What is the qualification standard of Henan real estate developers?

The developer's development qualification is divided into several categories: first, second, third, fourth and tentative.

The qualification of developers is often directly related to their financial strength (registered capital) and project development ability, which is implemented in accordance with the Regulations of the Ministry of Construction on the Qualification Management of Real Estate Development Enterprises.

The conditions for enterprises with different qualification levels are as follows:

(1) Level 1 qualification:

1. The registered capital is not less than 50 million yuan;

2. Engaged in real estate development and operation for more than 5 years;

3. In the past three years, the accumulated housing construction area is more than 300,000 square meters, or the accumulated investment in real estate development is equivalent to this;

4. The qualified rate of construction engineering quality has reached100% for five consecutive years;

5. The housing construction area in the last year is more than 6.5438+0.5 million square meters, or the investment in real estate development is equivalent to this;

6. There shall be no less than 40 professional managers with professional titles in construction, structure, finance, real estate and related economy, including no less than 20 managers with intermediate or above titles and no less than 4 full-time accountants with qualification certificates;

7. The person in charge of engineering technology, finance, statistics and other businesses has the corresponding professional intermediate title or above;

8. Have a perfect quality assurance system, and implement the system of "Residential Quality Guarantee" and "Residential Instruction Manual" in the sales of commercial housing;

9. No major engineering quality accidents occurred.

(2) Secondary qualification:

1. The registered capital is not less than 20 million yuan;

2. Engaged in real estate development and operation for more than 3 years;

3. In the past three years, the accumulated housing construction area is more than 6,543,800+0.5 million square meters, or the accumulated investment in real estate development is equivalent to this;

4. The qualified rate of construction engineering quality has reached100% for three consecutive years;

5. Last year, the building area was more than 654.38 million square meters, or the investment in real estate development was equivalent to this;

6. There shall be no less than 20 managers with professional titles in architecture, structure, finance, real estate and related economy, including no less than 10 managers with intermediate professional titles and no less than 3 full-time accountants with qualification certificates;

7. The person in charge of engineering technology, finance, statistics and other businesses has the corresponding professional intermediate title or above;

8. Have a perfect quality assurance system, and implement the system of "Residential Quality Guarantee" and "Residential Instruction Manual" in the sales of commercial housing;

9. No major engineering quality accidents occurred.

(3) Level III qualification:

6. Engineering, finance and other business leaders have corresponding professional intermediate titles or above, and statistics and other business leaders have corresponding professional junior titles or above;

7. Have a perfect quality assurance system, and implement the system of "Residential Quality Guarantee" and "Residential Instruction Manual" in the sales of commercial housing;

8. No major engineering quality accidents occurred.

(4) Level 4 qualification:

1. The registered capital is not less than1000000 yuan;

2. Engaged in real estate development and management 1 year or more;

3. The qualified rate of construction project completion quality100%;

4. Not less than 5 professional managers with professional titles in architecture, structure, finance, real estate and related economy, and not less than 2 full-time accountants with qualification certificates;

5. The person in charge of engineering technology has the corresponding professional intermediate title or above, and the person in charge of finance has the corresponding professional junior title or above, and is equipped with professional statisticians;

7. No major engineering quality accidents occurred.

Generally, newly established real estate development enterprises will first set a tentative qualification, and after one year, the qualification level will be approved according to the enterprise performance. Temporary qualification is valid for one year and can be extended twice for one year each time.

Article 10 (Qualification) An enterprise applying for the qualification of a real estate development enterprise shall meet the following basic conditions:

(1) Having a real estate development project manual filed by the real estate development department;

(2) It has a perfect quality assurance system, and the system of "Residential Quality Guarantee" and "Residential Instruction Manual" has been implemented in the sales of commercial housing;

(3) No major engineering quality accident occurred;

(4) It has not committed any of the following illegal acts in the past three years:

1. Engaged in real estate development and management beyond the qualification level, and the circumstances are serious;

2. Land hoarding, unauthorized change of plot ratio, real estate hoarding, price gouging and other illegal development behaviors, if the circumstances are serious, verified by the relevant administrative departments;

3. In the process of development and operation, group complaints affecting social stability are triggered, and it is verified that they are mainly responsible;

4 other serious illegal development activities that should be investigated for legal responsibility.

Article 11 (Grade I Qualification) The requirements for Grade I qualification are as follows:

(1) The monetary form of paid-in registered capital is not less than 200 million yuan;

(three) in the past three years, the housing construction area has been completed over 600,000 square meters;

Article 12 (Secondary Qualification) The secondary qualification requirements are as follows:

(1) The monetary form of paid-in registered capital shall be no less than RMB 654.38 billion;

(2) Having developed two or more real estate development projects, and having obtained Grade III qualification for more than 2 years;

(three) in the past three years, the housing construction area has been completed over 200,000 square meters;

(four) for three consecutive years, the qualified rate of construction engineering quality reached100%;

(5) The building area of the building under construction is more than 654.38+10,000 square meters;

Article 13 (Grade III Qualification) The qualifications for Grade III qualification are as follows:

(3) In the past three years, the accumulated housing construction area has reached more than 654.38 million square meters;

(4) The quality qualification rate of completed construction projects in recent 3 years is100%;

(5) There are not less than 10 professional managers with professional titles in the fields of construction, structure, finance, real estate and related economy, among which there are not less than 5 managers with intermediate or above titles and not less than 2 full-time accountants with qualification certificates;

(six) the person in charge of engineering technology, finance and other business has the corresponding professional intermediate title or above, and the person in charge of statistics and other business has the corresponding professional junior title or above.

Article 14 (Level 4 Qualification) The requirements for Level 4 qualification are as follows:

(1) The paid-in registered capital is not less than RMB 6,543,800,000;

(two) engaged in real estate development and management 1 year or more;

(three) in the past three years, the housing construction area has been completed more than 20 thousand square meters;

(4) The qualified rate of construction project completion quality100%;

(five) there are not less than five professional managers with professional titles in construction, structure, finance, real estate and related economy, and not less than two full-time accountants with qualification certificates;

(six) the person in charge of engineering technology has the corresponding professional intermediate title or above, and the person in charge of finance has the corresponding professional junior title or above, and is equipped with professional statisticians.

Article 15 (Provisional Qualification) An enterprise applying for provisional qualification shall take the existence of the project as the principle, and the paid-in registered capital, cash for management and technical personnel and other conditions shall be commensurate with the scale of the development project undertaken, and shall not be lower than the corresponding conditions of an enterprise with Grade IV qualification.

The net assets of a new real estate development enterprise shall meet the registered capital requirements of the corresponding qualification grade in these Provisions.

Article 16 (Confirmation of Performance) When a real estate development enterprise applies for qualification rating, the declared performance items shall be consistent with those recorded in the real estate development project manual.

The performance of projects developed by subsidiaries after the parent company holds more than 50% of the shares can be included in the performance of the parent company according to the proportion of the parent company. The performance of subsidiaries before the holding behavior shall not be calculated. The performance of subsidiaries that have been included in the parent company will not be recalculated when the qualification is approved.

Temporary employment or part-time management and technical personnel are not included in the total number of enterprise management and technical personnel.

Article 17 (Incentive Measures) The State encourages real estate development enterprises to actively participate in the construction of affordable housing and develop land-saving, energy-saving and environment-friendly housing. Measures for determining the performance of affordable housing and energy-saving and environmental protection housing construction projects undertaken by enterprises shall be formulated separately by the competent department of housing and urban and rural construction in the State Council.

Article 18 The competent department of housing and urban and rural construction of the people's government at the provincial level may, according to the local actual situation, make provisions on the conditions of registered capital, management personnel and technical personnel in the qualification examination standards for real estate development enterprises with Grade II qualification and below.
