Regulations of Harbin Municipality on the Administration of Taxi Passenger Transport

Chapter I General Provisions Article 1 In order to strengthen the management of urban taxi passenger transport, standardize the operating order of taxi market, improve the service quality, safeguard the legitimate rights and interests of passengers, operators and drivers, and promote the healthy development of taxi passenger transport industry, these Regulations are formulated in accordance with the provisions of relevant laws and regulations and combined with the actual situation of this Municipality. Article 2 These Regulations shall apply to the management of taxi passenger transport in the urban areas of this Municipality except Acheng District and Hulan District. Article 3 Taxi passenger transport as mentioned in these Regulations refers to the business activities of providing passenger transport services by using minibuses according to passengers' needs and charging according to mileage or time. Article 4 The management of taxi passenger transport shall adhere to the principles of total regulation, fair competition, standardized operation, excellent service and convenience for the public. Article 5 The municipal traffic administrative department shall be responsible for organizing the implementation of these Regulations.

City taxi management agencies are responsible for the daily management of taxi passenger transport industry.

Development and reform, industry and commerce, public security, finance, quality and technical supervision and other administrative departments shall be responsible for the relevant work of taxi management according to their respective responsibilities. Article 6 The municipal traffic administrative department shall, jointly with the relevant administrative departments, formulate the development plan of urban taxi passenger transport industry according to the economic and social development, urban construction and the demand of taxi passenger transport market in this Municipality, and implement it after being approved by the Municipal People's Government.

The municipal traffic administrative department shall regularly investigate and evaluate the demand of taxi passenger transport market, and put forward suggestions to the Municipal People's Government to adjust the transportation capacity when necessary. Seventh Municipal People's Government shall, according to the changes in the taxi passenger transport market, implement corresponding support policies for the taxi passenger transport industry and form a reasonable price mechanism.

Encourage taxi companies to implement intensive and large-scale operations. Eighth city traffic administrative departments, taxi companies and taxi passenger transport industry associations should improve the quality of employees in the taxi industry and improve the service quality through scientific management, intensive training and civilized service competition. Article 9 A taxi operating enterprise shall establish a trade union organization according to law, participate in mediating labor disputes, and safeguard the legitimate rights and interests of taxi drivers.

Taxi Passenger Transport Industry Association provides services and self-discipline management for taxi operating enterprises and individual operators (hereinafter referred to as operators) and their employees according to the articles of association. Chapter II Business License Article 10 The right to operate a taxi shall be subject to a licensing system.

The right to operate a taxi is transferred with compensation for a period of 8 years. The methods and procedures of paid transfer shall be implemented in accordance with the relevant provisions of the state.

Enterprises and individuals engaged in taxi business activities shall obtain the right to operate taxis.

The right to operate a taxi is subject to the system of one car and one right. Eleventh taxi operators who apply to continue their business after the expiration of the lease term, those who meet the provisions of these regulations can have the priority to obtain the right to operate, and those who pass the examination can enjoy relevant preferential policies. The specific measures shall be formulated separately by the Municipal People's Government. Article 12 An enterprise applying for the right to operate a taxi shall meet the following conditions:

(1) Having a fixed office and parking lot that meets the requirements;

(2) Having a corresponding management system;

(3) Having a good corporate reputation;

(four) there are corresponding car purchase funds or vehicles that meet the operational requirements;

(5) Having technical, financial, safety and management personnel suitable for its business and scale;

(6) Other conditions stipulated by laws and regulations. Thirteenth individuals to apply for the right to operate a taxi shall meet the following conditions:

(a) there are corresponding car purchase funds or vehicles that meet the operational requirements;

(2) Other conditions stipulated by laws and regulations. Fourteenth after the paid transfer of the right to operate a taxi, the municipal transportation administrative department shall sign an agreement on the transfer of the right to operate a taxi with the transferee within 7 working days, and issue a taxi operation certificate and a taxi operation qualification certificate.

Operators shall, by virtue of the Taxi Operation Certificate, go to the taxi management institution of the city to check the operating vehicles, install sign lamps, meters, rent empty cars, post the taxi price label, spray print the name of the taxi company and supervise the telephone number, and receive the Vehicle Operation Certificate issued by the municipal transportation administrative department.

City taxi management agencies should be completed within 7 working days from the date of acceptance. Fifteenth drivers should obtain the "driver passenger qualification certificate" issued by the municipal administrative department of transportation before they can engage in taxi business.

To obtain the Driver's Passenger Transport Qualification Certificate, the following conditions shall be met:

(a) with a "motor vehicle driver's license", driving experience of more than 3 years, and no record of major traffic accidents in the past 3 years;

(two) with the city's permanent residence or temporary residence certificate;

(three) men under the age of 60, women under the age of 55, with junior high school education or above;

(4) No occupational contraindications;

(five) by the municipal administrative department of transportation training and examination;

(6) Other conditions stipulated by laws and regulations.
