These Regulations are formulated in accordance with the basic principles of relevant laws and administrative regulations and the reality of Shenzhen Special Economic Zone in order to standardize the management of police auxiliary personnel in public security organs, ensure that police auxiliary personnel perform their duties according to law, and give full play to the role of police auxiliary personnel in maintaining social order, cracking down on illegal crimes and serving the people. Article 2 These Regulations shall apply to the duties, recruitment and management of auxiliary police in Shenzhen Special Economic Zone. Article 3 The auxiliary police referred to in these Regulations (hereinafter referred to as auxiliary police) refers to the personnel recruited and managed by the public security organs in a unified way, who perform the duties stipulated in these Regulations and provide auxiliary police support for the daily operation and police activities of the public security organs.

Auxiliary police are divided into service auxiliary police and civilian auxiliary police. Article 4 Auxiliary police shall carry out auxiliary police work under the command and supervision of public security organs and their people's police.

Citizens, legal persons and other organizations shall support and cooperate with the auxiliary police in performing their duties according to law. Article 5 The Municipal People's Government shall rationally allocate auxiliary police according to the social security situation and police force allocation, and incorporate them into the special plans related to national economic and social development.

The municipal and district people's governments shall include the auxiliary police's salary and welfare, equipment allocation, education and training, daily management and other funds into the fiscal budget at the corresponding level to guarantee it. Article 6 The municipal public security organ shall be responsible for the recruitment and management of auxiliary police. The auxiliary police unit is responsible for the daily management of the auxiliary police.

The municipal organization department is responsible for the approval and dynamic adjustment of auxiliary police posts.

The municipal human resources and social security department is responsible for the recruitment guidance and salary standard approval of the auxiliary police.

The municipal and district finance departments are responsible for the funding guarantee for the recruitment and management of auxiliary police. Chapter II Responsibilities Article 7 The auxiliary police in active service shall assist the people's police in law enforcement and other police work; Civilian auxiliary police are engaged in non-law enforcement posts in public security organs.

The behavior of auxiliary police in performing their duties according to law is protected by law and has legal effect, and the consequences of performing their duties are borne by their public security organs. Eighth according to the arrangement of the public security organs, auxiliary police can engage in the following police work:

(a) to prevent and stop illegal and criminal activities;

(2) Accepting and handling people's requests for help and mediating civil disputes according to law;

(3) Public security patrol and duty;

(four) to carry out safety inspections at stations, airports, docks and other places where people gather;

(five) to maintain the order of the case (incident), protect the case (incident) and rescue the injured and trapped people;

(six) to divert traffic, discourage traffic safety violations, and collect traffic violation information;

(seven) fire safety inspection;

(eight) to carry out publicity and education on social security, traffic safety, drug control and fire safety;

(nine) other duties as prescribed by laws and regulations.

The service auxiliary police shall be engaged in items 3, 4 and 7 of the preceding paragraph, and shall not be less than two when they are not under the leadership of the people's police. Article 9 According to the arrangement of the public security organ, the auxiliary police in active service may engage in the following police work under the leadership of more than one people's police:

(a) received an alarm for on-site disposal;

(2) Conducting on-site cross-examination and examination of persons suspected of committing crimes, and continuing cross-examination;

(3) Summoning, arresting and escorting criminal suspects;

(four) to investigate and collect evidence from administrative cases and implement administrative compulsory measures such as sealing up, detaining and compulsory testing;

(five) to take temporary protective restraint measures for drunken people who are out of control and mental patients who commit violent acts;

(six) public security and fire supervision and inspection;

(seven) the management of detention centers, detention centers, compulsory isolation drug rehabilitation centers, detention centers, law enforcement areas and other places;

(eight) involving property management;

(9) Verification of personnel identity information;

(ten) to maintain the order of large-scale public activities;

(eleven) the handling of mass incidents;

(twelve) other duties as prescribed by laws and regulations.

The Criminal Procedure Law of People's Republic of China (PRC) stipulates that the people's police shall not be less than two people to carry out relevant work, and its provisions shall prevail. Article 10 According to the arrangement of the public security organ, the civilian auxiliary police may engage in the following work:

(1) Technical support for computer network communication, on-site investigation, inspection and appraisal;

(two) wiring inquiry, data analysis, video monitoring, information collection and entry, police equipment maintenance and other police security work;

(three) clerical assistant, file management, license handling and other administrative assistant work;

(four) psychological counseling, medical treatment, translation and other work that can be completed by the civilian auxiliary police. Eleventh public security organs shall not arrange auxiliary police to handle matters involving state secrets, engage in domestic public security, criminal case investigation and evidence collection, implement criminal compulsory measures, conduct technical reconnaissance, identify the responsibility for traffic accidents, and make administrative decisions. Chapter III Recruitment Conditions and Procedures Article 12 The recruitment of auxiliary police officers shall follow the principles of openness, fairness and merit, unify recruitment standards and procedures, and strictly select and use them. Thirteenth auxiliary police recruitment by the municipal public security organs according to the auxiliary police positions approved by the municipal organization department, according to the annual recruitment plan, unified organization and implementation. Fourteenth auxiliary police candidates shall meet the following conditions:

Support the Constitution and abide by laws, regulations and social ethics;

(2) People's Republic of China (PRC) citizens who have reached the age of 20;

(3) Having a college degree or above;

(4) Having the physical quality and working ability required to perform their duties;

(five) other conditions stipulated by the municipal public security organs.

Retired non-commissioned officers and soldiers who apply for the auxiliary police can have a high school education or above. However, those who have not obtained a college degree or above shall obtain a college degree or above within the longest four years after joining the company; Those who have not obtained a college degree or above within four years will not be renewed after the expiration of their employment.
